生态保护补偿机制建设的法律保障——以地方政府生态补偿对赌协议为例北大核心CSSCI

生态保护是绿色低碳发展的应有之义。省级地方政府之间的流域生态补偿对赌协议是我国生态保护补偿机制建设的重要创新,具有特殊合同的法律属性,对于生态保护和政府治理均具有重要意义。生态补偿对赌协议在实践中成效显著,但也存在着法律依据不明确,在行政决策程序、预算法和合同法等层面的规则适用不完善等问题,亟须优化相应的制度设计为其扩大和推广提供法律保障。加快《生态保护补偿条例》的立法进程,为生态补偿对赌协议提供明确的法律依据,成立“国务院生态环境保护委员会”,统筹协调全国生态保护补偿工作;强化政府生态补偿对赌协议的重大行政决策程序,严格适用公众参与、专家论证、风险评估和效果后评估等核心制度;推进补偿金的全范围、全流程预算监管和人大预算监督;针对生态补偿对赌协议的特殊性,完善相关的合同订立、履行、违约责任及纠纷解决制度。
