21世纪,人类步入了网络时代。随着互联网的高速发展,个人隐私在网络空间的安全性不断受到威胁,网络隐私权的保护问题日益凸显。在我国,加强网络隐私权的保护已成为当务之急。本文在对网络隐私权的概念、基本特征及其侵权模式进行分析的基础上,结合我国的隐私权和网络隐私权的立法现状及存在问题,并借鉴国外网络隐私权保护的立法模式,提出了构建我国网络隐私权保护体系的立法建议。 相似文献

互联网的发展改变了人们的生活方式,给人们的生产和生活带来极大的便利,同时网络也使得人们的隐私变得更加透明,让现实空间里个人隐私权的问题延伸至网络空间。因网络具有互动性,网络隐私权一旦被侵害代价极大,所产生的后果远远大于传统意义上的隐私权侵害。针对当前网络隐私被侵犯之现状,本文从网络隐私权保护出发,分析了网络隐私权的内涵与侵权行为的表现,在此基础上指出了我国网络隐私权保护存在的问题,提出了完善我国网络隐私权保护的策略。 相似文献

Mobile customers are increasingly being tracked and profiled by behavioural advertisers to enhance delivery of personalized advertising. This type of profiling relies on automated processes that mine databases containing personally-identifying or anonymous consumer data, and it raises a host of significant concerns about privacy and data protection. This second article in a two part series on “Profiling the Mobile Customer” explores how to best protect consumers’ privacy and personal data through available mechanisms that include industry self-regulation, privacy-enhancing technologies and legislative reform.1 It discusses how well privacy and personal data concerns related to consumer profiling are addressed by two leading industry self-regulatory codes from the UK and the U.S. that aim to establish fair information practices for behavioural advertising by their member companies. It also discusses the current limitations of using technology to protect consumers from privacy abuses related to profiling. Concluding that industry self-regulation and available privacy-enhancing technologies will not be adequate to close important privacy gaps related to consumer profiling without legislative reform, it offers suggestions for EU and U.S. regulators about how to do this.2 相似文献

In this article, Ruth Carey takes a critical look at recent privacy-of-personal-information legislation drafted in three Canadian provinces--Ontario, Alberta, and British Columbia. The article begins with a historical overview of international legal instruments and other privacy guidelines, and the Canadian experience with privacy protection. It then critically analyzes the provincial initiatives in the context of the federal Personal Information Protection and and Electronic Documents Act and accepted privacy principles. The article goes on to highlight certain types of legislative provisions of particular interest to people with HIV/AIDS and those who advocate on their behalf. It concludes that the numerous legislative initiatives underway in Canada provide an opportunity to alter the public discourse around the virus, thereby improving the lives of people with HIV/AIDS. 相似文献

In recent years, a growing number of foreign companies and individuals were involved in geodata violations in China. The Chinese government is facing greater pressure to protect confidential geodata within its territory. Geodata violations occurred in the course of illegal mapping and surveying, geographical and geological data collection and transactions. Although China has reformed laws and regulations to refine some aspects of confidential geodata management, existing rules remain ambiguous and controversial. This article aims to address the liability concerns raised among foreign companies from geodata violations. After defining the three most significant concepts, geological data, mapping and surveying, and state secrets, this article reviews the status quo, reasons for and impacts of geodata violations in China, to find out how big the problem is and why it matters. It then explores the legislative framework of state secrets protection in the context of geodata management; special focus is put on liability issues and problems of the current system. As a response to existing arguments, possible ways to improve confidential geodata protection and some practical tips for foreign businesses are offered. 相似文献
