在网络环境下,著作权的保护和发展面临着新的问题,其对象内容及主题都有了一定程度的变化。保护网络著作权应对网络条件下作品表现形式、作品著作财产权的延伸、著作权主体身份及权属证明、著作权侵权责任、网络侵权的制止和网络侵权损害赔偿等方面进行研究。

短视频在新媒体时代以其即时性、生动性、视听性特点,在网络空间呈现快速发展态势,拥有广阔市场空间。与此同时,短视频发展中的版权保护和行业治理问题日渐凸显,面临侵权方式更趋复杂、法律保护依据不足、行业监管相对滞后等难题。对此,可通过完善"通知—删除"相关规定、提升短视频"法律援助"、加大侵权赔偿力度等措施,为短视频健康发展营造良好法治环境。

网络对于一个社会来讲,已经成为渗透到全社会各个层面的终极工具.网络的迅猛发展,对法律提出了挑战,特别是对与新技术紧密相关的知识产权法律制度.伴随我国网络技术的进一步成熟,网络环境下的侵权案件层出不穷,尤其是著作权侵权案件,逐渐成为理论界近年来讨论的热点之一.在新的技术条件下,我们必须正视著作权法律制度所面临的新的问题和挑战,规范虚拟世界的著作权法律关系,构建日益完善的著作权司法保护机制.     

行政许可与著作权保护的交叉博弈与法理重构

我国著作权保护遵循自动产生原则，但著作权所涉领域的特性又需要行政许可对作品内容进行合法性审查，从而导致行政许可与著作权保护的交叉博弈，给行政和司法实践造成困惑。基于行政许可的限权性质，单纯的著作权纠纷不属于行政许可的审查范围，行政许可机关在对作品进行审查时，应对所涉著作权纠纷遵循谦抑原则，著作权人也应对其行政救济权利进行谦抑性选择：在著作权司法保护中，对未经审批作品的侵权责任的认定。法院也应根据行政许可的不同情形区别采纳，而行政许可机关对于法院生效裁判的协助执行也应依其权责范围而定。     

著作权法修改草案若干规定的否定性创见——以草案46、60、69条为考察文本

2012年国家版权局公布的《著作权法》修改草案,引入了追索权制度和延伸性集体管理制度,著作权侵权赔偿标准也有了显著提高。但草案中仍存在著作权集体管理组织权力过大、录音制品法定许可过度膨胀、网络提供者在防止网络侵权上的责任要求过低等问题,本文通过对比研究、定性定量分析等方法,认为在录音制品的法定许可问题上应保留"声明不得使用"的例外,并明确"声明不得使用"的范围;取消著作权集体管理组织的"推定代表"制度及其在确定报酬、许可使用和维权上的优先权;确定网络服务提供者的审查义务,明确技术服务的范围等。这对我国的著作权保护具有非常重大的理论和现实意义。

正调查数据显示,截至2020年3月,我国网络视频用户规模达8.50亿,其中网络短视频用户规模为7.73亿,占网民总体的85.6%。~([1])我国网络短视频行业规模2019年达400多亿元,预计2020年将超过700亿元。~([2])短视频已成为中国网民最喜爱的视频内容形态之一。然而,网络短视频市场存在着内容失范、版权侵权、隐私泄露等棘手问题,挑战了伦理道德与国家法律底线,产生了恶劣的社会影响。在建设"网络强国""数字中国"大背景下,如何运用法治思维和法治方式,借助大数据智能化等信息技术力量,补齐网络短视频监管短板,形成多元共治效     

网络服务提供者著作权侵权责任认定
