治安管理处罚证明标准的构建

我国的《治安管理处罚法》未规定治安处罚的证明标准,加之行政诉讼的司法审查标准也不明确,致使公安机关在治安执法中难以正确收集证据对违法事实做出认定,乃至在行政诉讼中屡屡败诉.本文认为,我国的治安处罚应采用"优势证据"标准和"排除合理怀疑"证明标准的分层次标准.     

行政诉讼中的证明标准

本文简要介绍了证明标准及其在行政诉讼中的适用,通过对比国内外的行政诉讼证明标准,进一步了解我国行政诉讼中证明标准的意义和价值,使其能在行政案件审理中起到一定的促进和引导作用。     

行政诉讼证明责任主体负担均衡化趋势

行为责任与后果责任统一于证明责任之中,究其本质,实为后果责任。多年司法实践已然将行政诉讼"原告主张、被告举证"的分配模式固化,且形成了行政诉讼的基础、核心,显著区别于另两大类诉讼。诚然,强调被告证明责任负担的分配原则确有保护弱势原告之作用,不过其原有的理论正当性却于实践中渐失,一定程度上与提高行政效率的理念相悖,有浪费司法资源之嫌。仅就近年行政诉讼立法以及相关司法政策性文件对此所作调整来看,行政诉讼证明责任的主体负担已然呈现出均衡化趋势且愈发明朗,对于破解原有模式的困窘局面而言大有裨益。     

浅谈行政诉讼证明标准的层次性

刑事诉讼证明责任及证明标准新论

我国刑事诉讼的证明责任主要有狭义的证明责任分担说和广义的证明责任分担说两类。刑事诉讼过程中的主要活动有立案证明活动、提起诉讼证明活动以及法庭审理过程中的证明活动等 ,都存在证明主体、证明责任、证明标准及认定权问题。以案件客观真实作为我国刑诉证明标准在逻辑上出现矛盾 ,我国刑事诉讼中“证据确定、充分”和西方的“排除合理怀疑”和“内心确信”等证明标准并无质的不同     

证明标准之重构设想

证明是诉讼程序的核心问题,证明标准则是证据制度的核心,是诉讼程序中极其重要却又难以把握的问题。目前,由于我国没有统一的《证据法》,我国的证明责任制度仍呈“块状”分布,即将证明责任制度分成三大块,分别规定在三大诉讼法中。本文分别从三大诉讼法的角度,提出笔者对于重构我国证明责任标准的一些设想。     

审查起诉阶段口供采信中的问题与对策

在审查起诉阶段,检察人员常常会遇到诸如口供前后不一致,同案人口供,以及只有口供而无其他证据证明的事实等等情况。应当赋予口供多强的证明力、单独口供能否被采信,等等问题是检察人员必须面对和判断的。口供应当具有完整、独立的证据价值。我们不能因为对刑讯逼供的憎恶和恐惧,就否定口供的独立性和贬低其证明价值。我们也应当认识到单个(口供)证据的价值,特别是在证明案件事实某一方面的(充分)证明作用。     

我国刑事认证模式的改革与完善

刑事认证模式的选择直接关系到庭审方式价值目标的实现和庭审功能的发挥.本文通过对不同庭审方式下认证模式的考察和分析,指出庭审方式的类型直接决定了认证模式的选择,进而提出在我国控辩式庭审方式下,应建立当庭认证和裁判认证并行的"双轨式"认证模式,并对建立这种认证模式的具体措施提出了构想.
