惩治犯罪与促进社会发展的统一是刑事政策的精神。新中国成立以来,随着情势变迁,刑事政策审时而变。新中国的基本刑事政策经历了由"镇压与宽大相结合"至"惩办与宽大相结合",再至"宽严相济"的演进历程。镇压与宽大相结合刑事政策,主要针对反革命分子适用,其精神内涵是:镇压反革命,巩固新政权;恢复国民经济,保障三大改造。惩办与宽大相结合刑事政策则适用于所有的犯罪分子,并成为新中国第一部刑法典的立法指针,其精神内涵是:惩治各类犯罪,保障改革开放。在构建"和谐社会"的语境下,宽严相济的刑事政策应运而生,其精神内涵是:打击犯罪与保障人权相统一;以宽济严,构建和谐社会。三种基本刑事政策,不仅仅是在时间上的接续,而且就具体精神内涵而言,后者都是对前者的传承与超越,但总体精神都是惩治犯罪与促进社会发展相统一。  相似文献

Advancement in the field of Information Communication Technologies (ICTs) changes not only our society but also crime. It opens more opportunities for crime and draws people into committing crime, leading to an unprecedented growth in the crime rate. On the other hand, it has also been applied to criminal justice. Crime fighters use the ICTs to control crime and gain efficiency in their policing efforts to service the community. This has led to more effective police work. As both criminals and police benefit from ICTs, these new technologies create new pitfalls for both criminals and law enforcement. Use of technologies by criminals represents challenges and risks to the crime fighter and vice versa. This triggers a crime race and raises notable social concerns on the adverse use and potential abuse of ICTs. Proactive territorial-based regulations, although called for, do not always provide solutions. The borderless nature of ICTs may not allow for rigid regulations and instead challenges the principle of criminal laws. As such, international laws and regulations combined with reliance on technologies are crucial to counter the crime race.  相似文献

The societal definition of crime is eroding. As a consequence of this secular process the focus of interest among criminologists and the agents of the criminal justice system is widening towards the whole of society. A new definition of crime is emerging, based on the difference between dangerous career criminals and spontaneous one time offenders. This difference is determined in terms of personality and character types based on criminological ideas about the typical hard core criminal. 在国际刑事法律公约的订立和各国刑事立法过程中,犯罪化和非犯罪化一直是刑事政策和刑事立法的基本问题。腐败行为犯罪化的意义还在于,随着国际和国内反腐败斗争的不断深入,对公职人员的廉洁性、廉政性的要求越来越高,不廉洁和不廉政行为范围更加扩大,那些原来属于职业道德规范规制的对象,随着人们对这些腐败行为的犯罪化的立法要求和呼声的高涨,这些行为便有可能上升为刑事法律规制的对象。而轻刑化是指对于犯罪的处罚倾向于用较轻的刑罚取代较重刑罚处罚的刑:事政策措施,它表现为用较轻的刑种(如监禁或有期徒刑)取代较重的刑种(如死刑或无期徒刑),或者在同一刑种中用较轻的处罚(如3年以下轻的刑期)取代较重的处罚(如10年以上重的刑期),甚至包括本应用剥夺自由的刑罚取而代之用剥夺财产刑(如没收财产或罚金)和资格刑(如剥夺政治权利)的刑罚措施惩治腐败犯罪。在国际上,轻刑化作为国际刑事立法和司法的趋势,正日益引起各国的重视。从表面上看,犯罪化和轻刑化是两种的对立的刑事政策,但实际上,这两者是可以兼容并蓄的。因此,对腐败犯罪行为的犯罪化与对该行为在处罚上的轻刑化并不矛盾,两者在理论与实践上都可以达到高度的统一。  相似文献

刑事司法协助是国家关系的重要内容,是一国司法权的有效域外延伸,具有重要的外交价值和司法价值。开展刑事司法协助问题的研究,特别是建立我国现代引渡制度,对于打击跨国犯罪、引渡跨国犯罪、追究逃窜到国外罪犯的刑事责任、监控追缴赃款赃物等方面具有重要意义。目前,在我国现存的各种法律规范以及与外国签订的司法协助协定之中,缺乏切实可行的措施。为此,制定切实可行的引渡制度仍是任重而道远的法制任务。  相似文献

A substantial minority (35%) of the Dutch population is in favor of capital punishment. In this paper, it is argued that in a staunchly abolitionist country such as The Netherlands, the existence and perseverance of such support can be better understood and explained by conceiving of capital punishment support in attitudinal terms as part of a law and order syndrome. Death penalty attitudes are analyzed by means of hierarchic logistic regression analysis. It is shown that support can be modeled quite well, partly in terms of general attitudes to criminal justice, partly in terms of political and sociodemographic parameters. Within the criminal justice attitudes complex, more support is found among those endorsing harsh treatment of offenders, those willing to grant far-reaching powers to justice authorities, those believing that the government is not delivering on the topic of crime fighting, and those who are concerned about the level of crime. Within the political context, more support is enlisted among people who abstain from voting and those who vote at either extreme of the political spectrum as opposed to central parties' supporters. In sociodemographic segments it is the younger and poorly educated who are the strongest supporters of capital punishment. It is suggested that endorsing capital punishment can be better understood as an expressive act, displaying dissatisfaction with judicial and political elites in the country.  相似文献

The environmental challenges of the 21st century require co-operation between criminal justice experts and economists. Three different economics perspectives are relevant for the discipline of criminal justice in general and for adressing environmental problems in particular: neo-classical econoics, political economics and the economics of sustainable development. Criminal justice pays a role in the effort to attain sustainable development because the limitations of market based decision making necessitate a role for law and regulation in addressing environmental degradation. Sustainable development itself is relevant to the general discussion of crime. Issues of sustainable development are already discussed in criminal justice literature. While criminal law has limitations as a tool against environmental crime, it will necessarily suplement the tools of the market and civil regulation in coping with environmental problems. The inherently multidisciplinary undertaking of sustainable development will be most effectively met if experts in both economics and criminal justice understand more of one another's fields. Suggestions for including the three perspectives of economics in the criminal justice curriculum are provided.  相似文献

This paper presents a logical approach to the problem of devising socially acceptable policy for the operation of a corrections system. As an alternative to considering separately the frequently mentioned, but conflicting goals of providing rehabilitation, retribution, detention of dangerous criminals, and general and specific deterrence of criminal behavior, the authors suggest that the goal be couched in terms of minimizing the social cost of crime. By developing a model which illustrates how the corrections process relates to the various facets of the criminal justice system, and by isolating the functional relationships which must be taken into account, the authors are able to show there is an optimal level of rehabilitation, detention, and deterrence associated with a socially optimal level of criminal activity and criminal justice control activity. Although much remains to be learned before such a model can be effectively implemented, considerable research has already pointed the way for learning how to more effectively balance the alternatives for policy. An enumeration of the policy implications of the model identifies targets for further research.  相似文献

Although academicians in criminology and criminal justice have come to appreciate the importance of the media in constructing ideological images of crime and punishment, apparently they have not considered how to use mass communications for the purposes of informing, interpreting, and altering those images to reflect more realistically the social, political, and economic conditions of crime and social control. Beginning with an analysis of the relationships among the developing political economy of the mass media, intellectuals, and conceptions of crime and justice, this essay introduces a criminological practice that can take advantage of the available opportunities in the production of crime news. I call this practice “newsmaking criminology.” It refers to the conscious efforts of criminologists and others to participate in the presentation of “newsworthy” items about crime and justice.  相似文献

作案手段、犯罪模式与“签名”特征都表征犯罪进行过程中某种形式样态,其内涵与外延均有差异:作案手段是指特定人或特定犯罪团伙所选择的犯罪的途径或方法;犯罪模式是以两个以上不特定的犯罪人或犯罪团伙的作案手段为基础而整理出的一套具有共通性的作案手段;“签名”特征是犯罪者因个人人格上的特质而强迫自己实施的一种“签名”式行为。明确区分三个概念的异同,有利于解决目前侦查实践中三者使用混淆的状态,准确把握三者各自的侦查价值,为侦查破案和犯罪预防工作服务。  相似文献

对本可以判处死刑立即执行的贪污受贿犯罪分子实际判处死刑缓期两年执行的,同时决定死缓期满减为无期徒刑后的终身监禁,既不是执行"死刑"之"重",又不是减为可进一步通过减刑、假释使实际服刑期变得相对比较短的一般"无期徒刑"之"轻",既实现了罪责刑均衡,又实现了震慑其他潜在的贪污受贿犯罪分子的一般预防目的,还能够遏制司法腐败实现司法公正,对贪污受贿犯罪行为进行精准的打击。终身监禁单独设在贪污受贿罪里,正是考虑到贪污受贿罪的特点和国家的刑事政策而作出的,不仅具有很强的针对性,而且在刑罚轻重的"度"上把握到位,体现出刑罚制定和适用的精准性。从刑罚精准性的视角分析,终身监禁不违背罪刑法定原则、罪责刑相适应原则和刑罚效益原则,具备刑罚正当化根据。  相似文献

刑法法典化和刑法法典成熟化是刑事立法现代化的一种趋势;对犯罪概念应坚持形式定义与实质定义的结合与统一;刑法上主要有两种犯罪分类方法,一是根据犯罪的性质,一是根据犯罪的严重程度;犯罪构成可以分为法定的犯罪构成与现实的犯罪构成;事业单位、机关、团体、民办非企业单位作为法人犯罪主体时,应当对其内涵予以正确界定;犯罪客体是犯罪主体的犯罪行为所侵害的、为我国刑法所保护的社会利益,它既是犯罪的组成部分,又是犯罪构成的组成部分;应在刑法上规定罪过的概念并坚持“无罪过不为罪,也不受刑罚”的罪过原则,罪过不仅指故意与过失,而且还包括其他因素,罪过不仅有存在与否的区别,还有程度的差别;“持有”作为犯罪行为的形式,通常表现为作为,但有时也表现为不作为,甚至表现为两者的交叉,因此把它视为犯罪行为的第三种形式亦未尝不可;国家对犯罪人及其犯罪行为的评价和判断,属于刑事责任的内容;犯罪和犯罪构成的质变,由组成要素的性质、数量、结合方式三个因素决定,研究犯罪和犯罪构成的质变与部分质变,可以以此来构建刑法分则理论新体系。  相似文献

The estimation of total population size for various phenomena of crime is an important factor critical for criminal justice policy formulation and criminological theory development. In this paper, methods are discussed for estimating the size of a criminal population from police records. Capture-recapture analysis techniques, borrowed from the biological sciences, are used to predict the size of population for migrating (or fleeing) fugitives and for street prostitutes. Heterogeneity and behavioral responses to previous police encounters are identified as major complicating factors. The basic problem is that the police records are virtually unaffected by a potentially large pool of cryptic criminals. It is shown how independently collected auxiliary data can address this problem.  相似文献

恢复性司法是一种通过恢复性程序实现恢复性后果的非正式犯罪处理方法。为考察司法人员与公众对待确定未成年人恢复性司法制度态度,对法官、公众等不同群体作问卷调查,结果表明,法官和公众对未成年人司法制度的诸项改革基本认可。该制度的合理性表现在可减少刑事污点对未成年人的消极影响,有利于恢复受损的社会关系,对违法犯罪的未成年人有积极的矫正作用;其局限性体现在难以满足同罪同罚的刑法原则,难以避免替代性的承担责任的现象等。避免局限性的关键在于要解决恢复性司法与正式司法程序的关系问题。  相似文献

This paper offers an exploration of criminals’ and non-criminals’ perceptions of crime in an urban milieu. Specifically. we examine perceptions of the incidence of crime within the city, of variations in police pratection. and of variations in the likely difficulty of committing crimes in different parts of the city. The analysis examines the distinctiveness of; and interrelationships among, these variables controlling for the racial status and criminal-non-criminal status of the respandents. Additionally. perceptions of the difficulty of committing crimes m different parts of the city are related to generalized perceptions of the city for our racial subgroups of criminals. The results provide evidence on the distinctiveness of criminals in such terms, on some factors influencing strategic criminal decision-making, and on ways m which criminal behavior shares common elements with other social behavior.  相似文献

The traffic in garbage and hazardous wastes is a huge illicit transnational business that involves a wide array of criminals, including private entities, corrupt public officials, and organized crime groups. The traffic in CFCs and radioactive materials and the chemical by-products of illicit crop cultivation and production are related problems with significant negative environmental and social consequences. Inelastic demand, price differentials among industrialized and developing nations, corruption, incongruent international regulations, a lack of political will, and the emergence of waste brokers are all factors that drive the illegal trade and inhibit law enforcement. While regulatory and criminal justice efforts have been mostly ineffective, technological innovations that reduce waste and the costs of safe disposal may limit opportunities for waste traffickers. The right mix of subsidies and taxation as well as monitoring and compliance at the local level could make legal disposal more attractive, and thus further inhibit criminal opportunities.  相似文献

This article attempts to illustrate the utility of isoquant map analysis from the field of production theory in microeconomics for the analysis of criminal justice data. Cross-national comparisons of aggregate crime and justice data are used to demonstrate the ability of this technique to reveal important patterns that are often obscured by simple rate comparisons and multivariate treatments such as pooled time-series analysis. For each jurisdiction, aggregate trends in criminal justice processing rates are systematically analyzed as a sequence of two-input production processes: gross imprisonment rates (prison population divided by resident population) can be partitioned in terms of the crime rate and punitiveness (prison population divided by the number of offenses); punitiveness can, in turn, be partitioned in terms of severity and certainty of punishment; certainty of punishment can then be partitioned, seriatim, in terms of the incarceration rate, the conviction rate, and the arrest or clearance rate and the rate at which citizens report crimes. Cross-national data collected by Farrington, Langan, and Wikström are used to illustrate the utility of the method for displaying comparisons of the decomposition of aggregate criminal justice data for the United States, England, and Sweden.  相似文献

与重惩罚的传统刑事司法模式不同,修复性司法模式,强调的是如何对犯罪造成的损害进行修复,而非单纯惩罚犯罪人。修复性司法作为一种刑事司法改革运动与一种刑事司法理念,还不是一个完全成熟的理论。因此,其内涵关系真实性是否存在还需要进一步检验,同样,修复性司法在我国能否进入实务过程似乎还有一段困难的路要走,仍有待加强实证研究。  相似文献

This paper will interpret and critically analyse the new offence for organised crime in England and Wales (Section 45 of the Serious Crime Act 2015) from a criminological perspective in light of evidence found in research in the country. It will argue that changes in the law relate to changes in political narratives rather than to variations in the criminal panorama of organised crime. It will discuss these changes within three perspectives, which address various levels of concern: a narrative perspective, which reflects on the overlapping of meanings in the use of the words ‘organised crime’; an evolution perspective, which reflects on the origins of the new participation offences with reference to both national and international pressures; a management perspective, which reflects on some of the immediate effects of the new offences of organised crime on the criminal justice system. This paper will conclude that political narratives have indeed influenced criminal policy, while there is no significant change in the phenomenon of organised crime to justify such narratives.  相似文献
