This article explores negotiation linkage dynamics (how one negotiation influences or determines the process or outcome of another) by examining three bilateral trade treaty negotiations conducted by the governments of Australia, Singapore, and the U.S. from 2000 to 2004. After developing a temporal framework of negotiation linkage, the study examines how one negotiation can influence another negotiation when time is treated as an independent variable and negotiation process and outcome are treated as dependent variables. The study's findings can be used to help negotiation scholars and practitioners strategically manage the opportunities and challenges inherent in negotiation linkage dynamics. The study concludes with a proposed research agenda and a temporal enhancement of the negotiation paradigm.  相似文献

The current Arab‐Israeli peace negotiations have normalized frequent and open contacts between Israel and its neighbors. This new situation is primarily the result of Operation ‘Desert Storm’ and the Soviet Union's dissolution. Both events forced the Middle Eastern states and sub‐national organizations to re‐evaluate their perceptions of one another, as well as of the degree of support they might expect from their superpower patrons. This article begins by examining the ways in which these events have affected those countries and organizations which chose to participate in the peace process and finally focuses on the policies of the Palestinian national movement ‐ specifically the groups which are opposed to the negotiations and have vowed to undermine them. It argues that these groups seek to subvert any peace treaty which the talks may produce and that the moderate Palestinian leadership has proven incapable of controlling them. It concludes that unless this occurs, it will be impossible to implement any agreement.  相似文献

Civil society is generally seen as an important actor in peace processes. But when it comes to reaching an agreement during peace negotiations, much of the current debate is centered on the question of including or excluding civil society. Although most researchers argue that civil society participation makes the process more sustainable and democratic, most practitioners emphasize that enhanced civil society participation makes it more difficult to reach a peace agreement. I argue that practitioners and theorists must both move beyond this dichotomy and, instead, focus on the variety of ways in which civil society actors can be included in a given negotiation process. To this end, I present in this article a comprehensive overview of nine models of inclusion, from most to least direct involvement of civil society, supported by illustrative case studies. Analysis of these models suggests that it will be possible to broaden the participation of civil society in peace negotiations without decreasing the negotiations' effectiveness.  相似文献

The most prominent feature of ancient historiography appears to be the matching and welding of two essential components: narrative and speech. The rhetorical feature of envoys’ speeches should not encourage the belief that they are mere literary evidence, as their presence in the narration is normally proportional to the historian’s interest in diplomatic events. This analysis focusses on envoy speeches during the negotiations of the peace treaty of 561–562 AD between Emeror Justinian I and the Persian King Khosro I as reported by the Byzantine historian Menander the Guardsman in the fragment 6.1 of his History. Since no documents survived after the destruction of the Byzantine archives, Menander’s documents are a precious witness. The envoy’s speech was not a distinct rhetorical genre; rather, it developed from the epidictic discourse for petitions and praise during the Hellenistic and Roman eras as a means of political communication between provincial cities and the central administration. Indeed, a fiction of internationality shaped the language of Roman diplomacy until late Antiquity. The speeches delivered by Roman and Persian delegates before laying down the treaty of 561–562 display discursive strategies articulated on the sharing of communal political and moral values.  相似文献

I explore whether newspapers that represent regions experiencing "local casualties," that is, fatalities from an international violent event, give greater coverage to the incident. Research suggests that local casualties influence domestic politics, yet scholars have given little attention to either the influence of local casualties on reporting or the impact of international events on local press coverage. I examine the effect of local casualties on local media by analyzing the frequency of newspaper coverage of the October 2000 terrorist bombing of the USS Cole. Using a variety­ of techniques, including random effects logit and repeat failure hazard analysis, I find that newspapers from areas that experienced casualties from the Cole attack were more likely to report on the bombing, even when controlling for paper-specific and temporal effects. Driven by community casualties, variation in local media atten­tion to an international news story may help to explain why the effects of international events on individual attitudes and domestic political effects vary geographically, a necessary condition for institutional arguments for the democratic peace.  相似文献

Even as online learning is increasingly embraced by institutions of higher education, the past decade has seen the arrival of yet another new educational vehicle: massive online open courses (MOOCs). These courses are designed to disseminate knowledge at an unprecedented scale — even as they engender concerns about quality, learning efficacy, and the future of higher education. In this article, I discuss the MOOC phenomenon and describe a MOOC on negotiation that I developed and taught, exploring the advantages that such a course offers for negotiation and conflict resolution education in particular.  相似文献

Approaches to terrorism and peacebuilding have a complex relationship with each other, which may be explained according to four categories outlined in this article. These range from blocking each others’ aims, nullifying terrorism, supporting a very limited, or a broader peace process. Each of these categories has implications for the inclusion and reconciliation of a wide range of actors and the hybrid nature of the emerging peace. This relates to the critical approach of using theory to create emancipatory forms of peace, which is used as a basis for the examination of the production of hybridity via the interaction of approaches to terrorism and peacebuilding in five cases in this article. These include Sri Lanka, Kashmir, the Middle East, Nepal, and Northern Ireland. We argue that “post-liberal” possibilities for a hybrid form of peace (which are inherent in such conflicts) offer a “post-terrorist” potential for peace processes.  相似文献

This article examines the ways in which the negotiation framework—i.e., the legal guarantees, information management mechanism, and degree of inclusivity in peace negotiations—shapes the likelihood of concluding a peace agreement. Codifying the peace negotiations in law, publicizing information about the content of negotiations, and including mediators and civil society actors in peace talks is likely to increase a government's short‐term costs. However, doing so alleviates the adversaries' information asymmetry and commitment problems, sets guidelines to insure the process against exogenous shocks, and increases the number of actors taking part in conflict management. Comparing the recent peace negotiations to end intrastate wars in Colombia and Turkey, this article argues that a legalized, public, and inclusive framework made a peace agreement possible in Colombia, while the lack of such a framework caused Turkey's peace talks to fail.  相似文献

This article examines the role of state actors, organization agencies, and individual agents in diplomatic interactions and negotiations. States as diplomatic actors, organizations as diplomatic agencies, and individuals as diplomatic agents enter into complex and interdependent relationships. Proposing a three‐level analysis of interstate interactions and diplomatic negotiations, I argue that no diplomatic negotiation happens without interactions between parties at the state, organizational, and individual levels. The agency–structure paradigm provides a conceptual framework for understanding behavioral and structural properties of international interactions and their influence on diplomatic negotiations. Diplomatic negotiation employs specific forms of interaction, using a distinct language, protocol norms, symbols, ceremonies, and rituals. The state's “self” (as a social conception of its identity, values, and interests) affects the process of diplomatic negotiation. By managing, organizing, and improving international interactions at the actor, agency, and agent levels, negotiating parties can advance the process and effectiveness of diplomatic negotiation.  相似文献

Peacekeeping has become an increasingly prominent tool for conflict management and there has been an accompanying explosion of scholarly studies on peacekeeping. Yet, such analyses typically ignore the process of getting a peace agreement itself, missing the potential impact that a peacekeeping force might have in facilitating a peace agreement between protagonists. In this paper, we explore among both enduring rivalries and civil wars whether the presence of a peacekeeping force enhances the prospects for gaining an agreement between protagonists. The academic literature suggests opposing logics: one suggesting the desirability of peacekeeping forces while the other implies that they may be counterproductive. We consider whether the presence of peacekeeping enhances or inhibits mediation and negotiation attempts. We also explore whether the success rates for international mediation and negotiation efforts in those conflicts are affected by the presence of peacekeeping forces. Our results suggest support for the pessimistic view of peacekeeping as it discourages diplomatic efforts and decreases the likelihood of achieving a settlement, although the results are clearer for interstate conflict than for civil wars.  相似文献

Contemporary policy-making guided by the ‘liberal peace’ holds that peace is necessary for states to emerge, and that peace-building and state-building do not only go in tandem, but are mutually reinforcing. Yet, in view of both the historical record of state-making and empirical evidence provided by liberal interventionism, this proposition appears questionable. While scholars have shown that state-making has, historically, been as much associated with war than with peace, cases from Afghanistan to Somalia suggest that state-making is inherently conflictive, frequently upsetting nascent peace. In order to shed light on the reasons underpinning the relationship between prevailing peace-building practices and the fundamental exigencies of state-making, this article pursues a theoretical argument. It proposes that while peace-building is principally about creating a situation of non-violent co-existence despite prevailing differences and, thus, essentially geared at accepting and enshrining institutional and identity pluralism, state-making is vitally aimed at replacing institutional and identity multiplicity with greater degrees of rule hegemony and standardisation. Applying the prism of ‘rule standardisation’ to the nexus of peace-building and state-making, this paper seeks to advance existing debates on this delicate relationship.  相似文献

A leading theory of human development — constructive-developmental theory — posits that people make meaning in qualitatively different ways through the course of their lives and that their meaning-making capacities continue to evolve even in adulthood. This article begins with a brief introduction to constructive-developmental theory, including its roots in Jean Piaget's work on child development and Robert Kegan's more recent work on adult development. The author then explores the different ways in which students at different developmental stages might make sense of the same negotiation concepts. The article discusses some implications of these diverse understandings for negotiation teachers in terms of goal setting, evaluation, teaching methods, and transformational learning. It then concludes with a suggestion for more research on the connections between constructive–developmentalism and negotiation pedagogy.  相似文献

This article discusses the use of the La Francilienne CD-ROM, which I developed with my colleague Alain Lempereur, law professor at ESSEC Business School, near Paris. As a professor in the ESSEC Department of Environment, I use the CD-ROM as the basic tool for my course "Concertation, Decision, and Local Democracy." The CD-ROM's simulation of a public negotiation process for a highway project allows me not only to teach basic concepts and methods of negotiation and mediation but also to enhance two important concepts in public decision processes in planning and environment: conflicts and creativity. The students are given the opportunity first to experience, and then to discuss, conflict and creativity in a quasi-real setting. These experiences and discussions encourage an internal change process for the students and help them to integrate the negotiation and mediation concepts and methods taught. This internal change will be conceptualized in this article according to two educational theories: transitional thinking theory and experiential learning theory.  相似文献

Private diplomacy and secret agreements among adversaries are major features of international relations. Sometimes secret reassurance has resulted in cooperation and even peace between longtime adversaries. Yet rationalist theories consider private diplomatic communication as cheap talk. How do we explain this gap between theoretical expectations and the empirical record? I offer a theory that explains how, why, and when a leader may convince an enemy that his private reassurances are credible even when they are not costly to undertake. I also account for the conditions under which recipients of such reassurance infer the leader's benign intentions from these secret interactions. I claim that leaders engage in secret reassurance with the enemy when they face significant domestic opposition. The adversary can leverage the initiator's domestic vulnerability by revealing the secret reassurance, thereby imposing domestic punishment on the initiator. Further, by entering into private or secret negotiations and offering their adversary such leverage, initiators generate “autonomous risk” that exists beyond their control. I evaluate this theory against two empirical cases. The first case looks at Richard Nixon's secret assurances to the Chinese leadership in 1972. The second examines the secret negotiations between Israeli officials and the leadership of the Palestine Liberation Organization that ended with the signing of the Oslo I Accord in 1993.  相似文献

The last decade of the twentieth century witnessed radical and potentially constructive adaptation of NATO. Although retaining its core function of collective defence and serving as the transatlantic security forum for consultation and co‐operation, the Alliance pursued new directions in support of wider stability in Europe through enlargement to its east, forging partnerships with former adversaries, and conducting peace enforcement operations outside the treaty area. But the transformation of NATO remains a work in progress. This article discusses three key questions: the nature of peace support operations, the capability to provide for both collective defence and crisis management, and managing further Alliance enlargement while maintaining a working relationship with Russia.  相似文献

Negotiation educators recognize that collaborative problem‐solving is a critical negotiation skill. Negotiation outcomes are often better when negotiators take a collaborative approach to the process, and they are better able to do this when they are able to take the perspective of the person with whom they are negotiating. Over the years, I have developed several techniques to help my students improve their collaboration and perspective‐taking skills. One of these techniques is to use collaborative terminology (BABO = both are better off) rather than more competitive language (win‐win). In this article, I describe the strategies I employ in my negotiation class to increase students’ perspective‐taking capacities and discuss how this focus enhances their ability to negotiate collaboratively.  相似文献
