选举权的性质解析

Suffrage is not a right “recognized” by the Constitution but “created” by people through the Constitution, which is a right of the closest relationship with the people’s sovereignty. It is both a right and a power, where the attribute of right is manifested in that it can be waived with the nature of interest and will, and the attribute of power is manifested in that it can determine the interest and destiny of candidates. However, no attribute is complete. Suffrage is an individual right rather than a collective right, with indirect relationship with the state power but direct relationship with the “holders” of state power, creating them and in turn influencing the state power.

The E-commerce Law of the People's Republic of China: E-commerce platform operators liability for third-party patent infringement

The E-Commerce Law of the People's Republic of China(E-commerce Law) was enacted on August 31, 2018. One of the hottest topics is e-commerce platform operators (EPOs) liability for third-party patent infringement. The EPOs, which provide platform services rather than participating in trade directly, must try to maintain the balance between patentees and social interests. Due to the particularities of the patent infringement review, it is difficult for the EPOs to fulfil the task. Thus, the EPOs liability for copyright and trademark infringement is likely unworkable in the patent area. A China practice review will be helpful in analysing the problem; the guiding case No. 83 is an especially meaningful reference. The E-Commerce Law is principled and advisory - it is impossible to distinguish the limits of EPOs liability for third-party patent infringement by differentiating the patent from other intellectual property rights. After reviewing the regulations on the general and intellectual property duty of care of EPOs, this article argues that the E-Commerce Law still has some specific problems. Consequently, to implement the E-Commerce Law, judicial interpretation and detailed rules for implementation should be formulated as soon as possible, and the potential solutions are described in the conclusion.

我国人口预期寿命的影响因素分析

本文选择人口平均预期寿命、婴儿死亡率作为因变量,在宏观层面上分析影响人口健康水平的因素,并对各因素的作用大小与机制进行讨论。总地来看,经济、教育、医疗、公共卫生等因素对人口健康水平起着大小不同的作用,并且表现出较强的城乡差别。在城镇地区,除了经济发展水平之外,是医疗卫生服务资源的利用水平能够更加直接和显著地影响人口健康水平,而不是供给水平。在乡村地区,提升健康水平的有效选择是：积极有效地改善乡村地区公共卫生设施,提高乡村人口安全饮水的比例;大力促进乡村地区人口的教育水平;提高人们对医疗卫生服务资源的利用水平。     

管理模式创新与高校后勤社会化改革

该文对中国高校后勤社会化改革的历程进行回顾和分析,将中国高校目前主要采用的管理模式归结为两大类,即附属模式和独立模式,并采用新公共管理三种基本理论对这两种模式进行比较分析,在此基础上对高校管理模式的创新与重构进行探讨。     

An experimental model of regulating the sharing economy in China: The case of online car hailing

Online car hailing represents a disruptive innovation model in the sharing economy and requires a new regulatory response. China's attempts to regulate this emerging industry can be considered highly experimental model. To relieve the pressure from offline competitors and to clarify the ambiguous legal status of online car hailing, China currently enforces a strict regulatory scheme through what can be described as a central-local dual system. Questions, however, have arisen regarding the legality, proportionality and effectiveness of this approach. Moreover, the current system's choice for a segmented market strategy heavily impairs the sustainable development of the sharing economy. Therefore, the adoption of Internet-based regulations for online car hailing might create better prospects to establish a fairly competitive market as well as to further boost the ever dynamic Internet sharing economy in China.
