E‐government and public service quality in Ghana

This article contributes to the growing discourse on the potential of e‐government to transform the operations of public sector institutions, thereby improving public services. It does so by conceptualizing public service quality into efficiency, economy (cost reduction), customer satisfaction, and service accessibility and draws on qualitative data from the Ghanaian narrative for illustration. As previous studies have demonstrated, this study also affirms the potential of e‐government in improving public services delivery by increasing efficiency, reducing the cost of operations, expanding access to services, and achieving customer satisfaction. Yet, there remains a repertoire of challenges such as weak ICT infrastructure especially in towns and villages, incessant power outages and illiteracy, which are drawbacks to fully harnessing the benefits of e‐government in Ghana. The study recommends that these challenges should feature prominently in e‐government policies to increase the chances of solving them.     

“协助抓捕型”立功的司法认定——以接电话“稳住”同案犯行为为例

"协助抓捕型"立功是我国立功制度中的一种基本形式。构成立功不需要对行为人进行主观方面的认定。对于"协助抓捕型"立功中的其他协助抓捕行为,需要遵照体系解释的原则,将其他协助抓捕行为与法律明文规定的协助方式进行同类解释。抓捕的结果需要与行为人的协助行为具有刑法上的因果关系。接电话"稳住"同案犯的行为并未达到"协助抓捕型"立功所要求达到的程度与确定性,与抓捕的结果不具有刑法上的因果关系,不构成"协助抓捕型"立功。     

Integration of the Family Therapy Specialist into Public School Pupil Personnel Services

SUMMARY

The integration of a full-time family counseling specialist into the Pupil Personnel Service (PPS) Team of the modern public school is described. The roles of the present specialists are delineated as well as the problems inherent within the present Pupil Personnel Services Team. Inclusion of a family counseling specialist on the PPS Team would help schools avoid the antagonist position they find themselves in when a family opposes their suggestions and interventions. In such cases, the PPS Team attempts to wrest control of the case from the parents which subjugates the family, limiting the family's inherent resilience and strength. The family comes to resent the PPS Team, seeing them as blameful and controlling. Conversely, the PPS Team comes to resent the family, claiming it is “dysfunctional” in some way and using diagnostic labels to satisfy themselves that their “expert” actions are justified. This antagonist position in the schools arises more out of fear of litigation than good case management. We propose a new integration of family system and school system. Creation of a family counseling specialist who is highly trained in systems, narrative and structural/strategic family therapy could ameliorate this antagonist problem. Numerous functions for such a new specialty are listed as well as suggestions for including this member into PPS Team work.     

新加坡政府网络信息传播平台建设的策略与启示

新加坡政府在信息化方面的战略规划由来已久,目前正在实施的智慧国2015计划更是政府重视信息化平台建设的体现。新加坡政府网络信息平台建设的成就得益于以公众需求为中心的理念,全面、开放、双向的公共服务平台,多个部门、一个政府的资源整合策略和优化政府信息化传播生态的管理机制。新加坡的经验给我们许多启示:提高政府信息传播平台的开放性和服务意识;建立双向沟通机制,提供公众参与的渠道;整合政府和社会资源,提高部门协调能力;建立强有力的组织领导和管理体系。     

论工会在全面深化改革中的角色选择

我国正处在经济社会转型期,全面深化改革的力度不断加大,城镇化、工业化、信息化的深入推进,职工队伍构成、职工的从业形态日趋多样,职工利益诉求更加多元,职工特别是青年职工诉求个性化趋势越来越明显,迫切需要工会组织进一步明确自身的角色定位,找准围绕中心、服务大局、展示作为的着力点,努力做好维权和服务工作。     

网络服务提供者“知道”认定新诠——兼驳网络服务提供者“应知”论

我国目前立法规定和司法实践全面承认了"应知"可用于认定网络服务提供者主观知道,但学界在这一问题上却分歧很大。这一现象的产生源于对网络服务提供者提出的应知要求与其不负审查义务的共识相冲突。主张网络服务提供者应知既难以在理论上得以证成,也是对相关规定的误读。通过借助诉讼法中的推定规则,可有效证成网络服务提供者主观知道,从而实现了从起点客观事实不明到终点网络服务提供者承担侵权责任间逻辑脉络的贯通。依循这一逻辑路径,我国目前的相关立法、司法和未来学界的研究重点等都需作出相应的调整。     

Knowing the past to understand the present - issues in the contracting for cloud based services

This article builds on our previous introductory article to cloud computing ([2009] 25 CLSR 270-274) and seeks to explain how cloud computing has evolved. We then discuss how this evolution impacts on key contractual and legal considerations and how the treatment of these considerations might differ from their treatment in traditional IT supply agreements.

顾客理念的理性吸纳促进服务型政府建构的文献综述

服务型政府是一种新型的政府管理模式，西方新公共管理运动所提出的先进理论为服务型政府的构建提供不少借鉴。其中被新公共管理运动视为改革指南的顾客理念就被众多学者力捧于指导服务型政府的构建，在指导服务型政府构建起积极作用的同时也存在众多不足，且其对服务型政府构建带来的消极影响没有引起足够重视。所以，通过研读关亍顾客理念的相关文献，总结归纳出顾客理念的积极作用和消积影响因素，并做出相应文献综述和评价，对促进服务型政府构建需理性吸纳顾客理念的研究具有一定价值意义。
