This article uses a hard law—the Rome Statute of the International Criminal Court—to examine the depth of China's socialization in the international human rights regime and the relative weights of sovereignty and human rights norms in determining China's policy choices. It shows that the reasons for China's rejection of the Rome Statute are twofold. On the one hand, Chinese leaders have not fully internalized human rights norms, and they prioritize state sovereignty over human rights when making decisions. On the other hand, the legalized Rome Statute sets up an independent court with mandatory jurisdiction and grants the Prosecutor the ex officio right to investigate a crime. Such treaty provisions may have negative impacts on China's core sovereignty of territorial integration and regime security, thus imposing high sovereignty costs on China. Therefore, China resolutely voted against the Rome Statute, even if such an action made it a small minority outside the international mainstream. These findings indicate that China is still in a weak socialization stage and is not able to take on binding human rights and humanitarian obligations with high sovereignty costs.  相似文献

China in recent years has been asked by other major powers to take a greater share in international responsibility in response to the rise in China's national capability. Negative perceptions about how China is dodging its international responsibility exist not only among policy makers around the world, but have spread to worldwide mass publics, especially across the American people. In this article, we apply the dataset from the ‘Americans’ Attitudes toward China Survey' (AACS) to investigate what the American public think of China's international responsibility and which factors explain the varying evaluations from different theoretical perspectives. The results indicate that Americans' negative evaluations of China's international responsibility are associated with poor ratings regarding China's fulfillment of its domestic obligations and apprehension regarding China's potential threat, but has little to do with China's international behavior. To reduce these negative evaluations, China needs to improve its human rights conditions, give people more political rights, and convince the American public of the benevolence of its ascending power. In addition, persistent efforts toward soft-power construction are also very important since Americans who are interested in Chinese culture or knowledge tend not to think that China is dodging its international responsibility.  相似文献

China's attitude towards UNPKOs has experienced two shifts since the 1980s. One is about changing from non-financial-support, non-voting, and non-participation concerning peacekeeping to financial-support, voting, and participation in 1981. The other shift concerns China's gradual change in its attitude toward non-traditional peacekeeping over the 1990s. This paper provides a norm perspective on the issue. Specifically the author argues that China's attitude toward UNPKOs changed as a result of the change in international norm from prioritizing sovereignty to prioritizing human rights, and the diffusion of the norm of human rights into China through a variety of agents such as foreign policy elites and two special groups of PLA officers.  相似文献

One of the most intriguing ironies of our era is the result of recent changes in the former communist world. Whereas the “democratizing” Russia and Eastern European countries are caught in repeated political as well as economic crises, the “unrepentant” authoritarian China and Vietnam are seeing their economies booming and more market‐oriented. Such an irony poses many important questions. One of the questions is how China has managed to get where it is. This paper represents an attempt to address this question. Firstly, it will briefly outline where economic reforms have brought China so far. Secondly, it will discuss two popular models used to explain China's economic performance. And finally, it will develop an alternative model that combines politics and economy in accounting for China's reform experience.  相似文献

Taking enviornmental management in Guangzhou as an example, this article explores the theory and practice of Communist China's idea of “environmental management by law.” Based on the Guangzhou experience, it argues that environmental management by law in China is mainly an administrative system of environmental management which takes law strictly as a tool for efficient and effective environmental protection. This system is operated on the principle of ‘rule by law’, and is the antithesis of the Maoist practice of “rule by person.” Contrary to its Western counterpart, China's environmental management system is built on a state‐centered conception of administrative law instead of a ‘right‐centered’ one which is the core of the ‘rule of law’ tradition.  相似文献

This article examines one aspect of China's “second revolution” led by Deng Xiaoping: the relationship between the post‐Mao leadership and the intellectuals, who were the most persecuted during the “Cultural Revolution.” When Deng took power in 1978, one tough challenge was to mobilize China's well‐educated men and women for the nation's modernization. New policies toward them were introduced to rekindle their enthusiasm in creative and critical academic activities. The anticipation of a new period of cooperation between the authorities and the intellectuals was, however, dashed by the bloodshed in Tiananmen Square on June 4, 1989. Why did Deng, who sought the support of Chinese intellectuals for his modernization program, side with the Party's hard‐liners to order the military crackdown on pro‐democracy demonstrations? Will China's post‐Mao leadership no longer need the intellectuals’ help? This article argues that the Communist Party of China has been playing “a dangerous game of cooperation” with the intellectuals. Despite the tragic events, the game is likely to continue as long as the CCP proceeds with its modernization program and the intellectuals maintain their sense of mission. What remains uncertain is how the next round of game will be played out and who will emerge as the winner.  相似文献

During the past few decades, China's economic success has permitted it to pursue a greater role on the international stage. China is recognized both as a regional and aspiring global power. Nowhere is this more evident than within Southeast Asia, where China's more active diplomacy is reflected in growing trade relations, proposals for stronger security ties, and the signing of numerous cooperative agreements on issues as varied as environmental protection, drug trafficking, and public health. As a whole, the region has received China's activism with both enthusiasm and trepidation. China has expended significant effort to assuage the fears of its neighbors by adopting a foreign policy approach that is active, non-threatening, and generally aligned with the economic and security interests of the region. This positive diplomacy has clearly yielded some success, most notably in the trade realm, where China is rapidly emerging as an engine of regional economic growth and integration that may well challenge Japanese and American dominance in the next three to five years. In the security realm, China's diplomacy, while rhetorically appealing to regional actors, has yet to make significant inroads in a regional security structure dominated by the United States and its bilateral security relationships. Most significantly, however, if China is to emerge as a real leader within Southeast Asia, it will also need to assume more of the social and political burden that leadership entails. As China continues to advance itself as a regional leader, its policies on issues such as health, drugs, the environment and human rights will face additional scrutiny not only for their impact on the region but also for the more profound question they raise concerning the potential of China's moral leadership. For the United States, China's greater presence and activism suggest at the very least that it cannot remain complacent about the status quo that has governed political, economic and security relations for the past few decades. Shared leadership within Southeast Asia will likely include China in the near future, with all the potential benefits and challenges that such leadership will entail.  相似文献

This article examines the implications of the political transition of Hong Kong on US‐China relations in strategic, political and economic dimensions. It evaluates the impact of Hong Kong's changing status in the context of the engagement‐containment debate on China policy in the US. It suggests that US concerns over questions such as democracy and human rights and China's rejection of foreign interference’ in Hong Kong would turn the territory into a source of political conflict between the US and China. Finally it points out that any major trade confrontation between the two countries would have serious implications for the territory. The article concludes by arguing that if Hong Kong could continue to be a prosperous and free society with a global outlook, it would facilitate China's integration with the global community, but if a reversion to authoritarian rule occurred in Hong Kong, US‐China relations will be aversely affected.  相似文献

The Lhasa riots in 2008 re-captured the world's attention on the Tibet problem. As China continues to grow as a rising power, it raises a concern over whether the perception of a rising China will affect how American people think about the Tibet problem. In this article, the authors apply public opinion data to evaluate this question. The results show that the perception of China's hard power or soft power has little influence on Americans' view of the Tibet problem, while factors of political values and China's policy stance matter greatly. Our findings suggest that the huge difference in political values between the PRC and the US makes it tough for both sides to agree on a resolution to the Tibet problem. In the long term, China needs to improve its human rights record and present itself as a responsible great power to win over the hearts of foreign publics rather than conduct a public relations campaign according to its own imagination.  相似文献

Many reporters and scholars outside China advocate the privatization of land ownership in China as a necessary step for the transformation of China's agriculture system into a modern, large-scale, market-oriented and technology-intensive one. Chinese scholars advocating land privatization, for their part, typically argue that land privatization would better protect farmers’ rights and interests. We present a contrarian view to these calls for land privatization. Under China's current system of collective land ownership and individualized land use rights, agriculture has modernized rapidly in China in a way that has avoided privatization's many downsides. Land privatization, by contrast, would only exacerbate class inequality and social tension in rural China and further weaken farmers’ positions in dealing with more powerful actors. Through analyzing six dimensions of this issue—increasing investment in land and agricultural productivity, promoting scaled-up modern agriculture, protecting farmers’ land rights and preventing land grabs, enhancing rural livelihoods, and facilitating rural migrants’ integration into cities—we maintain that strengthening the current system is superior to privatizing rural land.  相似文献

This paper studies the present land disposition (requisition and acquisition) and land use rights transfer system in China with emphasis on its marketization and its institutional arrangement concerning the central state and the local government. China's current land property right system is first described. It finds that although the communist government gained full control over the Chinese Mainland in 1949, it had never constitutionalized the state ownership of land until December 1982. Since then, the State owns all urban (nonagricultural) land and the rural collectives jointly own agricultural land. Only the user rights of urban land are allowed to be transferred. China's land administration system, its historical evolution, and its institutional configuration are then studied. Institutional difficulties associated with this system are also discussed. This paper proceeds further to study China's land requisition approval system. The role of the local government in land transactions is also discussed. The rest of this paper inquires into the marketization of land transactions in China. Discussion on the trend of China's land market development, suggestions for its improvement and remarks for future studies conclude this paper.  相似文献

Future international relations in East Asia are likely to be largely shaped by the maritime strategies and policies of various actors. This paper examines China's policy and behavior in maritime cooperation in the East Asian region in recent years, a topic that has been insufficiently understood. I suggest that while it is necessary and useful to take into account China's naval power, more attention to Chinese intentions and policy on East Asian maritime issues is warranted to arrive at a more balanced, and arguably more accurate, understanding of China's role in East Asian maritime affairs. This paper takes stock of China's changing perceptions, attitudes, and behaviors in maritime cooperation in the region. I describe China's new policy moves in the South China Sea and East China Sea. I also address some of the major Chinese concerns for further maritime cooperation in East Asia. I conclude that while a grand cooperative maritime regime is still not possible from a Chinese perspective, China is likely to agree to more extensive and substantive maritime cooperation in many functional areas, most notably in the non-traditional security arena.  相似文献

Counting only China's female population, China would still be the second most populous nation on earth. With the implementation of the “Open Door” policy and the introduction of a market economy, Chinese women will gain new opportunities and face unfamiliar obstacles. To adapt, they must be willing to reevaluate traditional roles, and meet these challenges head‐on. Chinese women can learn some from the spirit of western women in their struggle for equality. Like it or not, the reality of “China at the Turn of the Century” will demand changes. This article attempts to (1) draw attention to the changing status of women in China; (2) compare their emerging struggle to that of American women; (3) suggest that Chinese women adopt the spirit of western women to redefine themselves without losing their Chinese identity.  相似文献

China's entry into the World Trade Organization has been applauded for the benefits it will confer on China's economy and for granting recognition to China's modernizing efforts. The scrutiny of the outside world will force China to regularize many of its practices, such as legal and economic practices. But most of the discussion of the WTO has focused on a very limited segment of China's society. This article considers the realities of rural Chinese life, warning that the consequences of China's increased pressure to reform may be more negative than positive and that the prospect for rural China is far from clear.  相似文献

This essay provides an analysis of China's National People's Congress (NPC) as a key institution in China's transition from an authoritarian regime to a pluralist political system. Using the revealing incident of Hu Jiwei's attempt to force a meeting of the NPC Standing Committee as a model of possible future interaction between the NPC and the CCP, the author hypothesizes that the NPC may serve as a major site for bringing about significant political change. It provides a new perspective on the NPC by adopting an institutional‐functional approach. Specially, the author tries to explain the function and strength of the legislature as an implanted Western institution in China's context by looking into how its essentially democratic core‐representation, which, to simplify gross, was dismissed by previous researchers as only existed in “sociological” terms, survived through adapting into Chinese own tradition and political infrastructure.  相似文献

刑事司法实践中"一捕到底"、"久押不决"、"不当羁押"等现象时有发生,严重背离了羁押的初衷,侵害了被羁押人的合法权利。修改后的刑诉法在对现行羁押措施进行重新审视之余,确立羁押必要性审查制度,承继了尊重和保障人权的刑事诉讼原则,填补了我国在羁押救济规则方面的立法空白,强化了检察机关对诉讼活动的法律监督,防止超期羁押和不当羁押的发生,也有力地保障了被羁押人的合法权益。但是,新刑诉法过于原则性的规定,制约了捕后羁押必要性审查的实际操作,使其成为毫无强制力和生命力的"摆设"。因此,无论是从被羁押人权利保障的角度,还是从公安司法机关权力相互制约的角度,都需要对捕后羁押必要性审查机制进行严密的设计,以增强该机制的司法适用功效。  相似文献

This paper uses a survey at six universities in China to analyze university students' views on China's energy problems. It finds that gender, the nature and location of a student's original community, and their level of education affects students' views about China's energy problems, as well as the types of solutions that are deemed to be most appropriate to manage this looming crisis. University students are quite concerned about China's energy situation. For them, it is already a crisis. They fear China will be controlled due to resource dependency, see the US as China's primary energy competitor, all the while advocating a more hawkish attitude towards Japan in the East China Sea. But, they look foremost to domestic solutions to this crisis, such as enhanced conservation, more efficient use of energy, new technologies, enhancing China's strategic reserve, and increased government taxation, particularly of large enterprises. When they look abroad, they support diversifying energy sources, increasing energy cooperation, particularly with Russia and Central Asia (but not with Japan), and some increase of the navy's role in enhancing sea lane and energy security.  相似文献

China's trade patterns with African countries have made Beijing the focal point of new anti-Chinese resistance narratives in Africa. Unlike the Maoist era, when China's trade policies served its leaders' political goals, now they aim to access markets as part of China's larger domestic development strategy. China's state-run firms can channel China–Africa trade through extra-market decisions that influence flows, yet, ultimately, Beijing's ability to direct trade with Africa is constrained by market forces. Despite suggestions that shared illiberalism drives China–Africa trade the author concludes that five interrelated causal factors overwhelmingly determine China–Africa trade: China's comparative advantage in labor-intensive and capital-intensive production; Africa's abundant natural resource endowments; China's rapid economic growth; China's emphasis on infrastructure building at home and in Africa; and the emergence of economies of scale in China's shipping and light manufacturing sectors.  相似文献

This article evaluates China's model of development, especially its main component, i.e. its model of governance. It suggests that China's model of development is marked by an imbalance between fast opening of the economy and the society and sluggish opening of the political system. The Chinese society has become much more open, reflected in the Chinese growing awareness of their legal rights. The Chinese economy has become highly internationalized and open, but much of Chinese politics is closed. China's governance is marked by pro-growth authoritarianism. The Chinese state is effective in opening up the economy, promoting reform, and generating economic growth, but offers weak protection of people's rights and ineffectual mitigation of social grievances. These imbalances help produce social protests. Viable solutions are discussed.  相似文献

In this paper we provide an overview of China's human capital strategy and educational achievements over the last two decades. While everyone acknowledges China as an economic superpower, very few are aware of or realize China's notable achievements in education as well as its internationalization of education. Since 1978, the landmark for the foundation of the Chinese modern higher education system, China has made tremendous strides in education both domestically and internationally. While China maintains 10% growth in GDP, albeit with a GDP per capita at a low level for a developing country, it is also producing serious scholars and a tremendous amount of scholarly output; more and more Chinese students are seeking higher education abroad; and international students are showing a rising interest in receiving education in China.  相似文献
