全球环境治理的有效性

全球环境治理经过三十多年的发展,已经形成了一个体制。然而,这个体制是有效的吗?为了回答这个问题,本文首先界定了全球环境治理有效性的概念和前提,然后分析了全球环境治理体制的功能与要素,随后根据确立的分析框架,评估了现有全球环境治理体制的有效性,并且认为该体制的有效性得分是中等偏低的。这也表明了该体制进行改革的必要性。论文最后提出了相关的政策建议。

我国改革开放以来经济高速发展 ,几乎可以与战后取得经济奇迹的日本相媲美 ,但我国实现工业化的目标 ,却需日本所花时间的两倍以上 ,这里的关键问题是发展的效率低 ,而要提高经济发展效率 ,就需要加大经济结构的调整 ,加大科技教育的投入     

预约合同初论

预约合同的本质是契约。预约合同最早存在于买卖、使用借贷、消费借贷等个别契约之中 ,后被有些国家扩及于所有契约。不同国家对预约合同的立法模式不同。预约合同的成立与效力原则上适用一般合同的规定 ;违反预约合同侵害了一方当事人的信赖利益 ,应承担违约责任。我国立法上应补充预约合同的规定 ,完善合同法。     

劳动争议诉讼三题

受我国传统诉讼文化的影响,我国劳动争议适用法律及法律程序设计等方面,都没有能够充分体现出程序正义和程序效益,法律对弱者所给予的救助和支持存在不同程度的弱化。建立社会主义市场经济体制和加入WTO,呼唤尽快完善我国的劳动法制,劳动争议诉讼制度必须从诉讼时效、诉讼证据和诉讼程序方面进行探讨和改革,以更好地维护劳动者的合法权益。     

Three Management Modes of Community Correction and the Effect of Social Work Intervention: from an Evidence-based Correction View

After the birth of community correction, the management mode did not become a problem for quite a long period of history until the anti-correction movement seriously questioned the rehabilitation movement led by social workers. In the evidence-based correction movement, the management mode became a controversial issue, and numerous research evidences showed that the correction effect of integrated management mode was better than that of supervision mode and rehabilitation mode. Based on questionnaire survey and interviews, this article holds that the Beijing mode of community correction basically belongs to the supervision type, the Shenzhen mode is a hybrid type, and the Shanghai mode is also hybrid but with a bias to rehabilitation. The analysis and test of survey data shows that the Shenzhen mode and Shanghai modes are superior to the Beijing mode, and the increase of the proportion of social workers among frontline staff would reduce the recidivism to some extent. It is suggested that more social worker proportions are required in the community correction management system to enhance the hybrid management. The call for comprehensive staff and community correction police should be carefully considered.     

违反强制性规定的合同效力之探讨——从比较法的视角切入

根据我国合同法第52条的规定,违反法律、行政法规强制性规定的合同无效.在这样的制度框架下,现实生活中的很多案例依此规定却往往会出现违反诚实信用原则、损害当事人之间公平的情况.因此违反强制性规定的合同在私法上的效力就成为一个值得探讨的话题.     

内容违法的民事行为的效力研究——以契约为例

一般来说,内容违法的民事行为无效,但某些情况下其私法效法应当受到保护.内容违法的民事行为的理论按照研究进程可以分为强制性规定与任意性规定、原则与例外、取缔规定与效力规定、取缔规定四个阶段.     

A physical therapy environment design concept for children with cerebral palsy in accordance with patient behavior and therapy effectiveness

This research aims to study the effects of interior environmental features on the effectiveness of physical therapy among children with cerebral palsy. The research assumes that interior environment primarily determines the central attention of the patients, which further institutes the level of cooperation and thus the effectiveness of therapy. Distinctive interior settings in three state hospitals are utilized to test the effects of different environmental settings on child patients＇ level of attention. A ＇~structured observation＂ together with an ＂achievement rating＂, measured by the patients＇ cooperative level, are utilized to gauge the success of therapy conducted within the three different environmental settings. Statistical result reveals a pattern of correlative linkages among the interior features, the level of central attention and the effectiveness of therapy. Behavioral responses are found to be positively correlated with the level of patient cooperation. The analysis of behavioral response discloses three types of environmental stimuli--crowding in the treatment rooms, present of particular interior features such as windows, and activities outside the treatment rooms visible to the patients. Desirable response is also found to be increasing along with the number of interior stimulus features. A design guideline for treatment room is finally established. Two groups of interior environmental features could be manipulated to elevate the effectiveness of therapy--the physical environment which includes room size, and the spatial location of therapy activities within the interior environment.
