清代州县的法律生活图景——读《清代县域民事纠纷与法律秩序考察》

作为2012年《国家哲学社会科学成果文库》中的一种，吴佩林教授的新作《清代县域民事纠纷与法律秩序考察》于中华书局出版。该书系统利用四川《南部档案》，并结合四川《巴县档案》、河北《宝坻档案》、台湾《淡新档案》、四川《冕宁档案》、浙江《黄岩档案》、浙江《龙泉档案》等清代州县档案以及传世文献、田野调查等资料，打通从民间到衙门的解释渠道，就民事纠纷在民间社会的产生与调解、上诉到衙门，直至县官的裁决这一过程作了精细的实证研究，给我们展现了一幅清代州县鲜活的法律生活图景。     

清代法律位阶关系新论 ——以《大清律例》和《户部则例》的关系为例

作为清代法律体系的主干法律，《大清律例》与包括《户部则例》在内的部门则例均是具有重要实用功能的基本法典，它们分属于不同的门类，在调整方法和条文内容等方面具有互补性。就法律体系内部的效力等级而言，《大清律例》并不存在凌驾于《户部则例》之上的法律位阶，它们在不同的领域发生作用，彼此间是一种分工与配合的关系。部门则例是中国传统法律部门发展完善的最后阶段，标志着清代法律体系已发展成为中国传统法制的完备形态。     

我国民事调解制度中的调解协议与民事调解书刍议

民事调解协议和民事调解书是法院进行民事调解的重要法律文件，但是，我国《民事诉讼法》及最高人民法院《关于人民法院民事调解工作若干问题的规定》（法释[2004]12号）（以下简称《调解若干规定》）等均未对民事调解协议的法律效力及其与民事调解书的法律关系予以界定。而且笔者认为，从法理上来看，现行法律对于调解协议与民事调解书的规定本身存在着诸多矛盾，

《大清律例》法律术语特征探析

法律其实就是语言的法律。法律语言的法律词汇系统主要由法律专门术语和法律专业词语有机组合而成。法律专门术语是生成法律文本语言整体系统的核心要件。《大清律例》数以千计的法律术语,展现的是清代法律语言文化的核心价值观念,一定程度上昭示了中国古代传统法律语言体系的整体性法律观念及清代法律语言文化的时代特征。《大清律例》法律语言障碍的分析和疏解,主要体现为对其法律术语外化符号表现特征的理解和阐释。从不同视阈考察《大清律例》法律术语符号体系,归纳总结其饱蘸中华法系独特性格特征的法律专门术语外化表现形态,揭示其存在的专属性汉民族传统法律术语文化精神的客观规律,是研究清代法律语言文化整体价值的必由之路。     

最高人民法院关于审理劳动争议案件适用法律若干问题的解释（四）

为正确审理劳动争议案件。根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》、《中华人民共和国劳动争议调解仲裁法》、《中华人民共和国民事诉讼法》等相关法律规定，结合民事审判实践．就适用法律的若干问题，作如下解释：     

法律翻译在中国近代的第一次完整实践——以1864年《万国公法》的翻译为中心

无论在中国,还是世界上其他国家,法律移植都是与法律翻译联系在一起的。后者是前者的前提,前者是后者的结果———当一个国家希望学习、借鉴、吸收其他国家的法律时,由于是不同的语言,就必须将他国的法律先翻译为本国的语言,然后才有可能作出判断、作出评价、作出采纳与否的选择。本文以1864年翻译出版的《万国公法》为具体个案,着重解读中国近代第一次完整的法律翻译实践过程及这一实践的成果与不足,分析其对中国近现代法律翻译与移植乃至本土化运动的影响,并揭示其如何促进了中国近代翻译学、语言学的进步。

罪刑法定视域中的刑法适用解释

The judicial interpretation of criminal law should be an application interpretation to individual cases that is guided by judges and participated by the prosecutor and the accused, for which the judicial judgment should be combined with the application of criminal law of specific cases, and the criminal precedents should be as a carrier. The Supreme People’s Court should change from the previous practices of issuing normative and abstract interpretation to the dual approaches of the interpretation of criminal law application through direct creation and indirect acknowledgement. Liang Genlin, Professor and Vice Dean of Law School of Peking University and as a visiting professor of University of Tuebingen (2001–2002). His main research focuses on criminal law and criminal policy, and his important publications include “On the Structure of Punishment”, “Liang Genlin’s Review on Criminal Policy, Volume I, Criminal Policy: Standpoint and Category”, “Liang Genlin’s Review on Criminal Policy, Volume II, the Arm of the Law: Expand and Limit”, “Liang Genlin’s Review on Criminal Policy, Volume III, Criminal Sanction: Manner and Choice”.
