票据救济对抗事由评析

票据救济对抗是指在票据救济过程中因某种事由的出现而导致救济无效的法律后果。票据救济是票据丧失后的补救措施,其结果是真实票据权利人不持有票据行使票据权利。在挂失止付期间有人请求付款、在公示催告期间有人主张权利、在普通诉讼付款后持票人请求付款,都会引起票据权利争议,以确认票据的归属,但是票据被善意取得和无过失付款的结果却使票据救济归于无效。     

On Music,Censorship, and Globalization

Malik Bendjelloul’s music documentary, Searching for Sugar Man (2012), uses the narrative of its central figure, American rock “n” roll musician Sixto Rodriguez, to allegorize South Africa’s emergence from censorship and isolationism to a post-apartheid and increasingly transnational dispensation. I look at the cultural politics of apartheid-era censorship in attempt to account for Rodriguez’s cult appeal in South Africa, despite his artistic shortcomings and his obscurity in the USA. I then focus on the film’s final concert sequence, featuring Rodriguez’s first South African performance, which Bendjelloul subtly positions as a moment of celebration over the new possibilities enabled by the demise of apartheid and the rise of an increasingly integrated global culture.     

Differing patterns of marriage between a city and villages in 18th century Korea: The case of Taegu Area

While the urban area was increasingly filled with middle- and low-status residents, the rural area was dominated by high-status settlers whose number increased because of migration from the city and natural growth. Remarkable differences existed between urban and rural marriage features such as marriage age and rate of remarriage. The more sincere adoption of the high-status marriage culture in the rural area may be attributed to its occupational homogeneity. In the rural agrarian settings, landlords, self-cultivators and tenants shared a similar living pattern and value system based on the agricultural cycle. The urban area, however, exhibited a variety of work patterns of local functionaries, artisans and merchants. Many middle- and low-status people might well have found the high-status culture of the rural area incompatible with their own.

Local Renewable Energy Initiatives in Germany and Japan in a Changing National Policy Environment

Our article explores the contribution of local initiatives to the creation of path dependencies for energy transition in Germany and Japan in the face of resistance from entrenched incumbents at the national level. We use a process‐tracing methodology based partly on interviews with local participants. In particular, we explore the role of local initiatives in securing “socio‐political space” for the expansion of renewable energy (RE) and in embedding themselves in “ecosystems” of public and private institutions. German energy activists were more successful than their Japanese counterparts in expanding this space and creating positive feedback in part because they were able to build horizontal networks that anchored the energy transition firmly in local communities. Although problems with grid technology have led to retrenchment in both cases, Japanese activists' reliance on vertical networks has limited their ability to weather a backlash from national government and utility actors. Our study demonstrates the interaction of political, economic/technological, and legitimation paths to energy transition and highlights the importance of the latter two.     

Borders Inscribed on the Body: Geopolitics and the Everyday in the Work of Martín Kohan

This article analyses the critique of militaristic geopolitical worldviews in two novels by Martín Kohan (Dos veces junio, 2002 and Ciencias morales, 2007). Drawing on ‘everyday nationalism’ and the insights of feminist geopolitics, it explores these novels' use of space and gendered violence to present Argentina's 1976–1983 dictatorship and the Falklands/Malvinas war as unexceptional manifestations of the relationship between the state and its citizens. This reading foregrounds Kohan's emphasis on the origins and consequences of national identity discourses, framed as powerful narratives capable of generating a vision of the nation-state that privileges the security of borders over bodies.

Exploiting the common pool or looking to the future? A study of free-riding leading up to the 2007 municipal amalgamations in Denmark

ABSTRACT

Municipal amalgamations can create incentives for opportunistic behaviour. Several fairly recent studies have examined this on amalgamations in Denmark and Sweden using the so-called law of 1 over n. However, they have yielded inconclusive results and I argue that one plausible explanation is a theoretical deficiency in the law, as it does not account for how future political representation can mitigate the incentive to free-ride. I examine this using large-scale amalgamations in Denmark in 2007. This case is quite unique as the amalgamations were implemented in such a manner that they constitute a quasi-experiment, and because an extra fiscal year was added to the election period where the composition of the new councils was known with certainty, while the municipalities retained some decision-making power. The study’s findings are consistent with the argument that the incentive to free-ride depends on the decision makers’ future political stake in the new, amalgamated municipality.

The following piece of paper is a critical approach to the amendment of the Article 135 of the Spanish Constitution, by means of which the principle of balanced budget and the restricting of the public expenditure are constitutionalized. This work consists of four different paragraphs: the first one, in which a chronological approach to the debt crisis in the Eurozone and the reform of the Article 135 of the Constitution are carried out; the second one, where the new features that the current Article 135 contain are presented; the third one, in which the critical analysis of the 2011 constitutional reform is now developed (around tour fundamental axes: content, procedure, time and purpose and significance); and the fourth one resulting with a number of final considerations.
