ABSTRACT

Anna Stilz’s Territorial Sovereignty (2019) aims to be a revisionist account of territorial rights that puts the value of individual autonomy first, without giving up the value of collective self-determination. In what follows I examine Stilz’s definition of occupancy rights and her emphasis on the moral relevance of what she calls ‘located’ life plans. I suggest that, if it aims at being truly revisionist, her theory should work with a broader definition of occupancy. So long as it doesn’t, these rights will be mainly the preserve of groups of settlers and peoples with predictable patterns of movement. Moreover, insofar as occupancy rights ground collective rights to self-determination, they actually have the potential to trump individual rights to what I call ‘dynamic’ or non-located occupancy. This is worrying, I claim, for at least two reasons. First, rights to dynamic occupancy are arguably as central for respecting individual autonomy as rights to located occupancy. And second, rights to dynamic ocupancy should be seen as key in helping to form the kind of political allegiances required to overcome the most pressing collective action problems that humanity faces.  相似文献

ABSTRACT

Beginning with Karl Marx, theorists have seen individual autonomy and ideology as opposing elements. Ideology was considered the product of mental, cultural or social constraints. People did not choose their world view – they fell victim to it. With the increase of individual autonomy, however, ideology would wither away. In the late 20th century, the advocates of individualization theory have similarly predicted the vanishing of clear-cut ideological divisions in a world in which any form of collective identity was difficult to sustain. Political eclecticism and the mixing of different political world views would become the new norm. Politics was now ‘beyond left and right’, as Anthony Giddens once famously argued. In my article, I show that this understanding of the relationship between individualization and ideological polarization is flawed. By discussing the extreme ideological polarization in the U.S., I disprove the notion that our need for ideology vanishes the more our freedoms expand. On the contrary, precisely the increase in individual autonomy – in terms of mobility patterns, media use and lifestyle differentiation – has helped to turn the country into a series of closed echo chambers and to deepen the ideological fault lines of American society.  相似文献

ABSTRACT

Cento Bull addresses the question of whether the Italian Lega Nord, when in government, pursues policies that contradict its rhetoric (politics of simulation or symbolic politics) or policies that are in line with its dominant discourse (politics of identity). Her analysis focuses on immigration policy because this is an area that links together economic issues (immigration is highly functional to the economy of those regions of Italy that form the Lega's strongholds) and identity issues (immigration is seen as visibly threatening cultural values and disrupting community cohesion). She argues that recent legislation in this area, approved in July 2009, is formally in line with Lega rhetoric but also that actual policy outcomes contradict both the party's rhetoric and the legislation itself. This confirms the validity of the concept of ‘simulative politics’ in so far as it refers to a societal practice of self-deception, rather than simply to practices of deception on the part of political actors.  相似文献

Abstract

This paper explores the aporetic nature of social and historical being as it emerges from a juxtaposition of the philosophies of Castoriadis and Heidegger with specific emphasis on their meditations on history, individuality and collective being. It is argued that any current attempts to grasp the problems posed by historical time should not overlook the conceptual space opened up by contrasting Castoriadis' theorisation of social-historical praxis as the enactment of autonomy expressed through the emergence of the ‘radically new’ with Heidegger's treatment of authentic historicity as fate and repetition. The attempt of both thinkers to break with the philosophical tradition of the West is examined from the perspective of their conceptions on time and history, while their opposing accounts serve to revaluate the traditional dichotomy between allegedly linear' and ‘cyclical’ conceptions of time. Additionally, it is argued that instead of treating Phenomenological-Hermeneutic and Marxist accounts as adverse and incompatible, our reflections on history and society are enriched by their juxtaposition. Castoriadis and Heidegger present us with the most promising individual cases of thinkers representing these philosophical schools mainly due to their emphasis on the historical dimension of human life and to their overall groundbreaking philosophical elaborations that resist labelling and defy confinement to specific philosophical or epistemic traditions.  相似文献

Abstract

Margaret Kohn argues for a reappraisal of early twentieth-century left-republican French political theory, known as ‘solidarism’. Solidarism recognises private property as legitimate, but at the same time argues that the collective nature of economic production gives rise to a claim to social property. It is social property that should underlie the case for social justice and social rights, not the standard liberal claims to individual autonomy. This paper provides an appraisal of Kohn’s recovery of solidarism, taking as its main theme the relation between property and social justice. The paper first offers a typology of four theories of justice (right- and left-libertarianism, luck and relational egalitarianism) and discusses the relation of each of these to the concept of property. Then it argues that solidarism is akin to left-libertarianism in the way it formulates justice as a claim to social property. Finally, it argues that solidarists cannot escape grounding their theory in a non-property based fundamental principle, which makes the theory much less distinctive from egalitarian theories of justice than may appear at first sight.  相似文献

Neither the major assumptions of developmental statist theories nor their revised arguments (e.g. network and internal organization theories) can persuasively elucidate the South Korean state's strong autonomy vis‐à‐vis the capitalist group in establishing and implementing economic/ industrial policies. A more relevant elucidation can be made by attending to the following three points: 1) one can more clearly show the former's autonomy in relation to the latter by examining discordant rather than amicable aspects of the relationship between them; 2) the strength of the East Asian state's autonomy lies not in its inherent, absolute cohesiveness but in its ‘political integrating power'; 3) in interpreting the state's strong autonomy vis‐à‐vis society, more research on political and administrative factors (rather than economic ones) need to be conducted. Also important are the behaviour of political and administrative agents who operate institutions and various interactions among them. To enforce these points, this article analyzes the political aspects of the state‐capital relationship while the South Korean government established anti‐chaebôl policies to restrict economic concentration via big businesses.  相似文献

This review of Patten’s Equal Recognition suggests that minority rights can be grounded either in cultural accommodation rights or collective self-government rights. I defend four propositions: (1) individuals’ interests in membership in political communities cannot be reduced to their interests in being able to pursue their own conceptions of the good; (2) liberal states do not have to extend neutrality as equal treatment to self-government claims that intersect with their own jurisdiction; (3) claims for the establishment of public languages and territorial autonomy need to be justified on the basis of self-government rights rather than on grounds of equal treatment of cultural identities; (4) as a condition for their admission, immigrants can be expected to waive collective self-government rights rather than cultural protection rights.  相似文献

Abstract

The Vietnamese term for socialization, xã h?i hóa, is grounded in its history of socialist construction, originally referring to the collectivization of property and resources. Since the country shifted to a market economy, yet remaining under the leadership of the Communist Party, the term has come to imply the individualization of responsibilities and the privatization of public goods. As a policy, however, it continues to evoke the idioms of ‘the whole society’ or ‘all the people’ as the basis of wellbeing and development. This paper examines the practices of socialization as part of broader shifts in welfare provision and local dynamics of exemplarity. I show that socialization concerns not only the mobilization of resources, but also the production of a moral subject that is self-optimized and yet sensitized to helping others, self-governed and yet governable by the party state. In a socialist country that is rapidly marketising, this moral subject plays into governing rationalities that blends new-prudentialist logics with socialist genealogies, privatization with a notion of society within which individual actions can be made morally meaningful. While the tension and contestation induced by people’s greater burdens are immanent, the continued reference to collective idioms appeals to people’s moral sensibilities, and thus makes socialization meaningful to some extent, even as they resent the turn away from broad-based structures of wellbeing.  相似文献

This essay aims to re-evaluate the quality of democratic consolidation in South Korea from a participatory democracy perspective. In order to do so, I, drawing on Barber's theory of strong democracy, redefine democratic consolidation in terms of the active citizenship and political dynamism that it breeds rather than in terms of stability, which overly prefers a liberal-pluralist, yet inherently conservative, civil society to a more vibrant and sometimes intractable form of civil society. Understanding democratic consolidation as an open-ended, non-teleological, and perennial struggle for citizenship, I then focus on the Koreans' collective response to the deaths of two teenage girls struck by a US military vehicle in 2002 to explore how Koreans critically re-evaluate their collective identity and actively repossess citizenship in civil society through the inculcation and practice of ch?ng, the Koreans' familial affectionate sentiment. I conclude by presenting “affectionate citizenship” as the most practicable model for Korean democracy.  相似文献

Abstract

There is a kind of guilt that looks archaic, but which arises at the moment of Romanticism. One way of understanding it is as a response to a plight bequeathed by Kant. Kant's account of the subject secures the subject as such, but not the particular individual. The particular individual for Kant presents a risk, the risk of turning away from the good will defined by the categorical imperative to embrace one's own, particular good. Ultimately for Kant this entails the risk of radical evil. The peculiarity of Romantic guilt is that it seems to grant one ontological assurance for one's particular individuality. This paper explores and seeks to define the phenomenon of Romantic guilt as a possible aspect of tensions in lived experience, in particular between the universalism and moral autonomy associated with the rationalist, Enlightenment strain in liberalism, and the particularism and rootedness of cultural belonging associated with Romanticism. Romantic guilt emerges as having a constitutive function in relation to the self. The paper concludes with suggestions about ways in which further research might trace Romantic guilt in a collective form in nationalism and modernity.  相似文献

In the intellectual confusion prevailing since the demise of Marxism and "marxism", the attempt is made to define democracy as a matter of pure procedure, explicitly avoiding and condemning any reference to substantive objectives. It can easily be shown, however, that the idea of a purely procedural "democracy" is incoherent and self-contradictory. No legal system whatsoever and no government can exist in the absence of substantive conditions which cannot be left to chance or to the workings of the "market" but must be posited as objectives of political activity. The confusion results from a deficient understanding of what makes a society and an empty idea of "freedom". The objective of politics is not happiness, an affair to be left to the individuals, but it certainly is liberty understood as participation in the governance of the polity; it is also the pursuit of the common good, defined as the sum of the prerequisites and facilitations of individual autonomy depending on collective action, and as the realization of commonly agreed collective goals.  相似文献

This article is concerned with governance of long term socio-technical transitions required to orient development trajectories of advanced industrial counties along more sustainable lines. It discusses the contribution that ‘transition management’ can make to such processes, emphasizes the irreducibly political character of governance for sustainable development, and suggests that the long-term transformation of energy systems will prove to be a messy, conflictual, and highly disjointed process.  相似文献

At first glance, one might view the political differentiation in the European Union as a reflection of the autonomy of its member states, signifying flexibility and the dispersion of democratic control. However, under conditions of complex interdependence and economic integration, political differentiation can undermine the fundamental conditions for democratic self‐rule. Political differentiation may cause dominance. It is argued in this article that we must move beyond Philip Pettit's conception of dominance as the capacity to interfere with others on an arbitrary basis, in order to properly identify the undemocratic consequences of differentiation. Political freedom is also a question of institutional provisions to co‐determine laws. From this vantage point, differentiation raises the spectre of dominance in the form of decisional exclusion and the pre‐emption of political autonomy. Drawing on a re‐conceptualisation of dominance, the effects of differentiation on the possibility of self‐rule are examined, and two systematic effects of political differentiation are identified. It is argued that segmentation is the systemic effect of differentiation in the vertical dimension of integration. Here, dominance occurs in the form of exclusion from decision‐making bodies and the denial of choice opportunities. In the external horizontal dimension, the systemic effect of differentiation is hegemony. Some states are vulnerable to arbitrary interference and the pre‐emption of public autonomy. The article discusses developments within the Eurozone as a case of segmentation and the statues of associated non‐members as a case of hegemony. With regard to the latter, we are faced with the phenomenon of self‐incurred dominance.  相似文献

ABSTRACT

Toleration is usually regarded as a pivotal democratic virtue that should be cultivated in the educational systems of liberal democracies. The concept of toleration, however, is marked by deep ambivalence. Power-theoretical criticisms of toleration as a political and educational ideal have emphasized that discourses of toleration are entangled with societal power struggles, and tend to naturalize social hierarchies and reify individual and collective identities. Given this criticism, toleration refers not just to justificatory problems concerning the limits of political or pedagogical authority, or to the peaceful negotiation of conflicts that pervade pluralistic societies. On the contrary, toleration itself seems to create and perpetuate precisely those political conflicts that it is meant to contain. This contribution develops a defence of toleration as a coherent and sound aim of public education and as a democratic virtue against the power-theoretical critique.  相似文献

Government policies can activate a political constituency not only by providing material resources to, or altering the interpretive experiences of, individual citizens, but also by directly subsidizing established interest groups. We argue that state laws mandating collective bargaining for public employees provided organizational subsidies to public sector labor unions that lowered the costs of mobilizing their members to political action. Exploiting variation in the timing of laws across the states and using data on the political participation of public school teachers from 1956 to 2004, we find that the enactment of a mandatory bargaining law significantly boosted subsequent political participation among teachers. We also identify increased contact from organized groups seeking to mobilize teachers as a likely mechanism that explains this finding. These results have important implications for the current debate over collective bargaining rights and for our understanding of policy feedback, political parties and interest groups, and the bureaucracy.  相似文献

War heightens public interest in politics, especially when human lives are lost. We examine whether, and how, combat casualties affect the decision to vote in established democracies. Drawing from social psychology research on mortality salience, we expect increasing casualties to increase the salience of death, information that moves people to defend their worldview, especially nationalistic and ideological values. By heightening the importance of values, we propose that combat casualties increase the benefits of voting. In particular, we expect the effect of combat casualties to be pronounced among the least politically engaged. Using both cross‐national data of elections in 23 democracies over a 50‐year period and survey data from the United States and United Kingdom during the Iraq and Afghanistan wars, we found that mounting casualties increase turnout. Furthermore, as expected, we found the effect of casualties to be most pronounced among those least interested in politics.  相似文献

This Viewpoint essay understands China's COVID-19 responses through the lens of six paradoxes, focusing on normal and non-normal governance, competing values, expertise and politics, centralization and decentralization, public and private, and technology and institutions. Preliminary lessons are drawn regarding pandemic governance: embedding resilience into all aspects of governance; developing a public value framework for pandemic governance and improving individuals' ethical capacity; institutionalizing policy capacity on pandemic governance and requiring expertise in relevant positions; balancing centralized coordination and decentralized responses with a stable and ready-to-work commanding center; enabling businesses and nonprofits for pandemic governance but regulating them appropriately; and enacting technologies to revolutionize pandemic governance with proper institutional safeguards.  相似文献

Globalization challenges the ability of contemporary public administration to encourage citizen participation in collective action through behaviors such as tax compliance and contributions to public goods. The authors introduce a new individual‐level approach to globalization, arguing that people vary in the extent to which they are globalized and that an individual's level of globalism (ILG) reflects attitudes and dispositions that influence the way he or she resolves the social dilemma of participation in collective action (i.e., the decision to contribute versus follow a “free‐ride” strategy). Using a four‐country sample, the article examines the relationship between ILG and collective action participation decisions in three behavioral experiments. Findings support the hypothesis that regardless of country‐level globalization, a more globalized individual complies less willingly with tax codes, donates less to local nongovernmental organizations, and prefers to adopt a free‐ride strategy in a public goods game. The consequences for public administration are discussed.  相似文献

Pharmacogenetic tests provide genetic data to tailor drug treatment and were widely predicted to be one of the first fruits of the Human Genome Project. In the mid-2000s, the US Food and Drugs Administration (FDA) became an advocate for pharmacogenetic testing, but its efforts to build a market for this new technology brought the agency into dispute with other regulatory actors over the type of evidence needed for the adoption of pharmacogenetic testing, in particular the importance of randomized control trials. The warfarin case highlights the tension between a new form of promissory regulation driven by future expectations and FDA's established role as protector of public health; and the controversy can be conceptualized as a struggle over regulatory epistemologies within a complex polycentric regulatory space. Our case study addresses two themes central to the burgeoning scholarship on the governance of emergent science and technologies (EST): the political economy of regulation, in particular the role that regulators play in creating markets for EST; and the epistemological politics of regulatory science, in particular the controversy that arises when regulators modify scientific standards to accommodate EST. Linking these two themes is the concept of promissory regulation: the idea that regulatory policy may be shaped by an institutional commitment to the transformational potential of EST. This concept sheds new light on the neo-mercantilist nature of contemporary regulatory capitalism.  相似文献

Historically, Israel's ability to sustain a situation of armed conflict for a long time was predicated on the republican equation in which the dominant group – the secular Ashkenazim – exchanged military sacrifice for social dominance. Nonetheless, an imbalance between military burden and social rewards, which emerged during the 1970s and1980s, led the middle-class Ashkenazim to undertake collective action aimed at reducing the burden of military service through protest and peace movements, along with more individual tactics. These modes of action, together with the attenuated status of the military, spurred on national-religious and Mizrachi groups to integrate themselves into the traditional equation, or to formulate an alternative one (the Gush Emunim and the Orthodox route). Arguably, the status of each group in the military, which itself saw an erosion in its social status, played a major part in shaping the nature, scope and strategy of each group's collective actions. The groups capitalized on the opportunities that the military offered them in accordance with their capacity to utilize the resources they had at their disposal.  相似文献
