社会契约理论的历史回溯、思想评价及宪政意蕴

在世界政治法律思想史中,社会契约理论源远流长。自伊壁鸠鲁开始,从格劳修斯到霍布斯,从洛克到卢梭,再到康德,他们以自然状态、自然权利、自然法为逻辑起点,演绎出天赋人权、人民主权、分权制衡、宪法至上等理论。这些理论提倡主权在民,在公法领域还探寻了宪政问题,进而为西方资本主义国家创立宪政制度奠定了思想理论基础。对这些理论的深度发掘及有鉴别地吸收运用必将有助于促进我国的宪政建设。

Negotiating the Marcellus: The Role of Information in Building Trust in Extractive Deals

New technology has expanded the opportunities for energy companies within the United States, often bringing them into populated communities and requiring them to negotiate deals with landowners. This case study focuses on how one group of landowners in northeastern Pennsylvania creatively reimagined the process of negotiating in a natural gas deal. They used collective bargaining for leverage, and the Internet and social media to level the informational playing field. These techniques allowed them to develop trust within the group and ultimately with one company, as they sought to protect their environment and enhance their financial gain.

雷经天的司法思想是新民主主义司法思想的典型体现。苏维埃司法的政法传统、边区司法正规化改革思想及马克思主义理论的中国化潮流是其思想的主要来源。围绕新民主主义司法观，雷经天提出了在司法组织上贯彻民主集中制，在法官队伍建设中加强工农干部与知识分子干部的融合，在六法全书援用中将政治立场与司法实践适度分离，在司法程序中坚持司法民主、发展司法便利等系列观点。其思想贯穿着革命性和实践性思维的特点，是时代背景与个人经验综合作用的产物。     

从历史中来,到现实中去：党的群众工作的主要经验

面临新的时代背景,党在历史上做群众工作的经验是不是都过时了？为了回答这个问题,本文分析了群众工作的基本理论并归纳出十条经验。它们是：与最广大人民群众联系并抓住关键性群体;给人民群众看得见的物质福利与荣誉;从思想上教育群众、引领群众;通过各种形式把群众组织起来;在群众中发现并培养＂群众领袖＂;整顿党的基层组织,巩固基层民众对党的信任;反对官僚主义,干部与群众打成一片;建立民主政治,把群众的意见聚合起来;发现并总结群众工作的规律与得失。     

19世纪前欧洲国际私法学说重述

19世纪以前欧洲的国际私法学说对国际私法的实践和理论发展有着不可或缺的重要作用,但是目前国内对这些学说的解读,由于各种原因,并没有展现学说的原貌。鉴于此,同时抛弃非理性偏爱,本文对传统的各个学说进行了尽可能的再现,希望能对学说的学习和研究有所帮助。     

“出草”：一个猎头习俗的文学社会学旅程

“出草”猎人头，是一种消逝了的先民习俗，并非台湾原住民独有，但对“出草”的书写，却是台湾近代以来活生生的文化载体。“出草”在战后台湾文学中被呈现的面容，或诉说了几百年间原住民族的生存、抗争历史；或寄托着知识者缘少数族群问题进行的社会批判与反省，甚而，对萎弱的现代人格之出路的想象；或在当代意识形态与文化消费的背景下，成为某些主流论述——譬如多元文化主义——的注脚。本文追寻“出草”的文学旅程，一以探求战后知识者响应其时代、探寻思想出路的多重样貌；一以理解台湾的文化生态与现实政治。     

The shadow block: Female bonding in quilters

In these brief notes, the author's aim is to situate Born in Flames historically, including within the history of feminist theory. His starting point for thinking through this film was the presumption that what it means now differs from what it meant in its own time. While that would be true of almost any text, it has seemed to the author that Born in Flames, as an incendiary text, is extraordinarily provocative in the very ways that make it now seem “dated.” It remains inspiring, however, because it offers a vision of intersectional political coalition more radical than any feature film that we are likely to see now, despite the influence of decades of feminist, queer, and critical race studies. Revisiting the discourses the film generated at the time of its release, the author has come to recognize that, though times and the trends in theory have changed since 1983, the stakes of the revolution in the film have not. It presents a desire to make the world otherwise, economically and culturally.     

Wage labour and capitalism: a comparative and historical analysis of Eritrea and Kenya

Abstract

This paper seeks to explain the development of capitalism in Eritrea and Kenya from a labour history perspective. Indeed, the assumption in this research is that capitalism can only be explained by taking into consideration free wage labour as one of the sine qua non conditions for the existence of the capitalist mode of production. Therefore, the article looks at the paradigmatic socio-economic shifts: from unfree to free labour, from free to precarious labour and from unfree to precarious labour. These are the result of the complicated relationship that exists between capital and labour. The point of departure of the analysis is the Nieboer-Domar hypothesis on the structural origins of slavery, which despite severe criticism, it has been largely remained unchallenged until the present. In Eritrea, colonised by Italy, and Kenya, colonised by England, free wage labour fully developed between the nineteenth and twentieth century. This could be considered the era of the advent of capitalism, with the advent, for a fraction of the working population, of labour relations based on wages. The precarisation of life of free wage workers is also partially analysed in this article.
