Social-Nationalists in the Ukrainian Parliament

Disillusionment with the leaders of the Orange Revolution and their successors, combined with rhetorical and symbolic adjustments made by the ultraright party Svoboda, led to its electoral success in the 2012 parliamentary elections in Ukraine. As a result, xenophobia and anti-Semitism have become part of the public political discourse.     

Do Ukrainian Firms Benefit from FDI?

All countries are eager to attract as much foreign direct investments (FDI) as possible. At the same time FDI may have not only positive, but also negative economic effects for receiving countries. Positive effects are associated with technology transfer, efficient allocation of resources, and training of domestic workers. However, the entry of foreign firms could, e.g., lead to a decrease of labor productivity at domestic firms, which is a negative effect. The main purpose of this paper is to estimate direct and indirect effects of FDI. First, we test for direct influence of foreign direct investments on firms’ performance, where the latter is estimated alternatively as labor productivity and as exports. FDI notably increases both labor productivity and export volumes. Second, we look for spillover or indirect effects. There is statistical evidence that the levels of FDI in certain regional industries are associated with higher performance indicators of firms’ not receiving FDI in those same regional industries.

A behavioral model for Ukrainian organized crime groups

Ukrainian organized crime operates like any social group existing in relation to other institutions in society. The specifics of criminal group behavior in Ukraine are governed by strict norms and standards which have developed over many decades. The 'thieves idea,' promoting brotherhood and superiority among members of criminal groups, was cultivated by convicts and peasants as far back as pre-Soviet Ukraine. The infrastructure of these groups, their organization and leadership, and methods for criminal activities are all determined by customs and rules unique to Ukraine. Using statistical analysis, a case study of one organized criminal group, and collective interviews with various law enforcement officials, this study attempts to determine the prevalence of traditions and the nature of group dynamics in organized crime.     

Electoral Rules and Legislative Parties in the Ukrainian Rada

Critics of Ukraine's single‐member district majoritarian and mixed‐member majoritarian electoral systems argue that they undermined the efficiency of the Supreme Rada by permitting nonpartisan single‐member district deputies to enter the legislature in large numbers. Such deputies changed parties and ignored party positions. This article argues that the effect of the differences in how legislators are elected is dependent upon whether legislators are partisans. The statistical analysis of party switching and party cohesion in the Rada from 1998 to 2002 shows that nonpartisan single‐member district deputies were the most likely to switch parties and the least cohesive.

Legislative Oversight in the Ukrainian Rada: Assessing the Effectiveness of Parliamentary Committees

This study analyses factors associated with the perceived effectiveness of committee oversight in the Ukrainian Rada. Based on two waves of original survey data, it attempts to discern whether Ukrainian MPs view the committee oversight process primarily as an extension of partisan politics, a forum for constituency representation and resource distribution, or a politically independent process of information acquisition and regulation. The findings of the analysis suggest that partisan political considerations do not play a significant role in shaping MP attitudes towards committee oversight. Rather, deputy evaluations of the oversight process are influenced mainly by distributional and informational factors, suggesting that committee oversight is one area in which legislative institutionalisation appears to be taking root in post-communist Ukraine.     

Assessing Committee Roles in a Developing Legislature: The Case of the Ukrainian Parliament

The Ukrainian parliament consistently attracts scholarly attention as one of the developing parliaments in the Former Soviet Region that is succeeding with institutionalisation. This study assesses committee roles in the legislative process and discusses factors that are associated with strong or weak roles for committees. We bring evidence from the Ukrainian parliament to test traditionally hypothesised institutional factors in committee studies, such as roles of government and parties. To account for the difference between developed and developing legislatures, we add an attitudinal component to the analysis. The results confirm that traditionally hypothesised factors are important in assessing committee roles. However, important intervening factors such as strength and size of factions and the range of ideologies have to be taken into account to explain institutional dynamics in a developing legislature. In addition, an analysis of attitudes provides a valuable insight into the development of committee roles in a developing legislature.     

Household composition and family structures of Ukrainian Cossacks in the second half of the eighteenth century

One of the main problems faced by social historians of the Cossack Hetmanate (Cossacks' autonomous territory situated on the Left Bank of the Dnieper River) is a poor knowledge of population issues. This article therefore focuses on the history of the family and households in eighteenth-century Ukraine. Unlike the historiography of Western Europe, where active research in this field started in the 1960s, contemporary Ukrainian historiography includes only a few studies dedicated to these issues. Recently renewed interest in population issues is due to the widening scope of historical research and to changes in the methodological paradigm that started in the twenty-first century. Historical research of the Ukrainian family and population is thus in its infancy and reconsidering these aspects is crucial for a global scholarship.     

医患法律关系定位的规范性研究

当下理论界对于医患关系的法律定位一直存在争议,主要形成了医患关系是民事法律关系和独立的医事法律关系的两种观点。本文从法学的规范方法的角度,分析了法律关系分析法的方法论意义;提出了一般医患关系属于民事法律关系,特殊医患关系属于行政法律关系的主张。     

劳动法调整对象再认识与劳动法学科重构

随着中国劳动关系集体化转型的发生,劳动法的调整对象也由以往主要局限于个别劳动关系调整,转变为以个别劳动关系调整为基础,以集体劳动关系调整为主线,以社会劳动关系调整为目标。规范的市场经济下劳动法的作用,是从个别劳动关系的从属性出发,通过集体劳动关系的对等性,来实现社会劳动关系的协调性。与中国劳动关系和劳动法治的集体化转型相适应,中国劳动法学科理论基础和结构体系也需重构,构建一个以个别劳动关系调整为基础、以集体劳动关系调整为中心的新的劳动法学科体系,已经成为中国劳动法学科发展的当务之急。     

对民事诉讼法律关系若干问题的再思考

民事诉讼法律关系不仅是指法院与一切诉讼参与人之间,而且也是当 事人彼此之间以及当事人与其他诉讼参与人之间的诉讼权利义务关系;而区分诉讼 法律关系主体和诉讼主体概念的外延和界定其内涵,更易准确把握二者质的规定性、 把握其之于民事诉讼的不同意义。同时,树立法院与当事人在民事诉讼法律关系中 的地位平等的观念,并恰当理解和把握法院在民事诉讼法律关系中的主导地位,将对 更为合理地配置诉讼主体及其彼此之间的诉讼权利义务和更为科学地设置诉讼结构 大有裨益。     

中国倡导国际关系民主化的重大战略意义

经济全球化和世界多极化发展，呼唤和催生国际关系民主化，同时，实现国际关系民主化也是当前大多数国家在国际关系中追求的价值取向。当前影响和平与发展的不确定因素依然存在，要从根本上解决这些问题必须通过实现国际关系民主化这一途径来加以解决。实现国际关系民主化目标是一个长期的渐进过程，应该从道义和舆论、双边或多边外交关系和国际制度建设三个层面加以推进。这一思想无论是在理论领域丰富和发展中国国际战略思想，还是在维护世界和平、促进发展、提高中国的国际地位、改善和发展我国的对外关系等实践中都具有非常重要的战略意义。

Ukrainian Integral Nationalism in Quest of a "Special Path" (1920s-1930s)

The ideology of Ukrainian integral nationalism in the interwar period developed two main varieties—one more focused on ideas and the other on action—which were influenced by fascism yet remained apart from it. Their main contribution to later nationalist theory was the idea of the "special path" or "third way."
