In a context of rising violence and long-lasting impunity, in 2008, Mexico's criminal justice system underwent a radical change from an inquisitorial model to an adversarial one, to make it more effective, transparent, and expeditious. The new system tasked judges with publicly determining the admissibility of forensic evidence, as well as assessing its technical quality and probative value—tasks for which they currently receive little to no training. With the aim of contributing to the consolidation of the adversarial model, a comparative framework—in the form of a checklist—of the analysis of fingerprints, DNA samples, and voice recordings was created. To do so, a review of the academic literature, published reports, and guidelines was performed. The collected data were synthesized and submitted to a panel of Mexican judges, who provided feedback on its adequacy. The framework focuses on the steps on which quality assurance of forensic evidence depends, organized in five discrete stages that span from the collection of samples at the scene of a crime to the presentation of evidence at trial, specifying the main technical criteria experts should state to allow a decision maker to examine its accuracy and reliability. Differences and commonalities among the three methods were identified, particularly in terms of how qualitative and quantitative analyses are performed in each. Besides its potential usefulness as an aid for judicial decision-making, the checklist could be a valuable resource for training programs aimed at judges, as well as quality assurance programs.  相似文献

Abstract

The hope for a unique revolutionary actor in the twentieth century evaporated as a result of the weaknesses of social organisations. This paper examines the potential of an almost-forgotten group of revolutionary actors – collectively organised and deliberately involved in processes of social and productive transformation with a legitimate claim to territory – whose present-day activities involve them in concerted processes to consolidate a different constellation of societies on the margins of the global capitalist system. Indigenous and peasant communities throughout the Americas are self-consciously restructuring their organisations and governance structures, taking control of territories they claimed for generations. They are also reorganising production to generate surplus, assembling their members to take advantage of underutilised resources and peoples’ energies for improving their ability to raise living standards and assure environmental conservation and restoration. These communities are not operating in isolation. They coordinate activities, share information and build alliances. Hundreds of millions of people are participating in this growing movement; they occupy much more than one-quarter of the world’s land area. There is great potential for others to join them, expanding from the substantial areas where they are already operational. Global social networks are ensuring that this dynamic accelerates.  相似文献

Colombian forensic investigators required assistance locating clandestine burials of missing persons related to human right atrocities from 14 years ago. Geoscientific search methods were trialled, including a predictive spatial statistical model, using various input and database information, to select the most likely grave locations in difficult mountainous terrain. Groundwork using forensic geomorphology, near-surface geophysics (ERT) and subsequent probing identified suspect burial positions. One site was in mountainous terrain and the other in former school grounds, both difficult to access and in poor weather conditions. In the mountainous area, a negative resistivity anomaly area was identified and intrusively investigated, found to be a buried rock. In school grounds, after MESP and intelligence were used to identify a burial site, surface depressions were identified, and ERT datasets collected over the highest priority depression; intrusive investigations discovered a hand-dug pit containing animal bones. This approach is suggested for Latin American searches.  相似文献

This report interprets the presence of mite species in three clandestine graves in Europe, evaluating their potential use as trace evidence or markers. Grave 1 (Sweden): Two mite species Rhizoglyphus robini Claparède, 1869 and Parasitus loricatus (Wankel, 1861) were recovered from the surface of a body buried in a shallow grave in an area surrounded by trees, in close vicinity to house gardens. Grave 2 (Germany): Phoretic deutonymphs of Gamasodes spiniger (Trägårdh, 1910) were attached to an adult fly (Diptera: Sphaeroceridae) found within a shallow grave containing two human bodies covered in soil and dung. Grave 3 (France): P. loricatus were recovered from the soil around a body buried in a deep grave (80 cm under). In graves 1 and 3 both corpses were undergoing advanced decay and skeletization, the locations match with the subterranean habit of P. loricatus, highlighting the value of this species as a marker of graves or burials in soil and during late decomposition. R. robini is a soil mite that feeds on decayed roots and bulbs; this mite species confirms the location of the corpse within top soil, agreeing with a more specific type of superficial burial, a shallow grave. In case 2, the presence of both coprophiles, the mite G. spiniger and the carrier fly confirm association of remains with dung or animal feces. The three mite species are reported for the first time in human graves. There are no previous records of R. robini from Sweden.  相似文献

Recent theories of territorial rights could be characterized by their growing attention to environmental concerns and resource rights (understood as the rights of jurisdiction and/or ownership over natural resources). Here I examine two: Avery Kolers’s theory of ethnogeographical plenitude, and Cara Nine’s theory of legitimate political authority over people and resources. While Kolers is a pioneer in demanding ecological sustainability as a minimum requirement for any viable theory of territorial rights – building a bridge between environmental and political philosophy – Nine highlights a crucial distinction when looking at territorial rights from a global justice perspective, namely that between jurisdictional powers and ownership rights over resources. Daring and innovative at first glance, I claim that both theories present, however, deep ambiguities and retreat from their radical implications which, if taken seriously, would lead to a massive redrawing of current territorial borders.  相似文献

Nonprofits are critical partners in the delivery of government-funded human services in the US, but there is evidence of a persistent racial leadership gap in the sector, whereby Black and Latino Executive Directors are dramatically under-represented. Why does this gap persist despite increased attention to this issue in recent years? And what organizational and community-level factors do shape the likelihood that nonprofits will hire a Black or Latino Executive Director (ED)? We answer these questions through a mixed-methods sequential design, drawing on survey data from 606 nonprofit organizations across the US, along with interview data from 12 nonprofit executives representing expert informants in the Chicago metro area. Consistent with theories of representation and publicness, we find demographic representation at the board level positively linked to the hiring of a Black or Latino ED, but government funding has inconsistent effects. We further elaborate on these findings through our qualitative data.  相似文献

The wide application of networks in public administration has been driven by the practical need to address increasingly complex management and policy problems. To understand the outcomes of network structures, we reviewed empirical network research and examined the effects of six network structural properties across the five most studied policy domains. We found that certain structural properties such as global connectedness were consistently associated with positive network effects. Other structures such as brokerage/structural holes provided mixed findings, depending on the policy domain. Overall, our field is still in the early stages of developing research on network effects. The number of hypotheses on both node-level and system-level effects in any policy domain was relatively small. Most studies focused only on a single network at a single point in time, and thus very little work currently exists that examines the influence of contextual factors and their combined effects with network structures.  相似文献
