This article is an examination of the issue of whether the age of electoral majority should be lowered to sixteen. We consider and reject several arguments raised by both sides of the voting age debate. The key issue, we claim, is the political maturity of young people. Drawing on empirical data collected in nationally representative surveys, we argue that the weight of such evidence suggests that young people are, to a significant degree, politically less mature than older people, and that the voting age should not be lowered to sixteen.  相似文献

As the pandemic forces public and private institutions to move online, many court and business leaders are looking to the field of online dispute resolution (ODR) for best practices and lessons learned. Developed over the last twenty years, largely in response to the growth of e‐commerce, the ODR field has generated a deep well of theory and practice while also identifying potential ethical dilemmas and risks. The application of technology, the “fourth party,” plays an increasingly integral role in how we negotiate resolutions to our disputes, with or without a third party. A brief overview of the history of ODR’s development will set the context for the exploration of the range of tools and techniques encompassed by online dispute resolution. Consideration of the ethical challenges raised by ODR practice will illuminate key questions and choices that need to be made in designing ODR systems and in governing their use.  相似文献

Wing analyzes the constitutional significance and the important long-term implications for health policy of three 1990 U.S. Supreme Court decisions: Hodgson v. Minnesota, Ohio v. Akron Center for Reproductive Health, and Cruzan v. Director, Missouri Department of Health. Hodgson and Ohio upheld state statutes requiring parental notification of a minor's impending abortion. Cruzan upheld a state court decision refusing to allow the family of a patient in a persistent vegetative state to discontinue life-sustaining treatment. Wing argues that these decisions reach far beyond "the abortion issue" or "the right to die." Not only have they narrowed the constitutional protection of individual privacy, but they allow states to regulate activities like abortion in a manner that indicates that the Court is prepared to repeal the notion that individual privacy is entitled to enhanced judicial protection.  相似文献

This study examines correlates of in-law conflict with intimate partner violence (IPV) against pregnant women in a cohort of Chinese pregnant women who visited antenatal clinics in Hong Kong. This was a territory-wide, cross-sectional study of 3,245 pregnant women recruited from seven hospitals in Hong Kong. Participants were invited to complete the Chinese Abuse Assessment Screen and a demographic questionnaire. About 9% of the pregnant women reported having been abused by their partners in the preceding year. In-law conflict was the characteristic most significantly associated with preceding-year abuse against pregnant women, after controlling for covariates. Findings underscore the need to obtain information on in-law conflict as a risk factor for IPV. In-law conflict should be included in the assessment of risk for IPV. For the prevention of IPV, family-based intervention is needed to work with victims as well as in-laws.  相似文献

This article examines the political and legal barriers to introducing restorative justice (RJ) in Hong Kong. It argues that the processes involved in RJ may be in conflict with the rule of law, which is regarded by the citizens of Hong Kong as sacrosanct in their resistance to the "mainlandization" of criminal justice practices after China resumed sovereignty of Hong Kong. It is argued that, because it could admit such potentially harmful Chinese criminal justice concepts as "rule by the people," "absence of the presumption of innocence," "leniency for self-confession and severity for resistance," and "toeing the party line," RJ would be devoid of any restorative substance and could breach the principles of due process.  相似文献

This article extends the study of regulatory enforcement on three levels. First, it separates enforcement style elements during inspections and sanction decision‐making work, creating a more realistic measurement. Second, it focuses on how these elements function in a context where it is hard in practice to achieve deterrence. Third, it assesses how agents view the effectiveness of combinations of style elements in such a context. To do so, it uses survey and interview data with street‐level environmental officials in Guangzhou, China. It finds that the agents studied practise enforcement that goes beyond deterrence and uses education and persuasion more effectively. It finds that the behavioural assumptions of these agents are to a large extent in line with the available regulatory literature, although agents are very unlikely to have consulted such studies. Therefore, the article concludes that law enforcement agents can develop nuanced and appropriate behavioural intuitions through their everyday work experiences.  相似文献
