In the last two decades we have witnessed a growing global acknowledgement of indigenous rights – manifested in the 2007 UN Declaration on the Rights of Indigenous Peoples – challenging the traditional nation-state-centred understanding of political rights and democracy. In this paper, the author argues that indigenous self-determination is to be understood as a way to level the balance of power between indigenous peoples and the nation-states in which they live. Without a solid legal foundation for indigenous peoples to define self-determination in their own languages and to negotiate the conditions of their relation with the nation-states on their own terms, the colonial past (and present) of violent conquest and domination might continue. Indigenous peoples' right to self-determination ought in this perspective to imply recognition of indigenous peoples as having a standing equal to nation-states, i.e. as if they were sovereigns. What self-determination means in political practice would thus be the outcome of negotiations between two (or more) equal political entities. In this way, the right to self-determination has to be interpreted procedurally rather than substantially.  相似文献

Noel Pearson has recently argued that inclusion, over the last 30 years, in a 'passive' welfare system has been to the detriment of Aboriginal society. This article approaches the inclusion of Aboriginal people in the social security system from a slightly different perspective, while taking seriously Pearson's concerns. It argues that, despite norms and aspirations of universalism, rules within the social security system are social constructs derived from and intended for the particular social and economic circumstances of the dominant society. When those rules are applied to the very different social and economic circumstances of minority groups, such as Indigenous Australians, major issues of adaptation and interpretation arise. This article draws on research experience spanning 20 years on relations between Indigenous Australians and the social security system to illustrate the degree to which adaptation has occurred, in the pursuit of realism. However, it also argues that current relations between the social security system and Indigenous Australians are not just and fair because the rules of the system do not equally reflect Indigenous and non-Indigenous peoples' social and economic circumstances.  相似文献

The relationships between local governments and Indigenous institutions in Australia are unstudied, despite both being oriented to the local level. Related research focuses on the performance of Indigenous local governments, Indigenous forms of governance and its relation to local government, relations between local governments and Indigenous communities, and the intercultural dynamics of Indigenous and Western governance frameworks in local governments. This article presents the findings of a study that examines relations between local governments and Indigenous institutions in the Torres Strait, a relationship that is framed by s. 9(3) of the Local Government Act 2009 (Qld) (LGA) that allows local governments to ‘take account of Aboriginal tradition and Island custom’. A framework adapted from health-related studies, consisting of three alternative policy approaches—mainstreaming, indigenisation, and hybridisation—is used in this study to characterise relationships between local governments and Indigenous institutions. Kinship and country, two important Indigenous institutions, are marginalised in Queensland's mainstream system of local government, which in turn creates obstacles for Aboriginal and Torres Strait Islander people from participating and engaging in local government processes.

Although there has been considerable commentary and debate relating to Indigenous political leadership, less attention has been given to the emergence of Indigenous leaders working to improve Indigenous prospects from within the worlds of community development, management, and administration. Based on in‐depth interviews with a cohort of emerging Indigenous leaders in these situations, we found that these leaders are producing their own style of leadership, drawing on their Indigenous identity as a resource, while negotiating the policy and other demands of white Australia. The style of leadership that is emerging has its own distinctive attributes, being more relationally based than is the norm. We suggest that these differences have an important cultural dimension, but also relate to the strategic and tactical challenges of managing ‘two‐ways’. We conclude that these characteristics may be difficult to recognise and reward in organisations where leadership is conceptualised in more instrumental terms.  相似文献

This paper identifies two periods of punctuated change in the content and style of Australian Indigenous policy in the last fifty years. It also identifies a third period in which attention to Indigenous policy was heightened through the nationalisation of land issues already well‐established on the agendas of sub‐national jurisdictions. The paper relates all three periods to the changing federal institutions of Australian Indigenous policy, with the Commonwealth slowly exploring its post‐1967 role as a national government in Indigenous affairs. In later sections, the paper identifies some more conceptual bases of changing policy agendas, through ideas of the competing principles of equality, choice and guardianship and the generational moral dynamics of Indigenous affairs.  相似文献

This paper compares key aspects of governance structures for Indigenous populations in the United States and Australia. The paper focuses on policy coordination and administration, in particular the nodes of decision-making in the two countries in relation to government contracting and accountability. The U.S. approach to funding Indigenous organizations stems from the 1975 Indian Self-Determination and Education Act and its subsequent expansions. Through the development of contracting into permanent compacting via block grants, this approach builds established nodes of Indigenous government and facilitates whole-of-government coherence at the level of the American Indian tribe. The U.S. approach seems correlated with better performance and may lighten bureaucratic loads over the long term. The Australian model, on the other hand, seeks to create whole-of-government coherence through top-down financial accountability in a way that hampers the development of Indigenous political capacity. The paper traces the development of these practices through time and illustrates how they contribute to the fragmentation rather than growth of Indigenous political capacities. It suggests ways the Australian model could be improved even in the absence of fundamental reform by drawing on the contracting-to-compacting framework of longstanding U.S. practices.  相似文献

Investment in programs that help Indigenous people undertake work maintaining the environmental health of their country has benefits for the environment as well as the physical, mental and cultural health of the Indigenous people involved. For health these findings have direct implications for some national health policies, service provision to homelands, health promotion and Indigenous health research. There are also direct implications for environmental investment in northern Australia and the design and regulation of markets in resource entitlements. Indirectly the findings should be important for economic, employment and education policies as well as those promoting social harmony. Given the range of benefits there is a strong argument for cross-agency investment in working on country by Indigenous people.  相似文献

Debates over evidence-informed policymaking are predominantly structured from a western paradigm of ontology and epistemology. Other ways of being and knowing are neither privileged by the policy space nor the discipline, certainly not in the same way or to the same degree. This is changing, however, in the face of cultural recognition and with diversity and inclusion agendas and within the contexts of post-truth politics and the questioning of expertise. This article explores the contribution of Indigenous ways of knowing and being as providing valid, alternative forms of evidence that ought to inform the policymaking process. Australian experience suggests that Indigenous evidence and knowledge offers unique, substantive insights that are offered as ‘gifts’ to inform policy and public administration communities. This contribution is unrecognised and unincorporated into public administration at Australia and the world's peril given that Indigenous approaches offer new exciting ways forward for engagement, sustainability, and policy innovation. It should not be co-opted or presumed. Indigenous peoples need to be given self-determination avenues to decide what they wish to share or not, why, and how.  相似文献

This article seeks to understand the role of being a senior manager in Indigenous community governance, particularly though not exclusively in remote Aboriginal communities. It argues against the tendency of would‐be reformers of Indigenous community governance to focus on the competence and ethical qualities of those who occupy these roles and asks instead how can isolated managerialism in Indigenous community governance be overcome? The article begins with an overview of Ralph Folds' analysis of relations between Pintupi settlements and the larger Australian polity. While taking much from Folds' analysis, the article argues that ultimately he relies too heavily on the idea of antithetical worldviews across the settlement interface, on a problematic distinction between the official and private uses of publicly allocated resources and on too idealist a view of the Australian state. The article argues that the state's allocation of public resources inevitably involves a flow of private benefits and that public purposes and private benefits are not different phenomena, but rather different perspectives on state action. In contrast to Folds' idealism about the state, the article outlines a more thoroughly realist or materialist analysis of being a good senior manager in Indigenous community governance. In its concluding section, the article makes some suggestions for overcoming isolated managerialism in Indigenous community governance oganisations.  相似文献

The Indigenous Land Corporation (ILC) is a relatively new Commonwealth statutory authority which commenced its operations on 5 June 1995. It is new not only in the sense of its short existence, but also in the unique framework enshrined in its enabling legislation that aims to provide improved outcomes in Indigenous land acquisition and land management. This article explores this unique policy and operational framework, contrasts it with past Commonwealth policies and practices for Indigenous land acquisition and management, and assesses the ILC's performance in its initial five years. The article argues that notwithstanding this new framework, the potential for future success will lie in the ability of the ILC to substantially address long-standing issues in the management of the Indigenous estate which now comprises in excess of 15 percent of Australia.  相似文献

This article examines the dearth of any representative Indigenous role in national Indigenous affairs policy‐making and suggests a remedy. After making the case for a specific Indigenous place in national policy‐making, the article considers the reasons for the failure of the Aboriginal and Torres Strait Islander Commission (ATSIC), the body that filled this brief for a decade and a half. The article then considers three possible ways of ensuring an Indigenous role in the policy‐making process: a replacement for ATSIC with specific policy powers; set seats for Indigenous representatives in federal parliament; and the creation of a new elected body whose role would be to review Indigenous affairs legislation. The article concludes that the latter proposal in particular is worth trialling as it would ensure a significant Indigenous voice in national policy‐making while learning from the mistakes that led to ATSIC's demise.  相似文献

Indigenous community governments are at the frontline of current efforts to ‘close the gap’ between Indigenous and non‐Indigenous living standards. Yet there is little empirical evidence about successful performance by these organisations and considerable scepticism about whether introduced Western governance models can ever be viable in Indigenous communities. To identify the governance attributes that contribute to successful performance, case studies were conducted at three Aboriginal councils in far north Queensland. The untested assumptions in current notions of ‘good governance’ were examined. Currently accepted good governance principles and practices were investigated to ascertain their actual causal relationship with council performance. The research further identified key contextual, historical and cultural factors that are important in shaping successful or unsuccessful governance. Practical strategies are suggested for policy‐makers and Indigenous leaders to build the performance of Indigenous community governments.  相似文献

Indigenous Australians have a growing capacity to extract monetary payments from mineral development on their traditional lands. Considerable controversy surrounds the possible use of these payments to fund services such as health, housing and education for the Indigenous groups concerned. Critics of such an approach argue that government should provide basic public services to all citizens, and that use of 'mining payments' for service provision denies Indigenous people specific compensation for the negative impacts of mining and an important opportunity to enhance their economic status. There is also a danger that government may reduce its existing spending on services, leaving Indigenous people no better off as a result of allowing mining to occur. This article argues that while there are certainly risks involved in using mining payments to fund services, Indigenous groups can generate substantial net benefits by doing so. Mining payments can leverage additional government spending; fund services at a level or of a sort that government will not provide; give Indigenous people greater control over service provision; and help develop Indigenous organisational skills and governance capacity. A strategic approach is required to minimise risk and maximise the available benefits, and the article identifies policy principles that can be applied to secure such an outcome.  相似文献

The former Coalition Commonwealth Government consistently asserted that representative Aboriginal and Torres Strait Islander (hereafter Indigenous) organisations supported the introduction of the Cashless Debit Card (CDC) in multiple trial sites. Consequently, they depicted the CDC policy as an alleged exemplar of a co-designed policy model based on partnership with Indigenous community groups. This article examines the validity of this argument by analysing the views expressed by Indigenous organisations via written and oral submissions to the six parliamentary inquiries into the CDC from 2015 to 2020. Our findings suggest that with the exception of the first inquiry, most Indigenous submissions opposed the introduction or the expansion of the CDC. Yet, these critical views received only limited acknowledgement in the inquiry reports, and seem to have little or no impact on government policy concerning the CDC. It appears that the CDC policy is more accurately identified as a top-down policy imposed by government on local Aboriginal communities which, with some exceptions, neither requested nor consented to the policy.  相似文献

The economies of remote Indigenous settlements are dominated by public finances. The current system of governing public finance is highly saturated, fragmented and centralised, and this has a corrosive effect on local governance capability. The political accountability of leaders to their constituents is weakened in favour of an administrative accountability ‘upwards’ to higher authorities. New Public Management reforms have promoted administrative deconcentration, over political devolution, and this has been accompanied by an influx of public servants, Non‐Government Organisations (NGOs) and private contractors, and a decline in Indigenous organisations and local government. The end result in many settlements is a marked disengagement of Indigenous people in their own governance. There is evidence of considerable political capabilities existing within local government electorates. Decentralised financing arrangements can be used to catalyse these capabilities and then address deficits in administrative and technical performance.  相似文献

Abstract

Comparative political economy (CPE) has robustly examined the political and institutional determinants of income inequality. However, the study of wealth, which is more unequally distributed than income, has been largely understudied within CPE. Using new data from the World Income Database (WID), this article examines how economic, political and institutional dynamics shape wealth-to-income ratios within Western European and OECD countries. It is found that the political and institutional determinants that affect income inequality have no short- or long-run effects on the wealth-to-income ratio. Rather, the rise in wealth-to-income ratios is driven by rising housing prices, as well as price changes in other financial assets, not home ownership or national saving rates. The article concludes by examining how the changing dynamics of housing prices and wealth inequality will increasingly shape intergenerational – and associated class-based – political conflict in Western Europe.  相似文献

Abstract

Central to the debates on the transition of Hong Kong to Chinese sovereignty is how this process has affected change in the policy process and policy outputs. Many see policy change as a result of the evolving political environment in Hong Kong following the political transition. This article, however, adopts the notion of policy networks and argues that the analysis of policy change cannot be reduced to a simple contextual stimulus – the policy alteration model. A case study – ‘the development of civic education’ – demonstrates the importance of policy networks, as a particular structure of government and group relations in decision making, in explaining the course of policy change. It is apparent that the relationship between regime change and political liberalization, on the one hand, and established networks, on the other, tends to be complex and dialectical in Hong Kong. Despite the importance of sovereignty transition and political restructuring, the effect of contextual factors on public policy greatly depends on the nature of the network involved.  相似文献

This study examines conditions under which states in East Asia engage in the development of regional institutions. It assumes that crucial external events and shocks, which produce specific historical breakpoints – critical junctures – constitute a significant breakpoint at which the regional states willingly elevated a path to develop regional institutions to a new level. The analysis of the development of regional institutions for a free trade area and food stock for emergency revealed that regional states in East Asia changed their views on the evolving reality created by external shocks and such changes led to the creation of new regional institutions.  相似文献

At the time of the election of the European Parliament (EP) in 2014, the European Union (EU) was heavily affected by a multifaceted crisis that had – and still has – far-reaching implications for the political system of its member countries, but also for the European level of governance. Against the background of the strong Eurosceptic vote in the 2014 EP elections, this study aims to investigate in which way Eurosceptic parties of the left and the right respond to the multiple crises of the EU. Using data from the Euromanifesto Project from 2004/2009 and 2014, changes in the party positions towards the EU are analysed in the shadow of the multiple crises and the reasons thereof are explored. The findings show a general anti-European shift among the two types of Eurosceptic parties. Nevertheless, the changes in the EU polity tone are not determined by issue-based repercussions of the multiple crises, but by the EU-related evaluation – the polity mood – of the national citizenry. For far-right Eurosceptic parties, the shift is moderated by the level of public support for EU integration in their national environment. Among far-left Eurosceptic parties, by contrast, it is moderated by the more specific public attitudes about the monetary union policy of the EU. Consequently, political parties when drafting their manifestos for EP elections are not so much guided by the objective severity of political problems or by the evaluations of these problems by the citizenry. What matters in the end is the link that citizens themselves are able to establish between the severity of political problems, on the one hand, and the responsibility of the EU for these problems on the other. This has important consequences for understanding of the nature and substance of political responsiveness within the EU system of multilevel governance.  相似文献

This article focuses on the relationship between the two major ethnoreligious communities – the Jews and the Muslims – and the state in France, as reflected in lobbying, electoral behaviour, and public policies. It shows how the evolution of that relationship, an aspect of the politics of ethnicity, religion and multiculturalism, has been both a cause and a consequence of modifications in approaches to secularism, communitarianism and affirmative action. Finally, it deals with the question to what extent this development corresponds to a pluralist or corporatist model of politics and argues that changes in the relationship between state and society suggest an evolving accommodationist pattern increasingly similar to that of the United States.  相似文献
