Criminal background checks have now become ubiquitous because of advances in information technology and growing concerns about employer liability. Also, a large number of individual criminal records have accumulated and have been computerized in state repositories and commercial databases. As a result, many ex‐offenders seeking employment could be haunted by a stale record. Recidivism probability declines with time “clean,” so some point in time is reached when a person with a criminal record, who remained free of further contact with the criminal justice system, is of no greater risk than a counterpart of the same age—an indication of redemption from the mark of crime. Very little information exists on this measure of time until redemption and on how its value varies with the crime type and the offender's age at the time of the earlier event. Using data from a state criminal‐history repository, we estimate the declining hazard of rearrest with time clean. We first estimate a point of redemption as the time when the hazard intersects the age–crime curve, which represents the arrest risk for the general population of the same age. We also estimate another similar redemption point when the declining hazard comes “sufficiently close” to the hazard of those who have never been arrested. We estimate both measures of redemption as a function of the age and the crime type of the earlier arrest. These findings aid in the development of guidelines for the users of background checking and in developing regulations to enhance employment opportunities for ex‐offenders.  相似文献

The primary objective of this article is to examine both the role of government and the function of public administration in the areas of economic development and environment protection in Japan. This article will first elucidate several important mechanisms of Japan's economic growth. In a nutshell, it posits the Japanese government as the spearhead of a growth machine. Subsequently, this article will also describe a number of historical developments, all of which have, in one way or another, helped alleviate the state of pollution, which is called Kogai, in Japan. The major thurst of this article is to expound upon the idea that, despite the incidence of Kogai , the basic structure of the political economy of the country has not changed. Even though the Japanese had to pay a costly price for rapid economic growth in the form of Kogai, the fundamental structure of Japan's growth machine has been left undisturbed. It is primarily for this reason that there has been a growing fear that Japan will soon encounter another period of serious Kogai . An analysis of the Japanese experience seems valuable, for it may reveal several important lessons germane to the basic questions of the role and function of public authority in environmental issues, especially in newly industrialized countries.  相似文献

In the schools of crime hypothesis, social interactions between inmates are assumed to produce criminogenic rather than deterrent prison peer effects, thus implicating them in the persistence of high recidivism rates and null or criminogenic prison effects. We assess the validity of the schools of crime hypothesis by estimating prison peer effects that result from differential cellmate associations in a male, first‐time release cohort from the Pennsylvania Department of Corrections. To isolate causal prison peer effects in the presence of essential heterogeneity, we use a semiparametric local instrumental variables estimation strategy. Our results do not support the school of crime hypothesis. In our sample, prison peer effects produced in interaction with more criminally experienced cellmates are always null or deterrent rather than criminogenic. Although we do not explicitly test for the operant conditioning mechanisms theorized to underlie social influence in the context of differential association, we argue that, under the assumption that the differential association context relates positively to the direction of peer influence, our universally noncriminogenic estimates exclude direct reinforcement, vicarious reinforcement, and direct punishment as potential drivers of prison peer effects produced in interaction with more criminally experienced cellmates. Our results support the assertion that operant conditioning mechanisms connect differential association and deterrence theories.  相似文献

In the 1980s many developing and newly industrializing countries in Asia expressed great interest in administrative reform. Compelling reasons for public reform in these nations arise from causes different from those in developed nations. Among Asian developing nations, government reform is intrinsic to and inextricable from crises in governance. Within the context of developing politics, a reliable and competent government is sine qua non of national stability; and, more importantly, this largely decides the tenure of a governing group. Its ability to remain in power will be determined by the efficaciousness of public authority. Against these backgrounds, this article discusses the five conference papers of the Eastern Regional Organization of Public Administration (EROPA) of 1991. It examines both similarities and differences among four countries in their efforts to reform public administration. This review suggests that in developing Asia, the quest for administrative reform emanates from crises in governance. Reform goes beyond exploring ways to improve the quality of public management.  相似文献
