In the most range of the East China Sea, the exploiting oil and gas have been blocked for decades by conflicting claims to the boundaries and islets by China and Japan. For the sake of addressing conflicts in a comprehensive cooperation by bilateral and multilateral agreements aiming at reducing rising tensions and harvesting resources in disputed areas, it has become a key issue worthy of research. Zhou Zhonghai is a professor of international law and director of the International Law Center in China University of Political Science and Law. He was a senior visiting scholar of the Law School, University of Virginia (1991). As a legal adviser of the Chinese delegation to the third UN conference on the law of the sea, he once attended the drafting committee conference. His main works include Comments on International Law (2001), International Law of the Sea (1987), Legal Problems on International Economic Relations (1993), Peace, Justice and Law (1996), Technologic Progress and Development of the Law of the sea (1998), Law Dictionary (1998), Business Law in China, Trade, Investment and Finance (1997), On the Case of Agusto Pinochet Ugarte (1999). With the deepening of globalization, many provisions in the Nationality Law of China promulgated in 1980 are already out of time and some provisions are easy to trigger dual nationalities. Consequently, while sticking to the basic principle of the Nationality Law, certain provisions of the Nationality Law of China should be gradually improved according to the present situation of international and domestic development, and the implementing guidelines for the Nationality Law should be introduced to construct a relatively complete legal system to adjust and regulate various relationships of nationality. Song Xixiang, majoring in international law, Hong Kong and Macao law, is a professor of law and the dean of Law School of Shanghai International Studies University. Now, he is also a doctoral candidate of Wuhan University. Meanwhile, Prof. Song is an executive director of the China Society of Private International Law and of the China Society of International Law and of the China Society of International Economical Law, etc. Moreover, he is a vice chairman of Hong Kong and Macao and Taiwan Law Association.  相似文献

The corporate social responsibility “beyond law” is the responsibility of enterprises beyond the mandatory obligations by force of law but in line with social values and expectations. Indeed, the legal norms on such kind of responsibility are “soft law”, which mainly incorporate social values and expectations in corporate business behaviors and governance structure, so as to realize corporate “self-regulation”. By protecting the substantive and procedural rights of stakeholders and improving their negotiation power, the “soft law” aims at realizing the spontaneous confrontation and balance of the market, and the corporate reputation mechanism and the functions of NGOs adds much to the performance of corporate social responsibility. He Zhaodan, Economics Doctor of Sun Yat-Sen University, mostly focuses on Law and Economics. She has published six research articles in the academic journals of China.  相似文献

A peaceful and harmonious world is an important social basis for China’s peaceful development, and international law lays a legal foundation and guarantee for building such a world. In the “village of globe” with co-existence and economic globalization, international law provides China a peaceful development with legal certainty in external environment of peace and security, fair and equal international competitive order, and international cooperation; and on the other hand, it puts on an increasing legal restraint on the internal and external strategies of China’s peaceful development. At the same time, the peaceful development of China deems to make a great contribution to the world, which are the main subject of international law in peace and development, as well as to human rights, rule of law and democracy, which are the universal values pursued by international law. Zeng Lingliang, Ph.D of law, is presently a dean and professor in the Faculty of Law in University of Macau. He is an awardee of the Cheung Kong Scholars Award Program and Jean Monnet Chair of European Union Law in Wuhan University, and one of the first three individuals nominated by the China government on the list of panelists in the WTO. He has published many articles on WTO issues, EU law and international law, and his influenced monographs are European Communities and Modern International Law (1992) and its revised edition—European Union and Modern International Law (1994), Law of World Trade Organization (1996), International Law and China in the Early 21 st Century (2005) and the Essentials of EU Law—in the New Perspective of the Treaty on the Constitution for Europe (2007).  相似文献

Humanization is not only a new concept and value-oriented, but also an ever-increasing positive phenomena in international law. Contemporary international law has been contributing to the establishment and improvement of global peace and development order for the co-existence among States on the one hand, and making endeavors to the formation and maintenance of humanizing order, which is both “individual-oriented” and “humankind-oriented”. Such a humanizing phenomenon undoubtedly represents the advanced trend of international law, enriches its contents, updates some of its classic branches and impacts on the basic principle of reciprocity on which it is created and developed. However, the humanization of international law could not have taken shape without common accords among States by means of either treaties or customary rules; and without cooperation among States, the humanistic value of international law can never become true no matter how sublime it is. Zeng Lingliang, Ph.D, is presently a dean and professor in Faculty of Law of the University of Macau, a Cheung Kong awardee and Jean Monnet Chair of European Union Law in Wuhan University, and one of the first three individuals nominated by the Chinese government on the list of panelists in the WTO. Regional economic cooperation and multilateral cooperation of competition policies are regarded as two of the most important topics in international communities, both of which have a very close relationship, i.e., the former is an important path to the latter, and the latter is usually a critical topic of the former. Among the existing regional cooperation mechanism of competition policies are the three most typical modes, i.e., APEC’s open cooperation, NAFTA’s procedural law cooperation and EU’s substantive law cooperation. While taking initiatives to participate in multilateral cooperation of competition policies, China shall grasp the situation of current multilateral cooperation of competition policies, and follow the orderliness of its development, i.e., a step-by-step process of cooperation from nonbinding to binding, from domestic law to international law, and from fundamental to procedural law and to substantive law. Qi Tong, Ph.D, was once a visiting scholar in the Amsterdam Center of International Law (ACIL) (2006–2007). Now, he is an associate professor at the Department of International Economic Law of Wuhan University. His research interests focus on international trade law, international investment law, international financial law, international competition policy. International documents like the Declaration of the Rights of the Child (1959) and the Convention on the Rights of the Child (1989) propose that in mediating on children issues, the best interests of the child should be the primary consideration. In China, the Constitution and the Law on the Protection of Minors have already set out the terms in principle for the protection of minors, however, it has not been defined in the Marriage Law (2001). In order to enforce the commitment of respecting and safeguarding human rights, the child’s best interest principle should be established in marriage and family law, along with amending related provisions. Chen Wei is a professor of law, and director of the Research Center for Foreign Family Law and Women Theories in the China Southwest University of Political Science and Law. She is in the teachings of civil law, family law, law of succession, the history of civil law and comparative family law for years. During 2003–2004, Prof. Chen, being a visiting scholar, studied foreign family laws in the Faculty of Law, Sydney University. In academic field, she has published over 50 research articles in China and abroad; and her monograph is Research on the Legislations of Marriage and Family Law of China (2000). Further, she has taken charge of editing over 10 books, for instance, A Comparative Study of Family Laws between the Mainland and Hong Kong, Macao and Taiwan of China (2002), A Comparative Study of Foreign Marriage and Family Law (2006) and A Comparative Study of Succession Laws among the Mainland, Hong Kong, Macao and Taiwan of China (2007).  相似文献

As for international direct investment, the transnational corporations are playing a leading role in the fields of international trade, international investment and international intellectual property. In theory and reality, this authors analyze the rationale of the social responsibilities taken by transnational corporations, the main problems in the social responsibilities of transnational corporations and the legislative status, and put forward the functions of the social responsibilities of transnational corporations in promotion of the legal construction of socialist market economy, the reform of the corporate governance and the development of transnational corporations in China. Wang Chuanli, Professor and Doctoral Supervisor of China University of Political Science and Law, Vice-chairman of China Society of International Economic Law, and Vice-chairman of Research Institute of WTO Law (China Law Society), also Arbitrator of China International Economic & Trade Arbitration Commission and Beijing Arbitration Commission. Her main publications are “The Legal Effectiveness of Foreign Economic Contracts”, “International Trade Law of Sales of Goods”, “International Protection of Intellectual Property Rights” and “International Trade Law Government Control on Business”. Moreover, she has published over ten influential discourses on international economic law. In addition, her ongoing research projects include WTO Agriculture Agreement and the Rules of International Agri-products Trade, WTO and International Core labor Standards, and the Role of Judicial Independence of European Court of Justice to Promote the Integration of Europe.  相似文献
