Over the last decade there have been significant economic reforms in China. Foreign investment is encouraged and there are increasing numbers of joint ventures with foreign partners. The stock exchanges of Shanghai and Shenzen have developed quite rapidly, and the expansion of China's economy and the growing importance of foreign investment has implications for the development of corporate governance structures in China. The internationalization of institutional portfolios ensures that there is a cross‐border interest in corporate governance, and that China's steps in developing corporate governance will be watched with interest. In this paper, we will explore the existing cultural aspects of China, the structure of share ownership in China, recent developments that have taken place in China's capital markets, including the growing foreign influence, and their implications for corporate governance developments. We compare and contrast the influences on corporate governance in the West with those in China. We conclude that any model of corporate governance which develops in China is likely to embody the special role of the state and certain idiosyncratic cultural aspects of China, whilst taking on certain of the characteristics of an Anglo‐Saxon corporate governance model.  相似文献

Pursuant to Article 18(1) of the Chinese E-Commerce Law, e-commerce business has an obligation, when providing search results for goods and services based on consumers’ hobbies, consumption habit, or any other traits, to provide them with options that do not target their identifiable personal traits. The law does not provide any elaboration on the precise scope of application of the said provision. Yet, a plain literal interpretation of this obligation may lead to a broad requirement where the business operator has to provide a truly random “non-personalised” set of search results in all circumstances whenever personalised services are provided. Such an interpretation is in all likelihood unreasonable and impractical. This article argues that the proper interpretation of Article 18(1) should be based on its regulatory purpose to protect the lawful rights and interests of consumers. It further considers the precise types of rights and interests that ought to be protected by Article 18(1), and concludes that its appropriate scope of application should be limited to targeted personalisation of search results, which infringe on the consumers’ right to obtain true information and entitlement to human dignity. Personalisation which does not violate the said right and entitlement, should not fall within the regulatory ambit of Article 18(1).  相似文献

This paper explores the recent developments for regional trade agreements (RTAs) in North East Asia since China’s accession to the WTO in 2001. After having successfully achieved high growth rates since it became a WTO member, China’s stance towards RTAs has become more positive. In particular, an RTA in North East Asia will be facilitated if China, Japan and Korea fully acknowledge the positive spillover effect from launching such an RTA. This paper further argues that all three nations have to endeavor to resolve the prolonged confrontation in their collective defense systems if they want to expedite any real progress towards a federal RTA in North East Asia.  相似文献

大陆民营企业入岛投资理论上具有较大优势,但实践进展缓慢,入岛投资的家数与金额都低于预期,理论与实践呈现出明显的反差。从法律环境的角度分析投资进展为有效方式。两岸涉及投资的法律逐步规范并处于趋同之中,具有良好的基本面。但法律环境也突显不足,最主要的原因是我国台湾地区对投资从指导思想到具体制度都有较强的行政审查色彩,遏制了民营企业的投资。未来法律环境的改善需两岸共同努力。  相似文献

数以亿计的农民工和谐融入城市是当前以及未来中国社会发展中的重大问题。为了研究文化融合、经济融合、政治融合和社会融合等诸方面的因素是如何影响农民工对城市的感知关系水平的,基于2010年在沪农民工的问卷调查数据,考察了农民工城市融合诸因素对城市感知关系(生活满意度、认同度、未来发展意愿)的影响。发现:文化融合程度越高,农民工对上海的认同程度就越高,也会更愿意留在上海发展,但其生活满意度未必越高;经济融合程度越高,城市生活满意度、城市认同度和未来留在上海发展的意愿都越高;政治融合只对未来发展意愿有影响;社会融合越高,农民工对城市的认同度越高,对生活也越满意。研究为政府引导和促进农民工和谐融入城市提供了新的视角。  相似文献

Abstract

Policy innovation and diffusion literature mainly focuses on the decision to adopt a new policy, while ignoring the differences among new policies. This study divides the decision-making process of policy innovation diffusion into two phases: in the “innovate or not” phase, governments make the decision to adopt or reject the new policy, while “how to innovate” is the process by which governments formulate specific content for the new policy. A dynamic comparative analysis finds that effects of internal determinants and diffusion mechanisms vary during these two phases and that internal determinants moderate the effects of diffusion mechanisms.  相似文献
