The International Conference on the International Cooperation in Human Rights and the Chinese Perspective organized by the Institute of International Law, Chinese Academy of Social Sciences, took place in Beijing, China from October 22-23, 2016. Both Chinese and foreign human rights experts convened to exchange their opinions on the new development of the human rights theories and practices, especially from the Chinese perspective. The socialist concept on human rights with Chinese characteristics was discussed intensively during the meeting and new terms such as "the Human Rights Model of the South" and "the Human Rights Perspective of the South" were raised. The participants interpreted and summed up the experiences and features of the Chinese socialist human rights cause. The drafting and implementation of the Chinese National Human Rights Action Plans and the progress in the promotion of rule of law in China were mentioned. They highly valued the constructive roles played by China in the international human rights cooperation field, especially under the United Nations(UN) human rights regime and for the implementation of the UN 2030 Agenda for Sustainable Development.  相似文献

The symposium on the "Progress of Human Rights Development in the New Era in China" was jointly hosted by the China Society for Human Rights Studies and the Publicity Department of the Guangdong Provincial Central Committee of the Communist Party of China and organized by Guangzhou University Institute for Human Rights in Guangzhou on 19 December 2017. Scholars and experts from more than 20 universities and institutes, as well as delegates from over 10 ministries and commissions under the State Council participated in the symposium. The symposium explored four themes: "Human Rights Connotations in Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era", "The Progress of Human Rights Development in China after the 18 th National Congress of the CPC", "The Prospective of Human Rights Development in the New Era in China", as well as "Building a Community with a Shared Future for Human Beings and the Progress of the Human Rights Development of the World". In China, there are many human rights organizations, because of their focuses and priorities related to human rights. China Society for Human Rights Studies(CSHRS) is the largest of them, which focuses on human rights research, popularizing and international exchanges. This paper takes CSHRS as an example to show the role of the human rights organizations play in China. From the practice of CSHRS, we can see the human rights organizations in China play a kind of constructive role through involving in very broad fields and engaging in the various activities of human rights protection. Their works include participating in drafting the National Human Rights Action Plans, giving constructive suggestions, working in human rights education, engaging in international exchanges and cooperation, taking part in the work of UPR, raising fund and implementing projects, and so on. They are trying hard to contribute to improve human rights situation in China.  相似文献

China should study the National Human Rights Institution(NHRI) mechanism, establish a NHRI and take the issue seriously. The author firstly points out that NHRIs play the roles of "actors for change", "urgers for reason" and "protectors for rights", which make them possible for protecting human rights. Secondly, China's current human rights protection mechanism has some imperfections, which can be improved by the NHRI, therefore, the establishment of a NHRI in China becomes a necessity. Finally, the author puts forward feasible suggestions on the type, principles, functions and implementing steps for the establishment of a NHRI in China.  相似文献

Whether, and if so how, parliaments should participate in the Universal Periodic Review mechanism of the UN Human Rights Council is emerging. Due to their unique contributions to human rights protection and promotion, parliaments should participate in the process. Furthermore, some parliaments are already involved in this mechanism, including drafting national reports, engaging in interactive dialogues, and the implementation of review recommendations. In the past two rounds of reviews, China's National People's Congress has a positive record in this regard, but it should play a more active role in ratifying or acceding to international human rights conventions.  相似文献

The UN Convention on the Rights of Persons with Disabilities effective in 2008 explicitly stipulates that Member States shall guarantee that people with disabilities enjoy the right to education free from discrimination and without prejudice to equal opportunities.The Chinese government made amendments to the Law of the People s Republic of China on the Protection of Persons with disabilities and the Regulation on the Education of the Persons with Disabilities and issued a series of rules on the Education of the Persons with Disabilities so as to actively implement the Convention. In recent years,the number and proportion of children with disabilities who receive education in China and the number of students with disabilities receiving high school and higher education have been on the rise annually.However, there is still a gap in the level of education on all stages between persons with disabilities and persons without, presenting a huge challenge for the achievement of the right to education of persons with disabilities. We should continue to actively fulfill the obligations prescribed by the Convention to protect the right to education, explore the construction of integrated education, support the maintenance system,strive to improve the quality of special education,allocate resources for the education of persons with disabilities, and emphasize the appraisal of the education of persons with disabilities.  相似文献

Both reasonable accommodation and accessibility are crucial concepts in the UN Convent ion on the Rights of Persons with Disabilities Those two concepts promote each other and should develop as a whole State parties of the Convention undertake immediate obligations to ensure the provision of reasonable accommodation, which has advantages such as characteristics of subjective rights, individualization, justiciability and convenience, making it a flexible tool for the protection of rights It can serve as a supplement to insufficient accessibility and play a unique role in other areas which are irrelevant to accessibility, so as to satisfy the special needs of certain subjects to the largest extent The State Party has an ex ante and progressive obligations to the realization of the accessibility construction, which has advantages of comman design, large scale, economization and no need for individualization consideration In China, various forms of reasonable accommodation have been applied in employment, but they have disadvantages of contingency, randomness, simplicity and lack of systematic support In the process of further promoting the employment of people with disabilities in China, in addition to strengthening accessibility construction, we must fully understand and flexibly adopt reasonable accommodation.  相似文献

China's National Human Rights Action Plans connect policies and laws on human rights protection in terms of ideas,procedures,and contents.The functions of the connections are the guidance to local policymaking,the promise of state commitment,and the linkage to international human rights goals.At the practical level,the enhancement of the connection between policies and laws will promote the effectiveness of human rights protection.In order to improve the rationality of human rights policies,there should be more researches on National Human Rights Action Plans,and more public participation in the process of the Plan drafting.  相似文献

In response to the "cages in courts" issue in criminal trials,after reviewing a series of cases such as "Svinarenko and Slyadnev v.Russia",the European Court of Human Rights has gradually clarified that the "human dignity of the accused and his right to a fair trial are higher than the value of court security",thus found that putting the accused in a cage dock or improper use of a glass cabin dock are in breach of Article 3 and Article 6 of the European Convention on Human Rights,constitutes degrading treatment and violates the right to a fair trial.This position is in line with the international overall trend,which is of significance as a reference for China's courts.Domestic courts should take the initiative to change the current use of the "low fence dock" to further enhance China's judicial civilization.  相似文献

With the topic of "Building a Community with a Shared Future for Human Beings: New Opportunity for South-South Human Rights Development," participants conducted in-depth discussions on topics including "global human rights governance", "inclusive development and South-South human rights cooperation", "China and the SouthSouth cooperation", "right to education for the countries of the Global South" and "poverty reduction, right to food and right to health", which achieved great consensuses and yielded results.
