略论信用卡诈骗案件的防范和侦查

随着信用卡的普及，利用信用卡进行的诈骗将会与日俱增。此类犯罪主要有三种方法，其特点表现为：内外勾结、异地作案，连续作案。当前，此类案件增多的主要原因是：执行银行规章制度上存在漏洞，信用卡网络技术落后，特约商户把关不严，银行之间互不通气，个别银行工作人员责任心不强。因此，要预防此类犯罪，必须对症下药，从健全规章堵漏洞，加强宣传教育强素质等方面入手。侦破此类案件也必须从所用信用卡等方面入手。     

完善刑法第一百九十六条的立法建议──由一起骗领信用卡透支诈骗案件引发的法律思考

随着我国信用卡的发展与普及，骗领信用卡透支诈骗的案件逐年呈上升趋势，此类案件侦破难度大，具有较大的社会危害性，因此，必须进行严厉打击。但是，由于我国信用卡诈骗犯罪立法并未对骗领信用卡透支诈骗的行为作出明确规定，这一立法疏漏最终导致了司法实践中对此类案件定性及处理的混乱状况。为了严密法网，有利于司法实践依法惩处这类犯罪，通过对一起骗领信用卡透支诈骗案件的分析，对修改与完善刑法第一百九十六条提出若干立法建议。

浅谈电子设备中电磁信息"痕迹"及提取利用

电磁信息"痕迹"是指高科技犯罪分子在实施作案过程中或者预谋作案时在其使用的通讯媒体、计算机系统或其它具有一定记录保存功能的电子设备上自觉不自觉的留下的种种可供公安机关侦查、了解、掌握作案人犯罪过程、证明案件事实的以电子形式存在的信息与数据。高科技犯罪中电磁信息"痕迹"取证是关键。甚至需要从已被删除、加密或破坏的文件中重获信息。为有效控制高科技犯罪和侦破高科技犯罪案件,必须高度重视电磁信息"痕迹"的提取和分析技术。
