半夏是云南当代本土女作家,其小说文本具有"都市""时尚""物恋"等特点,体现出现代女性独立自足的主体意识。这些特点与作家的心理结构相关联,更是1990年代以来我国消费社会文化语境的产物。     

Political Branding: The Tea Party and Its Use of Participation Branding

The emergence of the Tea Party movement in 2009 witnessed the surfacing of a populist, anti-Obama libertarian mobilization within the United States. The Tea Party, a movement that brought together a number of disparate groups—some new, some established—utilized participation branding where the consumer attributed the movement its own identity and brand. Its consumer-facing approach, lack of one single leader, and lack of a detailed party platform, in combination with its impact on the 2010 election races in America, earmarks it as a contemporary and unconventional brand phenomenon worthy of investigation.     

Codes in context: How states,markets, and civil society shape adherence to global labor standards

Transnational business regulation is increasingly implemented through private voluntary programs – such as certification regimes and codes of conduct – that diffuse global standards. However, little is known about the conditions under which companies adhere to these standards. We conduct one of the first large‐scale comparative studies to determine which international, domestic, civil society, and market institutions promote supply chain factories' adherence to the global labor standards embodied in codes of conduct imposed by multinational buyers. We find that suppliers are more likely to adhere when they are embedded in states that participate actively in the International Labour Organization treaty regime and that have stringent domestic labor law and high levels of press freedom. We further demonstrate that suppliers perform better when they serve buyers located in countries where consumers are wealthy and socially conscious. These findings suggest the importance of overlapping state, civil society, and market governance regimes to meaningful transnational regulation.     

‘Exceptional’ Women,Healthcare Consumers and the Inevitability of Caring

In Rogers, the Court of Appeal held that the decision of Swindon N.H.S. Primary Care Trust to refuse to fund Herceptin for the treatment of Ann Rogers against breast cancer was irrational. The P.C.T. maintained that their decision was not resource driven but based on the fact that Herceptin was, at that time, not licensed by the European Medicines Agency (E.M.E.A.) for use in early stage breast cancer. Yet it was prepared to fund its use in ‹exceptional circumstances’ which could only be based upon the personal situation of the patient. In this note, I focus upon the ‹exceptionality’ argument in the context of the patient as consumer of healthcare and women as carers. I argue for a focus upon caring rather than consumerism in healthcare.     

我国消费者保护法律制度变迁的经济分析

我国消费者保护法律制度是适应市场经济发展的需要而不断变迁和创新的一种制度安排。"潜在利润"是制度变迁的内在原因,制度"企业家"、政府部门、消费者组织等是推动制度变迁的重要力量,从以政府为主维权向支持消费者投诉的转化应成为制度变迁的方向。     

The Impact of Tax Reduction on the Chinese Urban Household's Comsupation Gap——Analysis of Consumer Behavior Based on Price Effect

By studying the elasticity of consumption demand of urban households at different income levels and the price effect of tax reduction, we can analyze the effect of tax reduction on the consumption gap of urban residents. The results show that the marginal expenditure share of all kinds of urban households' consumption does not necessarily change linearly between income levels, and there is heterogeneity between consumption behaviors at different income levels. VAT rate cut could effectively reduce the input and output unit costs and prices, contributes all categories of consumption price index to decline. Notably, such price decline is relatively remarkable in the health, social work and social security department in the service sector, which decreases the urban household's health care consumer price index and reduces the corresponding expenditure. Overall, the tax reduction can effectively close the consumption gap among urban households, but the consumption gap between the middle-income households and the low-income households still requires close attention. In view of this, the relevant policies can further alleviate the consumption gap from improving the equalization of public services, implementing the effect of tax reduction and improving the consumption tax system.     

电子商务交易前消费者权益的法律保护

电子商务是一种非面对面交易,法律应建立一个畅通的渠道,保证消费者在交易前充分了解商品和服务的真实情况、了解经营者的身份信息及商业信誉等,据此,电子商务交易前消费者权益的法律保护措施应包括这样几个方面：转变经营者信息披露方式、确立经营者的在线信息披露义务、明确C2C交易中自然人的经营者身份、建立电子商务经营者的信誉评价机制。     

消费伦理的现实性质疑

本文通过对伦理与道德的词源学考察提出了“消费”与“伦理”的结合所可能存在的词语矛盾。尽管现代消费社会通过对消费的重新阐释消解了消费伦理的矛盾性,并从道德的正当性与经济的合理性两个方面设定了消费伦理存在的可能性,但在实践中消费伦理却并没有获得充分的现实性。本文通过对消费伦理存在的现实性的三种质疑,试图以否定的方式来完善消费伦理的理论建构。

在经济全球化日益加速的今天,国际消费纠纷日益纷繁复杂,国际消费合同的法律适用问题也随之产生。作者从阐释国际消费合同自体法的内涵入手,讨论其在国际消费纠纷中法律选择的自由和效力,并通过考察网络时代对国际消费者保护的挑战,探讨了国际消费合同自体法的一般适用及其在网络消费纠纷等特殊问题上的适用。
