儒家文化道德对韩国的深远影响

儒家文化道德传入朝鲜半岛已有2 000余年的漫长历史,早已深入人心。韩国为了继承弘扬传统儒家文化道德,提出了“文化立国”的国策,大力发展以儒家文化道德为主体的“文化产业”。不仅使以传统儒家文化道德为特色的韩国文化产业在亚洲乃至世界形成强势“韩流”,而且又拉动了国民经济的增长。当儒家文化道德面临欧美文化道德的严峻挑战时,韩国人对儒家文化道德又有了深刻的认识,并狠抓教育不放松。     

DELINQUENT PEERS IN CONTEXT: A LONGITUDINAL NETWORK ANALYSIS OF SELECTION AND INFLUENCE EFFECTS*

In this article, longitudinal social network data are analyzed to get a better understanding of the interplay between delinquent peers and delinquent behavior. These data contain detailed information about the social networks of secondary school students from the same grade, their delinquent behavior, and many relevant correlates of network formation and delinquency. To distinguish selection and influence processes, a method (Simulation Investigation for Empirical Network Analyses, SIENA) is used in which network formation and changes in delinquency are simulated simultaneously within the context of other network processes and correlates of delinquency. The data and the method used make it possible to investigate an unusually wide array of effects on peer selection and delinquent behavior. The results indicate that similarity in delinquency has no significant effect on the selection of school friends when other network dynamics are taken into account. However, the average delinquency level of someone's friends in the school network does have a significant, although relatively small, effect on delinquent behavior of the respondents, beyond significant effects of changes in the level of self‐control and morality. Another peer‐related change, leaving or joining informal street‐oriented youth groups, also appears to have a substantial effect on changes in delinquency.     

Mortgages, seniors and the common law contractual doctrine of mental incapacity in Australia

Seniors in Australia are being called upon to mortgage their most precious economic asset, the family home. They may be asked to guarantee the liabilities of other family members by providing a mortgage-based guarantee or they may decide to enter into a reverse mortgage to supplement financially their savings and pensions. As the family home is the single most valuable asset for most older Australians, the creation of any obligations in regard to it ought to be undertaken with care and vigilance. While seniors are free to create mortgages, they may lack the capacity to understand the legal ramifications of these complex transactions or be unable to protect their interests when entering into them. It is not suggested that older Australians necessarily suffer a lack of contractual capacity. Many seniors are more than able to take care of their interests and assets. However, some seniors do suffer cognitive impairment which adversely affects their capacity to act in their best interests and to navigate the complexities of contractual relations. In contract and mortgage law, this raises the issue of mental incapacity.For centuries, the common law has recognized not only that mentally incapacitated people exist, but that they may enter into contracts such as mortgages and may later wish to have the mortgage set aside. The present formulation of the contractual doctrine of mental incapacity is the product of 19th century jurisprudence in which the courts framed the doctrine to accommodate commercial dealing rather than the interests of persons who lacked the necessary mental capacity. Accordingly, the doctrine has been very difficult to rely on successfully when challenging mortgages made by persons lacking capacity. Therefore, Australian litigators and courts alike have sought to deal with mental incapacity issues in the contractual context by using and modifying other doctrines (such as non est factum, undue influence and unconscionable dealing) in which the issue of capacity may be incorporated, but where mental incapacity need not be the sole or primary focus. While this had led to greater success for mortgagors, this has been at the expense of the common law doctrine. The article concludes by offering some suggestions as to how the doctrine may be modernized and mental capacity dealt with in a way both to empower competent seniors and protect those vulnerable seniors suffering cognitive impairment.

文化在区域经济发展中扮演着重要角色。长三角、珠三角之所以能够成长为中国区域经济发展的引擎,与两地区域文化的特质密不可分。黄三角区域文化中既存在有利于区域经济发展的因素,同时也存在一些消极因素。在推动黄三角新一轮的开发建设过程中,必须充分重视区域文化对区域经济的影响,要在认真研究区域情况的基础上整合资源,构建新型地域文化体系,推动区域经济的发展。     

国际法发展进程中的“观念”及其影响途径

在国际法的发展进程中,"观念"不仅是客观存在的,而且起到了至关重要的影响。不过,在国际法的研究中,以理性主义为认识论的主流学派,并没有对此做出过系统性分析。这正是主流国际法学本身的一个重大缺漏。研究表明,诸如"世界观"、"原则化观念"以及"因果信念"等在国际法的发展进程中,起到了"路线图"、"黏合剂",以及"制度化"等方面的影响。     

A Two‐Year Study of Δ 9 Tetrahydrocannabinol Concentrations in Drivers; Part 2: Physiological Signs on Drug Recognition Expert (DRE) and non‐DRE Examinations,,

Whole blood samples were examined for ?⁹‐Tetrahydrocannabinol (THC) over 2 years in drivers suspected of driving under the influence. Part one of the study examined the link between [THC] and performance on field sobriety tests. This portion examined objective signs, eye examinations and physiological indicators; and their relationship to the presence of THC. Several objective signs were excellent indicators of the presence of THC: red eyes (94%), droopy eyelids (85.6%), affected speech (87.6%), tongue coating (96.2%), and odor of marijuana (82.4%). About 63.6% of THC positive subjects had dialted pupils (room light). THC positive subjects had either rebound dilation or hippus in 88.8% of cases. Pulse and blood pressure (BP) were evaluated to determine any correlation with [THC]. An increased pulse rate correlated well to the presence of THC (88.5%), but not [THC]. BP did not correlate to [THC] and was also a poor indicator of THC in the blood (50% high).
