论农村社会保障法律制度构建中的政府责任——基于社会法视阈

农村社会保障法律关系错综复杂,政府、社会及农民在农村社会保障中既有相应的权力(利),也要履行一定的义务。行政法、经济法和社会法各自具有独特的法律价值和调整对象,本文分别基于这三个法域检视农村社会保障法律制度构建中的政府责任,考察农村社会保障法律制度构建中政府责任的越位和缺位,反思政府在构建农村社会保障法律制度中所发挥的主导和基础作用,提出在社会法视阈下政府应定位在承担法律制度构建、财政支撑和监督管理之责任。     

To revise or not to revise: the ‘peace constitution’, pro-revision movement,and Japan's national identity

Why do conservative nationalists in Japan continuously seek to revise the constitution despite the past failures, and what is the likelihood of successful revision and its impact on Japan's norm of pacifism and its use of force? The article offers an analytical framework for the issue based on national pride and national security, and argues that the ‘revisionists’ seek to create a new national identity, one that infuses a greater sense of national pride among the public and enables the exercise of collective self-defense, thereby removing Japan's postwar psychological and institutional limitations on nationalism and military activities. The LDP's 2012 draft is most explicit and ambitious in this regard, with the current revision attempt under Abe having the highest chance of success since the 1950s. Successful revision would significantly expand Japan's security activities, particularly within the framework of the US–Japan Security Alliance, and entail the end of Japan's unique postwar institutionalized pacifism, although the norm of pacifism will linger on as a constitutional principle. For a smoother return to the international military scene, the Japanese government must distance itself from historical revisionism and utilize its enhanced military role to promote regional public goods rather than merely protecting its narrow national interests.     

《著作权法》第三次修改的重要内容及价值考量

将于2021年6月1日正式开始实施的著作权法修改决定,对我国的著作权法律制度作了重大完善,修改的主要内容包括:一是完善相关概念和制度,包括完善作品的定义和类型,明确视听作品的权利归属,廓清广播权的内涵,修改合理使用的相关内容,增加职务表演制度等;二是强化对著作权人的保护,包括增加惩罚性赔偿制度,提高法定赔偿额,加大对严重侵权行为的行政处罚力度等;三是解决权利人维权难题,包括增加作品登记制度,增加文书提交令制度,实行举证责任倒置,完善诉前保护制度,完善著作权集体管理制度等;四是全面履行国际条约义务,包括延长摄影作品的保护期,完善残疾人合理使用的规则,增加表演者对其表演的出租权,增加录音制作者的广播和机械表演获酬权等。     

Re-conceptualizing State Responsibility: Human Security Protection, Confl icts and Governance

Different from the perspective of traditional national security, human security is an essential component of non-traditional security. Human security is influenced by multi-dimensional factors. Human security will be threatened if one or more of these dimensional factors get twisted. Such threats, once accumulated to a certain level, may trigger a confl ict. While some factors may have a low correlation with confl ict, some other factors may have a multiplying effect in triggering the confl ict. Further, confl ict may be triggered by a single factor or multiple factors. Poor governance may lead to escalation of confl icts. Deep understanding of triggering effects and their correlation with confl icts is essential to addressing the root causes and the management of conflicts effectively. Concepts of human security, state responsibility of protection and neo-interventionism have been developed in succession. Though the people-centered security framework draws global attention, it should be recognized that there is no international consensus on an optimal type of governance. However, according to the Charter of the United Nations, the primary responsibilities of human security protection should be rested on the government of a state. The principle of sovereignty remains the fundamental principle of international relations, which should be the guiding principle for addressing human security issues.     

核安全峰会与核安全全球治理

美国奥巴马政府上台以来,为应对核恐怖主义对美国国家安全造成的严峻威胁,提升国际社会应对核安全威胁的能力,重塑美国在核领域的领导地位,积极推动由各国首脑参加的核安全峰会。经过四届核安全峰会,国际社会在促进凝聚核安全共识、设定合作重点并推动核安全全球治理的建章立制等方面取得了诸多成果,但也面临着在后峰会时代保持国际合作势头、明确和完善核安全全球治理范畴以及进一步完善均衡的核安全全球治理机制等挑战。为确保核安全全球治理在后峰会时代的可持续发展,国际社会应在治理范畴方面分清主次,在治理模式方面坚持全球合作治理与国家治理相结合,发挥国际原子能机构的核心作用。拥有大量核材料与先进核安全技术的大国在全球治理中负有特殊责任,理应发挥表率作用。     

清末北京城市治理和治安立法样式的法理分析

清末北京城市治理和治安立法是依法治市，实现城市治理法治化的新尝试，可谓中国城市治理和治安法制模式的现代化启动。从法律文本分析入手，对清末北京城市治理法规的结构、渊源及其社会基础等相关问题在制度层面进行探讨，可以反映北京城市治理和社会治安法律制度的实际变迁。可以说，该时期的有关立法尝试是具有现代意义的城市法制建设活动，在推动北京城市治理初步迈向法制现代化的同时，也深刻影响了民国时期及其后来城市立法样式及法制现代化进程。     

“拒绝衰落”与美国“要塞化”：特朗普的大战略

美国是大战略理论与实践的重镇。冷战结束后，“自由霸权主义”构成了美国大战略的基本内涵。在相对权势有所衰落的背景下，特朗普政府于2017年12月提出的新版《美国国家安全战略》体现出美国大战略转型的端倪。该战略是对“自由霸权主义”的颠覆：除在战略目标(追求或巩固世界霸权地位)大体一致外，该战略极力强调美国安全环境的恶化和外部挑战的大幅增强，在战略路径上主张单方面强化美国的经济与军事实力，放弃多边主义，撤回对国际机制的支持，以期在未来的大国竞争中取胜。特朗普的战略存在内在的缺陷，效果亦存在颇多不确定性，与国际政治经济发展趋势明显相悖，对中国国家安全环境产生了较为直接的影响。     

“The pluses of pulses”: haricot beans and women’s empowerment in Ethiopia

This practical note demonstrates the role that haricot beans play in assisting women to become food and nutrition secure, to generate income, and to have sustainable livelihoods that are resilient to shocks. Based on qualitative research among female and male beneficiaries of a pulse innovation project implemented in southern Ethiopia, the note provides a summary of the critical voices of farmers, and the role that haricot beans play in empowering women. It also outlines some of the challenges that the project faced in achieving its empowerment objectives.     

中国非传统安全研究40年(1978-2017)：脉络、意义与图景

中国的非传统安全研究已成一门“显学”，且对相关研究、安全现实与安全政策产生了极大影响。中国40年(1978-2017年)的非传统安全研究整体上历经了酝酿与显现、阐释与呼吁、反思与深化、建构与拓展的过程；研究内容丰富且不断出新，逐步形成了较为稳定的研究类型；与国家决策的关系呈现“被忽视——边缘性——中心圈”的发展轨迹；研究驱动包括学理驱动、技术驱动、事件驱动、政策驱动和环境驱动；形成了涵盖组织机构、学生培养、知识传播、政策咨询和学术网络的制度化研究态势。在学术上具备了学派与学科的自觉，推动了安全思想的“范式转型”与“安全文明”的重塑，在政策上牵引着安全治理实践更加综合化与国际化。然而，中国非传统安全研究的理论体系还未形成，专业性、科学性、国际性不足，未来非传统安全研究需要在全球安全的研究格局、元问题与分析框架、理论体系与学派自觉、方法论与量化研究、议题深究与国际对话上有新的持续推进。
