我国行政复议制度的新进展

在现实社会生活中,为有效地维护公共利益和公共秩序,各级人民政府及其工作部门进行着经常的、大量的、范围广泛的行政管理工作。由于行政权最终要由具体的行政机关和公务员来行使,某些违法或不当的行政行为难以避免,这些违法或不当的行政行为会对相对人的权利造成损害,因此,需要给予行政管理相对人一定的权利救济途径。现代法制国家是通过建立行政复议制度和行政诉讼制度为相对人提供救济的。在我国,行政诉讼是由人民法院对引起争议的具体行政行为进行审查,以保护相对人的合法权益,这一种司法救济,是行政系统外部对行政权的监督形式。行政复议则是与行政诉讼相结合的行政救济制度。它是动用行政机关系统内部的层级监督关系,由上级     

民政部门行政复议与信访若干问题研究

行政复议与信访作为行政救济制度,均为行政主体内部自我纠错的方式。其中行政复议是世界各国普遍采取的为行政管理相对人提供便捷、廉价解决行政纠纷的形式,在行政救济法律制度上具有十分重要的地位。信访则是中国特有的解决行政纠纷的机制,具有非程序性、不确定性和浓厚的人治色彩,缺乏法制的规范性。     

论行政复议决定的法律效力

行政复议决定制度是法治国家解决行政纠纷的重要手段之一,而行政复议决定的法律效力是行政复议制度的生命力,研究行政复议决定的法律效力不仅是完善复议决定理论体系的需要,同时也是决定复议制度能否有效发挥行政救济功能的关键.     

高校行政违法之救济

高校行政违法救济应遵循校内途径首先救济、教育行政机关救济优先、司法机关最终救济、合法和公开公正等五项基本原则。我国应加快完善高校行政违法救济制度体系,建立校内申诉制度、行政申诉制度、信访制度、行政仲裁制度、行政复议制度和行政诉讼制度,使行政救济权在高校得到充分有效的实现。     

浅议国家安全行政复议的范围

行政复议,作为一种救济制度是指行政机关依利害关系人的申请,为解决行政争议而建立的制度。这里所说的救济,是法学用语,是指因行政行为造成损害而采取的补救制度。行政机关是一个庞大的体系,每天做出的行政行为不计其数,其中难免会发生侵犯公民权益的事情,因此,必须有一个解决的渠道与制度,使某些侵害公民合法权益的行政行为得到制止和纠正,弥补和挽回因违法或不当的行政行为给公民合法权益造成的损害。行政复议就是这样一种制度。行政复议     

论公务员行政处分的法律救济

行政处分是对应承担行政法律责任的行政机关公务员予以惩戒的法定形式。如果行政处分违法或不当则有可能侵害公务员的合法权益。考察世界各国行政法,一般都构建了公务员因行政处分遭受权益损害的法律救济制度。我国大陆地区现行的公务员行政处分法律救济制度存在诸多缺陷,未能充分实现其保障公务员权益的目标。完善现行的公务员行政处分法律救济制度,应当建立公务员行政处分的司法救济机制,并健全公务员因行政处分遭受权益损害的赔偿程序。     

完善我国行政救济制度的思考

这里所说的行政救济制度,主要包括信访制度、行政复议制度、国家赔偿制度和行政诉讼制度等。我国现有的行政救济制度在保障和监督行政机关依法行使行政职权,保护公民、法人和其他组织的合法权益,防止和纠正违法或不当行政行为等方面,发挥了积极的作用,其显著功绩不可磨灭。但是

行政复议是行政管理相对人寻求权利救济的一个重要途径,但由于起步晚尚处于建设期等原因,我国现阶段的行政复议制度还存在着很多有待完善的地方。本文笔者主要从行政复议的机关、行政复议的范围、行政复议与行政诉讼的衔接中存在的问题入手提出几点建议。     

由听证实践引发的思考

2004年9月,浙江省民政厅根据《行政许可法》组织了全省民政系统的首次听证会,就撤销金华大学发展基金会变更登记为金华市教育发展基金会进行了听证.听证会上唇枪舌战的陈述和申辩质证,对公务员的行政案件审查能力、依法行政能力直至语言表达能力都提出了较高的要求.作为预防性行政纠错机制的行政听证,与作为事后行政救济的行政复议一道,除了直接保障行政相对人的合法权益,也保障着利害关系人乃至社会公众的合法权益.
