There are several legal and ethical problems associated with the far-reaching integration of man with Artificial Intelligence (AI) within the framework of algorithmic management. One of these problems is the question of the legal subjectivity of the parties to a contractual obligation within the framework of crowdworking, which includes the service provider, the Internet platform with AI, and the applicant's client. Crowdworking is an excellent example of a laboratory of interdependence and collaboration between humans and artificial intelligence as part of the algorithmic management process. Referring to the example of crowdworking platforms, we should ask whether, in the face of the rapid development of AI and algorithmic management, AI can be an employer equipped with electronic personhood? What characteristics does a work environment in which AI and algorithmic governance mechanisms play a dominant role? What kind of ethical implications are associated with the practical application of the concept of electronic subjectivity of AI in employment relations? This paper analyses the legal and ethical implications of electronic AI subjectivity in the work environment. The legal construction of electronic personhood is examined. The legal entity that uses AI, which manages the work process through algorithmic subordination, bears the risks resulting from such use (economic, personal, technical, and social) and full material responsibility (individual liability regime with the application of the presumption of guilt rule) in case of damage to an employee. Liability provisions can be complemented by a mandatory insurance scheme for AI users and a compensation fund that can offer support when none of the insurance policies covers the risk. A compensation fund can be paid for by the manufacturer, owner, user, or trainer of the AI and can compensate all those who suffer damage as a result of its operations. This is the direction proposed by the European Parliament, which has progressively called for robots to be given an electronic personality. The personalistic concept of work excludes the possibility of AI becoming a legal entity. Alongside legal arguments, ethical questions are of fundamental importance. The final part of the article presents the ethical implications of AI as an employer endowed with a legal entity (electronic personhood).  相似文献

This article examines the emerging legal framework of encryption. It reviews the different categories of law that make up this legal framework, namely: export control laws, substantive cybercrime laws, criminal procedure laws, human rights laws, and cybersecurity laws. These laws are analysed according to which of the three regulatory subjects or targets they specifically address: the technology of encryption, the parties to encryption, or encrypted data and communications. For each category of law, illustrative examples of international and national laws are discussed. This article argues that understanding the legal framework of encryption is essential to determining how this technology is currently regulated and how these regulations can be improved. It concludes that the legal framework is the key to discerning the present state and future direction of encryption laws and policies.  相似文献

As a border country within the European Union, Slovenia willprobably need to manage a considerable burden of refugee lawcases in the future. In addition to the goal of managing thosecases promptly, judicial review will continue to play a crucialrole in building the integrity of procedural and material lawon the protection of refugees. The article first focuses, insection 2, on several refugee law issues from national legislation,supported by case law, with special attention to a comparisonof national legislation with the corresponding EU legal sourcesin their respective fields and other international law standards.On the basis of a qualitative assessment of judgements, in section3 the author provides an evaluation of the experiences and effectsof the Administrative Court, the Supreme Court and the ConstitutionalCourt in the construction of (case) law on refugees. Findingsin section 3 lead the author to the basic thesis, in section4, that the major challenge for adjudication on refugee law,which is an example of a very complex legal discipline, establishedwithin the multi-level constitutionalism, is to improve theinstitutional quality of the judiciary. In this regard the authorselects six priorities for building on the managerial capacitiesof the judiciary that are necessary mechanisms for dealing withthe increasing number of important international refugee lawissues in the future, so that the integrity of asylum law, theharmonisation of EU law and the protective character of internationalrefugee law in Slovenia is guaranteed. In the conclusion ofthe paper, the author selects the particular legal challengesfor judges in the future process of adjudication on refugeelaw.  相似文献

Western liberal democracies tend to impose duties on publicand private bodies that are often formulated as an obligationnot to discriminate. For instance, the European Union prohibitsdirect and indirect discrimination on certain grounds in certaincontexts. Under this model, indirect discrimination involvesa measure that, although it does not directly (i.e. explicitly)discriminate on the basis of a proscribed ground, produces adisparate impact that correlates with such a proscribed ground.Indirect discrimination is generally viewed, both conceptuallyand politically, as subordinate to direct discrimination. ProfessorJohn Gardner has argued that anti-discrimination law is justifiedon the basis of duties to respect other people's autonomy. Onthe base of this analysis, he argues that indirect discriminationis a secondary concept to the paradigm wrong of direct discrimination.I contend in this article that, if one adopts Gardner's autonomy-basedanalysis of anti-discrimination law, indirect discriminationis not a secondary concept to direct discrimination. Further,I argue that autonomy does not provide a convincing justificationfor the prohibition of either direct or indirect discrimination.I tentatively suggest, however, that the widespread impact ofcertain types of discrimination (alluded to by Gardner) maysupport an equality-based justification for the prohibitionof both direct and indirect discrimination.  相似文献

This paper examines issues concerned with police corruption and its control in England and Wales. The topic of defining police corruption is addressed, some current areas of risk are described and anti-corruption strategies, particularly those pursued by the London Metropolitan Police Service (MPS), are examined. What appears qualitatively and quantitatively different in the approach of services such as the MPS and Merseyside Police is the use of an adequately resourced, dedicated anti-corruption unit. This strategy has been buttressed by preventative measures involving management/administration and ethics/training. Dedicated units have been controversial, and preventative measures raise questions concerning evaluation. Nevertheless the approach to corruption bears comparison with that adopted by other major police services in other jurisdictions and represents a break with previous and unsuccessful efforts at corruption control in major police forces in England and Wales.  相似文献

There is an argument in academic circles that the implied dutyof mutual trust and confidence will evolve to form an all-embracingsuper-principle under which each of the more ‘traditional’implied duties will rest, including the employer’s impliedduty to exercise reasonable care for the welfare and well beingof the employee. The theme of this article is that, on balance,there is no evidence for the emergence of the implied duty ofmutual trust and confidence as a super-principle. If anything,the recent trends in the case law emphasise the distinctivenessof the employer’s duties to exercise reasonable care andtrust and confidence. The article’s aim was to demonstratethat both duties are separate, free-standing duties, sittingon an equal plane in terms of importance. To rationalise one,or all of the implied duties (i.e. the duty to exercise reasonablecare and/or all of the other ‘traditional duties’),as one of the means by which the super-principle of trust andconfidence is, or may be expressed, is to a large extent, aspirational.  相似文献

This article examines the threat to privacy posed by the transferof personal information from one jurisdiction to another. Despiteinternational trends towards greater protection of personalinformation, significant challenges to personal privacy arisein this context. These include the use of outsourcing by businesses,the encroachment of security laws and the potential ‘spill-over’of technologies developed for combating terrorism into the privatesector. Also significant are technologies enabling the ‘profiling’of individuals and ‘data mining’ across borders.Against this backdrop, the article considers existing jurisdictionalresponses towards regulating personal information flows acrossborders. It considers various actual or proposed solutions including‘safe-harbours’, contractual mechanisms and extra-territorialapplications. The article concludes that many of the existingapproaches to regulating trans-border information flows areto some extent deficient and suggests the need for a new ‘fourthgeneration’ set of data protection protocols. In formulatingthe latter, analogies are drawn from other relevant areas ofthe law in order to furnish creative solutions to the problem.  相似文献
