正Private rocket developers in China have taken off, embarking on a long marchChinese private rocket developer, i-Space has successfully completed a test run on a new engine it hopes will power its next test rocket later this year. The breakthrough was made on April 26, just three days before China's launch of Tianhe, the core module for its first permanent space station Tiangong.While visually less spectacular than the launch of Tianhe, the iSpace test run was important for the company as it prepares for its next attempt to send a rocket into orbit.

Does Coproduction of Public Services Support Government's Social Equity Goals? The Case of U.S. State Parks

The growing phenomenon of government-supporting charities prompts the question of whether these institutions help or hinder public values of equity in service access. Logit and tobit regression analysis using multiple data sources from the California and Florida state parks systems compares public parks with and without supporting “friends” groups. The results suggest that while parks philanthropy has produced real benefits in rallying citizen support for improved public spaces, it also introduces some distributional consequences that policy makers should not ignore. Namely, a philanthropic failure hypothesis is supported whereby wealthier Florida counties with greater income inequality are more likely to benefit from a charity supporting a nearby state park. Finding no similar result in California, the authors conclude that the association between community wealth and park charity presence may also depend on state characteristics such as the funding structure of each state park system, not just community wealth differences.

网络诈骗作为诈骗罪的特殊形式,具有专门的入罪与量刑标准。与传统诈骗相比,网络诈骗的入罪门槛低,量刑相对重,准确认定网络诈骗对于正确定罪量刑,实现刑法的罪责刑相适应原则至关重要。然而现有司法解释并未明确网络诈骗的概念,且理论界和实务界尚未形成统一认识,致使网络诈骗的司法认定成为实践中的疑难问题。正确认定网络诈骗,首先是要厘清普通诈骗与网络诈骗的区别,以解决罪与非罪的问题;然后要厘清网络诈骗与特定网络环境下盗窃、赌博及信用卡诈骗的区别,以解决此罪与彼罪的问题。

国家赔偿责任的民法基础

历史上盛行国家无不法行为能力理论,据此国家不对其公务员履行职务时的侵权行为承担责任,公务员要自己承担赔偿责任。随着法治国家观念的确立,国家开始代替其公务员向受害人承担赔偿责任,即所谓的代位责任。也有国家确立了国家的直接赔偿责任,即自己责任。但无一例外,国家的赔偿义务均建立在民法基础上,以全额赔偿为原则。我国国家赔偿制度确立了独一无二的"个人不赔,国家不全赔"的赔偿模式,偏离了赔偿法所固有的民法属性,无法良好保护受害人。而其根源则在于欠缺对国家赔偿责任的历史与本质的全面理解。有鉴于此,应尽快修订《国家赔偿法》,确立国家的全额赔偿责任,更好地服务法治国家的建设。
