刑事强制鉴定制度初探

近年来,随着刑事要案为公众所广泛关注,在某些案件中,司法鉴定成为直接影响被告人刑事责任的重要手段,也被推至舆论的风口浪尖之上。然而学界却少有对强制鉴定构建模式的专门论证。我国应当在法律中规定当事人的鉴定请求权,构建与裁量鉴定并行的强制鉴定制度,确定其适用条件、具体程序及监督体制。

Governance modes,policy regimes and operational plans: A multi-level nested model of policy instrument choice and policy design

Policy goals and means exist at different levels of abstraction and application and policies can be seen to be comprised of a number of components or elements, not all of which are as amenable to (re)design as others. Defining and thinking about polices and policy-making in this way is very useful because it highlights how policy design is all about the effort to match goals and instruments both within and across categories. That is, successful policy design requires (1) that policy aims, objectives, and targets be coherent; (2) that implementation preferences, policy tools and tool calibrations should also be consistent; and (3) that policy aims and implementation preferences; policy objectives, and policy tools; and policy targets and tool calibrations, should also be congruent and convergent. Policy instrument choices can thus be seen to result from a nested or embedded relationship within a larger framework of established governance modes and policy regime logics. In this contextual model, the range of choices left at the level of concrete targeted policy instrument calibrations—the typical subject of policy tool analysis—is restricted by the kinds of decisions made about policy objectives and the appropriate tools to attain them, and both of these, in turn, by the kind of choices made at the highest level setting out general policy aims and implementation preferences.

关于提高女性劳动者退休年龄的探讨

关于提高中国退休年龄问题,近来引发了社会各界的广泛关注。文章深入分析了广泛关注的几个因素:平均余命变化,世界的退休年龄变化趋势以及对于劳动力市场的影响,并进一步分析了当前制度规定下女性退休年龄偏低产生的低收益及退而不休现象及其影响。在此基础上,文章建议:中国应当提高女性退休年龄;结合劳动力人口变化趋势,采用小步渐进的方式进行调整。好处在于:在一定程度上解决女性退休后低收益问题,因而可以缓解退而不休现象;在一定程度上优化劳动力市场供给。     

Assessing the EU’s Transatlantic Regulatory Powers Using the Choice of Policy Instruments as Measurement of Preference Attainment

To what extent is the European Union (EU) exercising global regulatory power? This article investigates this question through a comparative study of two significant global policy fields: data-protection and banking with a special focus on the choice of policy instruments. Both cases suggest that the actual role of the EU is more complex than either exercising or being subjected to global regulatory power. This concerns not only the relationship between the EU and the member-states. The article suggests that the EU is in a better position to conclude global regulatory deals when the negotiating competencies sit with one EU institutional actor.

E-participation: A Strategic Framework

Despite the rising scientific and practical relevance of e-participation, the field still suffers from a diffuse, heterogeneous state of knowledge and our understanding of successful e-participation strategies and implementation is very limited. This situation is seen as a key reason why e-participation initiatives in practice often fall short of expectations. Against this background, this study compiles the existing insights from the interdisciplinary scientific literature to deduce a unifying definition and propose an integrated strategic e-participation framework that conceptually combines important strategic and organizational factors as well as environmental drivers of e-participation.     

从强制到自愿:公安政策工具的创新与适用

政策工具是政策的构成要素之一,政策工具选择正确与否对政策能否达到预期目标至关重要。一直以来,公安政策工具倾向于使用传统强制性工具,主要包括管制、直接提供、强制性措施。这些强制性公安政策尽管有许多优点,但也有缺乏灵活性、抑制社会活力,容易引发社会抵触情绪,产生官(警)民冲突以及容易滋生特权及权力寻租现象等弊端。因此,在新的历史条件下,创新公安政策工具,在公安改革的过程中积极采用自愿性的公安政策工具不仅有助于提高公安政策的执行力,而且是完善与推进国家治理体系和治理能力现代化的客观需要。自愿性公安政策工具主要有家庭与社区、志愿者服务、签约外包、公私伙伴关系、市场。选择和适用这些公安政策工具,必须以有利于实现公安政策目标为基本标准,注意政策工具自身的特征及其适用的环境,遵循政策工具选择及适用的合理程序。
