The Songs of Nongping Elementary School

China Foundation for Peace and Development(CFPD) has launched its education projects in Laos since 2012. By far, seven schools have been constructed with the assistance of CFPD, benefiting about 2000 students, which has effectively improved local education quality and is welcomed by the Lao government and people. Among all the constructed schools, Sino-Lao Nongping Elementary School has already offered Chinese classes in different grades taught by volunteer teachers from Confucius Institute Headquarter.

狱侦耳目的证据法问题分析及制度完善——从张辉、张高平冤案视角的反思

浙江张辉、张高平冤案反映出我国刑事司法运行中很多普遍性问题。狱侦耳目制度的滥用是酿成此类冤案最重要的原因之一。从法制视角解读狱侦耳目,其身份具有合法性,证人证言具备证据能力,只因制度滥用才导致冤案发生。应当从明确管理部门、强化奖惩机制、加强多方监督制约、严格法庭审查等方面完善狱侦耳目制度。这将对加快侦查程序的法制化、规范化进程、真正还原案件事实、进一步预防和消除冤假错案、促进司法公平正义有所裨益。

Japanese Policies towards China: Changeability and Stability

The implementation of Japanese post-war policies towards China has been through a gradually shifting process, chronologically going from policies of anti-China sentiment, friendly cooperation and a combination of caution and cooperation. Under the context of these adjusting policies towards China, the national political environment and the American power of discourse have both significantly affected Japanese authorities. At the same time, common economic interest and caution concerning China’s competitiveness have always been a stable consideration.

各位代表:现在,我代表江苏省人民政府向大会报告工作,请予审议,并请各位政协委员提出意见。一、2019年工作回顾过去的一年,是新中国成立70周年,是习近平总书记作出"强富美高"新江苏建设重要指示五周年,在江苏发展史上具有重大意义。     

Public sector innovation,e-government,and anticorruption in China and India: Insights from civil servants

Both China and India are adopting information and communication technologies to facilitate openness and transparency in their governments, and hence reduce corruption. Distinctive from their traditional anticorruption approaches, is the innovative e-government approach an effective solution to corruption in these two large developing countries? This paper addresses the question through comparative in-depth interviews with 44 mid- or senior-level officials in the public sector in these two countries. The first study of its kind, our research shows that civil servants in both countries overall think positively about transparency and technology in reducing corruption. However, to what extent these innovative measures will be effective is conditional on various factors, such as political willingness, income inequality, and infrastructure readiness. What is worth noting is that the Chinese respondents were more positive regarding the role of transparency, whereas the Indian respondents were more positive about the role of technology, which may reflect the different facilitators of corruption and the constraints of anticorruption in China and India.     

成年在读子女抚养义务问题的法律研究

我国《婚姻法解释(一)》中明确表示"不能独立生活的子女"不包括绝大多数的成年在读子女,这使得法律界和社会争议不断。该规定不仅不完善,且与社会观念、我国教育制度相违背。而美国、德国和日本的法律中均通过不同方式明确规定了成年在读子女仍享有一定的被抚养权,不仅符合国情、社会观念,也能保障公民的受教育权。在立法上,我国应当出台新的《婚姻法解释》,解决在读成年子女抚养问题。首先应对成年在读子女进行分类,然后根据不同类型确定抚养人是否应延续未成年人的抚养权或是确立一种"相对扶养义务"保障其基本生活。在司法实践中,则应根据当地情况,放宽标准,多以和解、调解方式结案,保障成年在读子女各项权益。
