司法调解化解行政争议——一种构建行政关系和谐之新路径

司法调解的性质以及司法调解是否可以运用于对行政争议的化解一直以来都是行政法学界争论的焦点之一。将司法调解的性质定位在一种不同于司法审判的独立调解权的地位上应该是合乎实际的二者并行不悖。行政争议是完全可以通过司法调解的途径寻求解决的,从而有利于构建和谐的行政关系。     

中国传统道德的现代转换

我国新生的市场经济道德必须得到传统文化的支撑才能真正成为现实社会秩序的调节者和维护者。传统道德中的许多范畴能够为现代市场经济道德体系的建立提供宝贵的思想资料。义利观上,可以将传统的见利思义、以义制利转换成追求个人正当利益的现代市场经济道德。诚信观上,将传统的忠信、信义转换成现代公民诚信道德。     

普京之治:俄罗斯的复兴之路

普京执政第 1任期已满 ,4年来 ,俄罗斯彻底告别了“叶利钦之乱” ,迎来了“普京之治” ,俄罗斯的转型也进入到了一个理性的政治发展周期 ;在这 4年中 ,普京逐步形成了一种“适应”俄罗斯文化性格特征的执政理念 ,确立了强力政治与自由经济相结合的治国方略 ,在政治、经济、外交等各个方面都取得了令俄国人满意的成就 ,使俄罗斯看到了振兴大国地位的希望。但是 ,俄罗斯的民主政治和市场经济仍然是不成熟的 ,要真正重振俄罗斯大国地位的目标 ,普京还面临着诸多挑战 ,俄罗斯的复兴还有待观察     

刑事错案成因、预防及纠正对策

刑事错案并不完全等同于平时所说的冤假错案,其主要包括因客观原因而产生的错案,以及因为主观上存在司法过错而产生的错案。对于前一种情况无法完全避免,但可以通过专业水平的提高及侦查技术等的进步来减少;对后一种情况则可以从多种层面予以遏制,进而完全避免出现人为因素导致的刑事错案,树立司法权威。检察机关作为国家的法律监督机关,在刑事诉讼中应当及时、准确地查明犯罪事实,追究犯罪,保障无罪的人不受刑事追究,通过多种途径克减刑事错案的发生。

从“模块教学”到“口径教学”——谈高职类艺术设计教育的战略调整

高职艺术设计教育实施“模块教育”与“口径教学” ,实质上是以教学理念的创新为基础来推动教学手段的改革 ,也就是突出艺术设计教育的时效性 ,并获得其在空间上的可持续发展。实施这一战略调整的现实背景是市场对人才要求的多样化、综合化 ,所要达到的目的是使艺术人才的最终价值体现在产品艺术价值、商品价值的创造上。     

The concept of democracy: moments,meanings and images in the “long term” (a proposed rethinking of conceptual history in the Ibero-American world)

ABSTRACT

In recent years there has been a notable increase in the practice of conceptual history in the Ibero-American world. There has been a particular focus on the use of fundamental concepts previous and subsequent to the Independences (1750–1850). This work is a proposal to broaden the temporal framework of analysis, until the Second World War at least. It also suggests the introduction of three central aspects: incorporation of images as a complement to texts in the analysis of concepts; identification of the historical moments at which there occurs a change in the dominant semantic of each concept; and consideration of the Ibero-American sphere, not in isolation but in interaction with the global world. To illustrate this new approach, we provide a case study related to a paradigmatic key concept of modernity: Democracy.     

Conceptualizing Interstate Conflict: How Do Concept-Building Strategies Relate to Selection Effects?

An essential, but often overlooked, role of concepts lies in how they constitute or define populations. Explicit choices made by researchers about concept structure are tied inextricably to the selection rule for identifying cases to include in analyses. Concept construction issues are absolutely crucial because the concept structure used interacts in various, usually hidden, ways with theories and hypotheses that researchers want to test. The concepts used to select cases may be correlated with common dependent variables hence producing selection bias. We illustrate this potential by exploring international crises as they have been conceptualized by the ICB Project. We show that two alternative conceptualizations of “crisis” produce populations that correlate with common ICB dependent variables. Our empirical analyses pay particular attention to variables related to power because they are particularly susceptible to being influenced by these selection effects.     

Is the general data protection regulation the solution?

Never has a text been received with so many requests for amendments; never has the debate around it been so huge. Some see it as a simple duplicate of the Directive 95/46; others present the GDPR, as a monster. In the context of this birthday, it cannot be a question of analyzing this text or of launching new ideas, but simply of raising two questions. I state the first as follows: "In the end, what are the major features that cross and justify this regulation? In addition, the second: "Is the regulation adequate for today's digital challenges to our societies and freedoms? The answers given in the following lines express the opinion of their author. It is just an invitation for a dialogue to go forth in this journal where so many excellent reflections have been published on Digital Law, thanks to our common friend: Steve.     

社会史视野下的陕甘宁边区劳动英雄运动

对劳动英雄的推崇在我国有着悠久的历史传承和重要的现实意义。抗战时期,陕甘宁边区政府在生产中奖励劳动英雄,推动了向劳动英雄学习的生产竞赛运动,对边区生产建设的发展和新的劳动观念的塑造也起到了很大的作用,劳动光荣的道德观念逐渐形成。在此过程中,越来越多的劳动英雄从组织起来的群众中涌现出来,集体英雄主义的价值观在群众中传播。劳动英雄群体在群众中所发挥的带头、骨干、桥梁作用的凸显,对推动工作、培养干部、联系群众起到了独特的效果,这实际上是生产组织形式和工作方法的一种创新。
