“套牌车”的防范打击研究

近年来,国内“套牌车”日益增多,引发了各种社会危害,不仅给道路交通安全带来了威胁,损害了国家和群众的利益,还滋生出系列社会问题和法律问题。“套牌车”大量涌现主要是因为法律法规不完善和打击难度较大。防范打击措施是：完善立法,加大打击力度;严格执法,加强管控;提高车主的自我保护意识。     

职业病鉴定制度的“诉讼化”改革

现行职业病鉴定制度具有＂仿诉讼化＂的特点,但仍然在公正性、便民性、权利性和救济性等方面存在一定的制度弊端,今后需要沿着＂诉讼化＂方向深化改革,切实保障劳动者公正获取职业病诊断和鉴定的权利。     

THE NEW BEGINNINGS PROGRAM FOR DIVORCING AND SEPARATING FAMILIES: MOVING FROM EFFICACY TO EFFECTIVENESS

This article describes a program of research on effectively transporting the New Beginnings Program (NBP), a university-tested prevention program for divorced families, to community settings. The four steps in this research are described: (1) selecting a community partner, (2) developing effective methods of engaging parents, (3) redesigning the NBP to be easily delivered with high quality and fidelity in community agencies, and (4) adapting the NBP to meet the needs of the full population of divorcing families. The article concludes with a discussion of plans for an effectiveness trial to evaluate the NBP when delivered in community settings.     

解读新律师法第33条对侦查工作的影响和对策

新修订的《律师法》第33条规定赋予了律师会见犯罪嫌疑人、被告人“不受监听、不需批准”的特权,被看做是加强被追诉方力量、强化侦查阶段控辩双方对抗性的信号,对侦查工作将产生重大的影响。为此,侦查机关应认真解读新法条的内容和立法本意,作好侦查工作的调整和观念的转变,完成侦查模式由过分依赖口供向综合搜集利用证据的办案模式转变,开拓秘密侦查取证的新途径,并尽量做好律师会见过程中的防范措施。     

Do Barriers to Crime Prevention Moderate the Effects of Situational Crime Prevention Policies on Violent Crime in High Schools?

This study investigates how barriers to school-based crime prevention programming moderate the effects of situational crime prevention (SCP) policies on levels of violent crime in U.S. public high schools. Using data from the 2008 School Survey on Crime and Safety, we estimate a series of negative binomial regression models with interactions to investigate whether the effects of SCP policies on violent crime vary by the presence of school-based barriers to crime prevention, such as poor teacher training, inadequate funds, and lack of parental support. Our results indicate that the effect of certain SCP policies operate differently depending on the presence or absence of specific limiting factors. Policy implications of this research suggest that schools can aid in preventing violent crime by addressing obstacles to the effective implementation of school crime prevention efforts.

鉴于保加利亚在"一带一路"经济圈上的特殊地位,论文以比较视角分析了保加利亚知识产权制度与中国的差别,认为两国在著作权领域主要是权利内容的不同,专利和商标领域体现为申请程序与司法救济程序的差异,动植物品种与生物技术发明保护表现为保护水平的区别。不同产业的中国企业进入保加利亚从事商贸活动,需有针对性地关注知识产权法律风险,建议文化创意型企业重在考虑著作权内容及其保护期限,一般工商业企业应重视专利和商标的申请程序及司法救济,农业或农业加工企业应关注动植物品种权的保护范围。     

Online victimization risk and self-protective strategies: developing police-led cyber fraud prevention programs

ABSTRACT

The prevalence and impact of cyber fraud continues to increase exponentially with new and more innovative methods developed by offenders to target and exploit victims for their own financial reward. Traditional crime reaction methods used by police have proved largely ineffective in this context, with offenders typically located outside of the police jurisdiction of their victims. Given this, some police agencies have begun to adopt a victim focused, crime prevention approach to cyber fraud. The current research explores with a sample of two hundred and eighteen potential cyber fraud victims, the relationship between online victimization risk, knowledge and use of crime prevention strategies. The study found those most at risk of cyber fraud victimization despite accurate perceptions of risk and knowledge of self-protective behaviors in the online environment underutilise online prevention strategies. This research has important implications for police agencies who are designing and delivering cyber fraud education. It provides guidance for the development of effective prevention programs based on practical skills development.     

Correlates of campus crime: An exploration of minority attitudes at an HBCU

Despite a recent increase in the reporting of crime, student attitudes associated with crime on college campuses have been well documented. To the contrary, there is a deficiency of studies that examine the views of students who attend Historically Black Colleges and Universities (HBCUs). The purpose of this exploratory study is to identify student attitudes in relation to crime within the context of victimization, offender characteristics, and crime prevention measures. Analyzing nearly 200 questionnaires, chi-square analyses reveal that age, gender, and residential status bear statistically significant relationships in association with student attitudes towards various aspects of campus-related crime. In a similar vein, binary logistic regression models demonstrate the existence of significant associations in a number of specific categories such as victimization and crime prevention measures. Limitations, areas of further research, and policy implications are discussed.     

The hunt for an elusive crime – an analysis of Swedish measures to combat sex trafficking

Sex trafficking has been described as an enormous, serious and growing problem that must be combatted, but also as a moral panic based on a very small number of cases. This article explores the measures that have been proposed to combat sex trafficking by politicians, the national police and the National Council for Crime Prevention in Sweden between 2007 and 2017. The analysis shows that sex trafficking is partly used by the actors to justify their own work. The measures that all three actors describe as central are crime victim support, co-operation, information, education and expanded legislation. The underlying problems associated with sex trafficking, according to the three actors, appear to be prostitution, drug use and foreign women crossing Swedish borders. Much of the responsibility for the provision of information and education is delegated from government agencies to a wide range of actors. This desire for comprehensive societal engagement stands in stark contrast to the small number of sex trafficking cases in Sweden. The measures to combat sex trafficking are thus largely characterized by the hunt for an elusive crime.
