Rechtsfolgen fehlerhafter Willensbildungsakte der Eigentümergemeinschaft nach dem WEG 2002

Der Wortlaut des § 24 Abs 6 Satz 1 WEG 2002 l?sst die unterschiedlichen Rechtsfolgen fehlerhafter Willensbildungsvorg?nge der Eigentümergemeinschaft nicht erkennen. Der folgende Beitrag versucht, fehlerhafte Willensbildungsvorg?nge im Einklang mit dem allgemeinen Verbandsrecht zu kategorisieren.     

Allele frequency distribution based on 17 STR markers in three major Dravidian linguistic populations of Andhra Pradesh, India

Allele frequencies for 15 tetranucleotides and 2 pentanucleotides repeat loci were determined in 317 unrelated, healthy individuals of Andhra Pradesh, India, belonging to three pre-dominant endogamous populations namely, Kappu Naidu, Kamma Chaudhary and Kapu Reddy. Adherence to the expectations of the Hardy-Weinberg equilibrium (HWE) was confirmed for all loci with few exceptions, which were not significant after applying Bonferroni's correction. Statistical parameters of forensic interest; observed heterozygosity, probability of homozygosity, probability of extact test, power of discrimination, match probability, polymorphism information content, power of exclusion and mean paternity index were determined for all loci. The present study reveals that Penta E and D2S1338 are the most informative loci in all the studied populations. The combined power of discrimination was greater than 0.976, whereas the cumulative power of exclusion gave an expected value of 0.9999 for all the tested microsatellite loci. No difference was observed in the discriminatory power of 15 loci in studied populations on comparison with other populations of India. Population differentiation tests revealed significant differences between the studied and neighboring populations at several loci. Analyzed parameters indicate the utility and efficacy of the studied 17 STR systems as a powerful tool in forensic human identification, paternity testing and human population genetic studies.

Daher kommt es, soweit der Ersatzanspruch nicht ohnedies durch Legalzession auf den Dritten übergeht, zur Drittschadensliquidation durch den unmittelbar Gesch?digten. Der Beitrag untersucht dies für verschiedene Fallgruppen und hebt die Bedeutung der Schadensverlagerung für die Bemessung des Umfangs des Schadenersatzanspruchs sowie zur Abgrenzung von Drittschadensliquidation und Vertrag mit Schutzwirkung zugunsten Dritter hervor.     

中国成都汉族及泰国群体D7S2846基因座的遗传多态性

研究STR基因座D7S2 846的遗传多态性 ,为法科学应用提供基础数据。应用PCR及PAG电泳技术 ,对376名中国成都汉族无关个体及 131名泰国无关个体进行了调查。两群体分别检出 8个和 7个等位基因 ,首次获得该基因座基因在两群体中的频率分布。两群体基因型频率分布均符合Hardy Weinberg平衡。家系调查证实了等位基因的传递遵循孟德尔遗传规律。该基因座在两群体中的个人识别能力 (Dp)分别为 0 85 70、 0 86 0 2 ,杂合度 (H )分别为0 6 915、 0 6 870 ,多态性信息含量 (PIC)分别为 0 6 445、 0 6 5 5 3 ,非父排除率 (PE )分别为 0 415 2、 0 40 85。D7S2 846基因座在法医学个人识别及亲子鉴定中具有较高的实用价值。     

Governance through government networks: The G8 and international organizations

As an informal grouping without headquarters, permanent staff or legal powers, the world’s major industrialized countries must rely on other actors, in particular international organizations, to manage global problems. This article examines how the Group of Eight contributes to global governance by cooperating with international organizations in the cases of debt relief and the fight against terrorist finance. It shows that the G8 draws on international institutions with the aid of government networks and argues that this cooperation is stronger, the greater the Group’s concentration of relevant power and the more important it considers the institutions’ resources.     

The politics of response to terror: the reshaping of community and immunity in the aftermath of 7 July 2005 London bombings

This article explores the politics of response to the 7 July 2005 London bombings, by analysing UK counter-terrorism institutional campaigns in the three years following the attack. By drawing on the interpretive category of community/immunity, the semiotic analysis of counter-terrorism campaigns aims to describe their representation of the political community and citizen in the immediate aftermath of the terrorist attacks. The article argues that the counter-terrorism discourse relies on two contrasting tendencies: on the one hand, the unifying force that brings people together in the name of common values; and on the other, the necessity to weaken communitarian bonds in order to allow the citizen to control and check-up on others, reporting “anything suspicious” to authorities. In these texts, the figure of the citizen surveillant clearly emerges. Surveillance activities are shaped around the representation of the terrorist event, from the image of the terrorist in normal everyday life to the actual attacks. Paradoxically this brings about a mimicry effect. The surveillance action carried out by the citizen and the imagined actions of the preparation of a terrorist attack partially overlap in the way they are described and visually represented.
