Victim Noncooperation in the Prosecution of Domestic Assault   总被引:2,自引:0,他引:2
MAUREEN McLEOD 《犯罪学》1983,21(3):395-416
In recent years increased attention has been focused on the response of the criminal justice system to domestic violence. Several studies have attributed the low rate of prosecution for spousal assaults to noncooperation on the part of police, prosecutors, and judges. A discussion of the role played by victim noncooperation in the prosecution process has been conspicuously absent. This article presents preliminary findings from a study of approximately 6,200 cases of domestic assaults reported to law enforcement authorities. The incidence and correlates of victim noncooperation are outlined at four decision points.  相似文献

Estimates of the prevalence of marital violence have been found to vary dramatically from survey to survey. This paper addresses one potential explanation for this difference which involves the focus and format of different surveys. We examine the extent to which survey respondents are willing to report marital violence in a context which focuses on criminal behaviors as opposed to a family violence context. In a very basic way, this answers a question as to whether individuals are willing to define acts of marital violence as criminal. Methodologically, it is a measurement issue which seriously affects the ability to compare findings across samples. National Youth Survey data are used to compare rates of generalized spousal assault and victimization reported in a crime context with rates of marital assault and victimization reported in a family violence context. Results indicate that 40 to 83% of all marital assaults and victimizations reported in the marital violence section are not reported in a format which focuses on criminal assault and victimization.  相似文献

ABSTRACT

Due to new legislation passed in 2011, Finnish police have been legally obligated to record and investigate all assaults, including petty assaults, occurring in close relationships. Referred to as domestic violence (DV), these assaults can be prosecuted even without victim consent. Much like pro- and mandatory arrest policies, this reform was aimed at decreasing victim and police discretion, based on the assumption that recording and preliminary investigation of every DV incident would help prevent further violence. Comparison between police call outs and the number of offences indicate that in reality not every DV incident is recorded. Using Police and Emergency Call Database data merged with 410 police officer survey responses, the current study presents the first empirical results on legal and extra-legal factors associated with recording DV as an offence in Finland. Factors explaining non-recording are discussed based on police officers’ free-text comments, and implications for policy and practice are presented.  相似文献

Abstract

The incidence of hate crime victimization in the states has received scant attention by researchers. Nor is it always clear who feels most vulnerable to hate crime victimization and why. In this research we included hate crime victimization questions in two years (2000, 2001) of a statewide survey. Idaho is a state with a predominately White population. It has been bedeviled with an Aryan Nation's compound and its attendant racist propaganda. We found that many citizens had been the victim of hate crimes in the last year and over the course of their lifetime. Minority group members were disproportionately represented as victims of hate crime and were almost three times as likely to feel vulnerable to it, as White respondents.  相似文献

This study examines short-term (five- to ten-year) trends in crime and juvenile delinquency using FBI Uniform Crime Reports data on arrests and offenses known to the police, National Crime Survey data on victimization, and National Youth Survey data on self-reported delinquency. The focus is on FBI Index offenses, but less serious offenses are also considered. FBI statistics indicate generally increasing rates of crime, while NCS and NYS data indicate stable and occasionally decreasing rates. Data on the self-reported incidence of delinquency are more compatible with arrest data than are data on the self-reported prevalence of delinquency, but the two self-report measures are more compatible with one another than with arrest data. Attempts to reconcile official statistics with victimization surveys and self-report studies seem unlikely to overcome the differences among the sources when trends in crime, rather than rates of crime at a single time, are considered.  相似文献

The current study attempted to expand the understanding victimization of police by examining the impact of a variety of factors related to community and aggressive policing styles on injurious assaults rates across 267 large municipal police departments. Regression analyses indicated that policing styles related to community meetings are associated with low levels of assault rates. Second, policing styles related to aggressive enforcement of drug laws has an aggravating effect on police victimization. Finally, departments that had high police-to-citizen population ratios also had lesser rates of injurious assaults.  相似文献

Studies concerning inmate-on-inmate sexual assaults within male correctional facilities are sparse in the sociological and correctional literatures. Only a few studies have specifically examined the characteristics of male inmate sexual assault targets. The current research sought to address this gap by providing an examination of factors related to victimization likelihood. Using data gathered in March 2000 from 142 inmates (18% return rate) in one Southern maximum-security prison, the authors examined demographic and behavioral characteristics of male inmate sexual targets. Based on inmates' self-reports of sexual victimization--threatened and/or forced sexual assault encounters--correlates of victimization were identified. Approximately 18% of the inmates reported inmate-on-inmate sexual threats, and 8.5% reported that they had been sexually assaulted by another inmate while incarcerated.  相似文献

Abstract

There has been little systematic research on how the characteristics of locales condition the relationship of ethnicity to crime-related attitudes, and none of it has examined southwestern Hispanics. Addressing these issues, this investigation examines the effects of ethnicity and concentrated minority disadvantage on confidence in the police and perceived risk of victimization. Data collected in telephone and personal interviews in El Paso, Texas, were analyzed using OLS multiple regression. The analyses show that Hispanics residing in the locales with the greatest concentrated minority disadvantage expressed less confidence in the police than did Hispanics residing in other areas and, irrespective of locale, Anglos. People residing in areas of concentrated disadvantage perceived greater risk of victimization than did those who resided elsewhere. In addition, confidence in the police was related negatively to perceived risk of victimization. These findings indicate that concentrated minority disadvantage has an important influence on crime-related attitudes.  相似文献

PurposeWhereas past research has examined the effect of individual-level and neighborhood-level predictors of bullying victimization separately, the current study examines their effects collectively.MethodsMiddle and high school students (n = 1972) in randomly selected classes within a Southeastern school district completed a battery of self-report measures. Levels of self-control (an individual-level factor) and neighborhood disorganization (a neighborhood-level factor) were regressed onto measures of the six-week prevalence of verbal, physical, and cyber bullying victimization.ResultsLow self-control and neighborhood disorder were found to be associated with each type of bullying victimization, though the impact of self-control was partially mediated by neighborhood disorder when included in the same model. The effect of self-control was mediated when subsequently controlling for poly-victimization experiences. Net of these controls, neighborhood disorder continued to be associated with a statistically significant increase in the odds of bullying victimization.ConclusionsEconomic and social decay within neighborhoods increased the likelihood of bullying victimizations. These effects hold true across verbal, physical and cyber victimizations, suggesting a need to consider both community characteristics when staging bullying intervention campaigns. Additionally, the findings suggest a need for further research considering the relationship between self-control and neighborhood conditions on the risk of victimization generally.  相似文献

We examine the effect of alcohol consumption on an individual's risk of victimization for physical and sexual assault. Analyses of the National Violence Against Women Survey suggest that the frequency and amount of alcohol people consume has strong effects on their risk of victimization when drinking, but is not associated with their victimization while sober. This evidence suggests that drinking has a situational causal effect on victimization, and cannot be attributed to opportunity factors associated with drinking. This effect is particularly strong for men and young adults, who may be more likely to behave provocatively when under the influence. Victims of sexual assaults and men assaulted by their female partners are also particularly likely to be drinking.  相似文献

Despite the fact that police officers are usually the first persons within the criminal justice system to respond to a criminal victimization, the majority of research investigating racial discrimination within the system has examined primarily the effects of race on adjudication outcomes which occur after initial police interventions, such as conviction decisions and sentences. Very little empirical effort has been devoted to examining the effects of race on early police responses to a reported victimization. Using data from the National Crime Victimization Survey from 1987 to 1992, this paper investigates the effects of both the victim's and the offender's race on three police responses to robbery and aggravated assault: (1) police response time to the scene, (2) effort exerted by the police at the scene, and (3) likelihood of arrest. It was found that police were quicker to respond and also exerted more effort at the scene such as searching and taking evidence to incidents of black on white robbery compared to all other racial dyads. This relationship held even after controlling for other factors such as victim-offender relationship, poverty, injury to the victim, and victim's gender. No significant effects of race, however, were found when predicting the probability of arrest in cases of robbery. The effects of race on police responses to aggravated assault were more complicated. For assaults involving strangers, police were significantly more likely to exert additional effort at the scene if the victim was white and the offender was perceived to be black. This effect was reversed, however, for nonstranger assault victimizations. Police were significantlyless likely to exert effort at the scene or to make an arrest in black on white assaults involving nonstrangers. The most consistent predictors of arrest in both stranger and nonstranger assault victimizations were police response time, injury to the victim, and the incident occurring in a public setting.  相似文献

This article examines developmental trends in the rates of different kinds of victimization across the span of childhood. The Developmental Victimization Survey was a national telephone survey of the victimization experiences of 2,030 children from ages 2 to 17. The overall mean number of victimizations during a single year increased with age, as did the percentage of children with polyvictimizations (4 or more different kinds of victimization). However, some specific types of victimization, physical bullying and sibling assaults, were highest prior to adolescence and then declined. Other types had different developmental patterns by gender. Peer assaults increased in adolescence for boys but not for girls. Child maltreatment and sexual victimization increased in adolescence for girls but not for boys. The complex and diverse patterns of developmental vulnerability to different kinds of victimization at different ages need more exploration and explanation in order to better target prevention and intervention policies.  相似文献

The role of environmental factors in incidents of violence has been relatively neglected in recent decades. Complementing recent research in social psychology and social geography, the present study tested two hypotheses: (1) general environmental conditions-day of the week, season of the y ear, and thermal stress-are significant predictors of the daily incidence of assaults on children, and (2) victim characteristics, sites of incidents, and types of assaults on children vary with levels of neighborhood socioeconomic status. Some 1614 incidents involving persons aged 18 and under were abstracted from a data base of 9994 aggravated assaults drawn from the files of the Dallas, Texas, Police Department, covering a 20-month period from March 1980, through October 1981. Analysis indicated that general environmental indicators are significantly related to daily frequencies of assaults on children. Further, neighborhood socioeconomic status was significantly associated with children's race, sites of assaults on children, and types of assault. Overall, only 11% of the assaults studied were classified as “abuse.” The dominant modes of assault involved firearms (28%) and knives (23%). The analysis revealed how assaults on children varied quantitatively and qualitatively as a function of victim characteristics, temporal and spatial context, and thermal stress.  相似文献

Most research on strain theory has focused on the effect of personally experienced strain on delinquency. This study focused on vicarious and anticipated strain; vicarious strain refers to the real-life strains experienced by others around the individual, while anticipated strain refers to the individual's expectation that current strains will continue into the future or that new strains will be experienced. Data from a national sample of adolescent boys were used to examine that type of strain involving physical victimization. A multiple regression analysis indicated that delinquency is related not only to experienced victimization, but also to certain types of anticipated and vicarious physical victimization.  相似文献

Abstract

Limited research exists on the extent to which the public supports the criminalization of domestic violence, and whether people believe police pro-arrest policies will deter future offending. Based on conflict theory, it is hypothesized that there will be differences in support for criminalization between powerful (i.e., middle to upper class Caucasian men) and less powerful demographic groups (i.e., women, minorities, and the economically and educationally disadvantaged). Data were collected from a randomized telephone survey of Alabama residents and analyzed using ordered regression models. Results indicate that a majority of respondents agreed with a pro-arrest policy for domestic violence; however, age, education, income, and gender subgroup differences offer support for the conflict model. An additional finding that domestic violence victimization plays a significant role in the formulation of respondents' attitudes toward these policies needs to be more closely investigated.  相似文献

Objectives

To present and test an opportunity perspective on prison inmate victimization.

Methods

Stratified random samples of inmates (n 1 = 5,640) were selected from Ohio and Kentucky prisons (n 2 = 46). Bi-level models of the prevalence of assaults and thefts were estimated. Predictors included indicators of inmate routines/guardianship, target antagonism, and target vulnerability at the individual level, and several indicators of guardianship at the facility level.

Results

Assaults were more common among inmates with certain routines and characteristics that might have increased their odds of being victimized (e.g., less time spent in recreation; committed violence themselves during incarceration), and higher levels of assaults characterized environments with lower levels of guardianship (e.g., architectural designs with more “blind spots”, larger populations, and less rigorous rule enforcement as perceived by correctional officers). Similar findings emerged for thefts in addition to stronger individual level effects in prisons with weaker guardianship (e.g., ethnic group differences in the risk of theft were greater in facilities with larger populations and less rigorous rule enforcement).

Conclusions

The study produced evidence favoring a bi-level opportunity perspective of inmate victimization, with some unique differences in the relevance of particular concepts between prison and non-prison contexts.  相似文献

There has been ongoing debate on how women are counted when they do not acknowledge as rapes experiences that are characterized by the key components of rape. This article explores this methodological issue by using a two-stage measurement strategy with behaviorally specific screen questions to gather information on incidents of sexual victimization from 4,446 randomly selected female college students. Our results revealed that almost half of the completed rape victims considered the incidents rapes, yet few of the attempted rape or nonrape victims considered the incidents rapes. The results of a multivariate analysis highlighted the characteristics of incidents that are likely to be considered rapes. The findings buttress the assertion that women who are counted as rape victims have experienced such victimization.  相似文献

Little is known of the circumstances surrounding prison inmates' assaults on correctional officers. To provide a foundation for understanding the meaning of these events, this exploratory study analyzes a sample of 694 official reports of assaultive incidents in a large state prison system over a one-year period. Results of a content analysis suggest that assaultive events occur in relation to a number of interactional themes—unexplained, officer's command, protest, search, inmates' fighting, movement, contraband, restraint, discipline, emotional instability, sexual, intoxication, and medical. The study's findings affirm that prisoners and officers must cooperate in order to negotiate each day with a minimum of disruption. When either party violates salient norms, mutually beneficial interaction patterns may break down and violent interactions may result. Officially reported assaults on staff members may be understood most clearly by considering the authority of officers, the autonomy of prisoners, and processes of social control enacted by prisoners and officers alike.  相似文献

Abstract

This article examines how economic, emotional and social-power related factors affect victims' behavior in favor of prosecution during police investigations. Data drawn from police records and police narrative reports indicated that mutual charge, dual arrest, the severity of assaults and the severity of injuries suffered by victims negatively affected the victims' behavior in favor of prosecution. These findings suggest that the norm of unequal relationships between men and women combined with an indiscriminate use of mutual charge and dual arrest without considering the defensive or offensive nature of violent acts can reduce trust in the criminal justice system among women victims of domestic violence and decrease the victims' interest in pursuing prosecution.  相似文献
