服务型政府呼唤公法转型——论通过公法变革优化公共服务

公共服务既是现代政府的核心职能,也是公法研究的时代课题。滥觞于20世纪七、八十年代的全球公共改革运动,其目的就是提高公共服务的能力和水平,建设服务型政府。正处于社会转型过程中的中国公法,应当全面回应建设服务型政府的现实需要,通过公法变革来拓展公共服务范围,确立公共服务原则,建构公私合作公共服务模式,重塑公共服务程序,完善公共服务配套制度,以实现公共服务供求关系的平衡,并推动公法制度体系和理论体系从以强制性行政管理为主旨的传统模式向以公共服务为核心的现代模式的深刻转变。

To achieve the balance between demand and suppy in public service and promote the profound transition of the systematic framework and theoretical framework of public law from the tradition model featuring coercive public administration to the modern model focusing on public service, China's public law during the process of social transition should respond to the practical needs of building a service-oriented government, widen the scope of public service through the transformation of public law, establish principles for public service, build a model of public service based on public-private partnership, rennovating public service procedures, and improve the backup systems for public service.
