审判管理何以可能——以“大日子”涉诉信访为例

当前审判管理工作的重点是要对审判质效和审判绩效进行科学考评,以确保司法公正、廉洁、高效。"大日子"涉诉信访现实地存在于我们的司法体制中,其所涉的许多案件都与政策和立法关联很深,并常常打破司法规律,对审判管理产生着很大的影响。无视这种影响,审判质量管理所要求的立案率、上诉率、申诉率等指标便难以达成,审判效率所要求的收结案动态平衡会很难实现,依托于审判质效管理的审判绩效管理也无法运作,反而有被刻意迎合和被架空的危险。应该淡化"大日子"的影响,择机废除涉诉信访,及时修正审判质效评估体系和审判绩效考评指标,使我们的司法能够稳定地、循序渐进地发展。     

西羌内迁述论

本文在概述两汉时期西羌内迁的基础上 ,结合有关文献记载和简牍材料 ,从中原的政治形势、西羌的人口压力、当时的气候变化和中原王朝的对羌政策等方面具体分析了西羌内迁的动因及其产生的影响。     

Research on Delinquency Risk Identification and Management of Housing Mortgage Loan: Empirical Evidence from borrower's Education Perspective

The housing mortgage market has always focused on the level of the borrower's education, but the research on the relationship between the education and the borrower's behavior is relatively insufficient. Based on the repayment data of housing provident fund loans in a key city from 2005 to 2014, and from the dimensions of overall impact, passive overdue, active overdue, age effect, etc., this paper constructs Cox proportional hazards model and conducts a systematic empirical test on the relationship between higher education and delinquency behavior. The results show that in the process of repayment of housing mortgage loans, the credit level of highly educated borrowers is relatively better, the probability of passive overdue and active overdue behaviors of highly educated groups is relatively low. And this rule is more obvious among young borrowers. Commercial banks, housing provident fund centers and other (quasi-) financial institutions can make full use of the education signal in the identification of borrower credit process, further strengthen the housing mortgage risk prevention and control, better match the supply and demand of financial services and improve the security of creditors' funds and the financial availability of trusted parties.     

吉林省外商直接投资经济效应的实证研究

外商直接投资(FDI)对经济增长的促进作用近年来越来越成为各国、各地区的关注热点。在国务院做出促进东北老工业基地进一步扩大对外开放战略部署的新形势下,通过协整关系分析和Granger因果检验对吉林省FDI的经济效应进行实证研究,发现吉林省FDI与经济增长之间具有长期稳定的均衡关系,并且存在FDI到经济增长的单向因果关系。据此提出:吉林省要持续发展,必须加快扩大外资规模、优化投资结构,合理有效、因地制宜地利用外资。     

Fighting to win: Wartime morale in the American public

The ingredients of wartime morale are the subject of lively debate, with casualties, prospect of victory, and elite cues representing the major points of view. This research covers the wars in Korea and Vietnam with expanded time series of public support and rare surveys that probed perceptions of victory during those military interventions. The prospect of victory affected wartime morale during both of those conflicts. It did so quite uniformly in the American public, cutting across elite cues such as partisanship.     

论我国普通遗嘱形式及其效力规则的立法完善

我国《继承法》对普通遗嘱的形式和效力规则作出了规定,但现有某些规定存在一些明显不足。我们应当从我国新时期调整继承关系的实际需要出发,在借鉴国外和我国港澳台地区成功立法经验的基础上,通过重新划分并拓展遗嘱形式、规定设立遗嘱的形式标准和程序、取消公证遗嘱最高效力的规定、对录音录像遗嘱的制作和使用加以严格限制、完善见证人资格制度等多方面对我国《继承法》进行全面的修订和补充。     

Constructing the homeland: Kazakhstan's discourse and policies surrounding its ethnic return-migration policy

A new political development that emerged after the disintegration of the Soviet Union was the adoption of ‘homeland stances’ by the newly independent states. Through the construction of the homeland image, the states of the region claimed responsibility not only for their own citizens, but also for a diaspora community of co-ethnics. Kazakhstan became one of these states and its leadership portrayed Kazakhstan as the homeland of the Kazakh diaspora. Furthermore, Kazakhstan's leadership developed far more active homeland rhetoric and initiated an ethnic return-migration policy as early as 1992. This paper will explore the discourse of Kazakhstan's leadership on the repatriation of its co-ethnics as well as the legal and political context that it created to achieve their smooth absorption into domestic society.     

略论“保密条款”的合法性与合理性——以“彭宇案”和解协议为例

＂：保密＂是商业行为进行知识产权保护所广泛采用的一种措施。在民事调解中,为保护当事人的隐私,＂保密条款＂也被广泛运用。当公众知情权与个人隐私权发生冲突时,保密条款运用不当可能会带来不良社会后果,被社会广泛关注的＂好心救人却要赔偿＂的彭宇案就涉及到个人隐私与公众知情权的矛盾。文中以彭宇案为例,探讨了＂保密条款＂合理运用的司法与社会效果。     

信息化条件下农业生产成本与产业结构调整关系研究

农业产业结构调整是我国农业应对国际国内市场竞争、实现健康快速发展的一项长期战略任务,但农业产业结构调整受多种因素的约束,信息化程度便是其中之一。理论及实证分析证明,信息化能有效降低农业产业结构调整中的各种成本,使农民在结构调整中获得更大的收益,进而加快农业产业结构调整的步伐。     

行政决策的功能定位与听证笔录的效力——基于商谈理论的视角

政府行政决策权的扩张,使得已有立法控制和司法救济机制对决策权的监督约束相形见绌,行政决策的合法性问题凸显。协商民主理论主张以公众交往权力制约行政决策权,从而提供了重要的约束途径。行政决策中引入听证的目的,在于发挥其重大行政决策合法性过滤器的功能;而听证笔录效力则提供了交往权力制约行政权力的通道;从立法上确立听证笔录的法律地位,建立政府对决策听证的回应机制,是推进和完善我国行政决策听证制度的一项重要的基础性工作。
