“A borderline issue”: Are there child soldiers in the United States?

The human rights literature on child soldiers has long emphasized conflict zones in the Global South, fostering the stereotype of the gun-toting African child while ignoring militarizing practices in the West. Of note, the existing human rights legal framework fails to address the reality of Western youth exposed to military recruiting in their schools. Seeking to address this limitation, we examine some of the primary methods the US military employs to “penetrate” American high schools in search of new recruits. We discuss the apparent targeting by military recruiters of communities with large numbers of low-income students, immigrants, and youth of color. Indeed, in many educational settings, students with limited access to college preparatory programs find themselves ensnared in a “web of militarism” that sharply limits their career options. Drawing on primary source material and military recruiting documents, we demonstrate how US schools are sites for the socialization of youth to a culture of militarism and, ultimately, the production of child soldiers. Thus, we argue that the military presence in US schools be included in the debate over the militarization of youth. We conclude by assessing the discourses and organizing strategies employed by US “counter-recruitment” activists, including some of those who use human rights-based arguments to curb militarism in American schools.

Trusts for Religious Purposes and the Question of Public Benefit

It is a well‐established principle that no trust may be regarded as charitable in law unless carrying out its purposes will benefit the public. Trusts for religious purposes have traditionally been presumed by courts to be for the public benefit. However, the presumption of public benefit will be removed from the law in early 2008 when section 3(2) of the Charities Act 2006 comes into force. At that time, two questions are likely to attract interest. First, to what extent, and in what ways, has the application of a presumption of public benefit assisted courts up to now? Secondly, without the assistance of the presumption, how might courts go about ascertaining whether the public will benefit in future cases? The article takes up these two questions with respect to trusts for religious purposes.     

Field performance of the Intoxilyzer 5000: a comparison of blood- and breath-alcohol results in Wisconsin drivers

Intoxilyzer 5000 and blood-alcohol results from drivers arrested for operating a motor vehicle while intoxicated and for related offenses were compared during a two-year period. Three hundred and ninety-five pairs of results were studied. The breath- and blood-alcohol specimens in this study were collected within 1 h of each other. The mean blood-alcohol concentration obtained was 0.180 g/dL, with a range from zero to 0.338 g/dL. By comparison, the mean Intoxilyzer 5000 result was 0.16 g/210 L with a range from zero to 0.32 g/210 L. Compared with the blood-alcohol result, Intoxilyzer 5000 results were lower by more than 0.01 g/210 L 67% of the time, within 0.01 g/210 L 31% of the time, and higher by more than 0.01 g/210 L 2% of the time.     

Household furniture tip-over deaths of young children

The potential for the injury or death of a child resulting from the tip-over of a piece of household furniture or a domestic appliance has not been previously well recognized. We reviewed nine accidental deaths of young children that resulted from avoidable residential hazards and/or lapses in supervision of the children by their caregivers. The offending household items included televisions, bedroom dressers, a kitchen stove, and a lounge chair. The causes of death were mechanical asphyxia, blunt trauma, and combined blunt head trauma and asphyxia. All of the deaths could have been prevented by appropriate anchoring of the piece of furniture and/or closer supervision of the child. A thorough multidisciplinary investigation is essential in establishing the cause and manner of death in such cases and in identifying risk factors that may aid in the prevention of future childhood deaths.     

Fatalities Due to Indigenous and Exotic Species in Florida

Florida's climate is suitable for many potentially hazardous animals, including both indigenous and exotic species, which are frequently kept as in zoos or as pets. This has resulted in many unforeseen fatal encounters between animals and the ever expanding human population. While the literature and knowledge pool for more common types of deaths referred to medical examiner/coroner's offices is abundant, the appreciation of wildlife and exotic pet‐related deaths is far less widespread. We report seven animal attack‐related deaths that occurred in Florida. The inflicted injuries included blunt and sharp force injuries, asphyxia, drowning, and envenomation. The underlying cause of death, however, was always a result of the human/animal interaction and in many cases related to human error and failure to appreciate the potentially dangerous behavior of nondomesticated species. These cases illustrate the varied circumstances and pathophysiologies associated with deaths due to indigenous and exotic species and the importance of the multidisciplinary approach in the medicolegal investigation of these cases.     

Explanations of,and responses to,youth homelessness in local authority housing departments

This article examines the relationship between beliefs about youth homelessness and the steps being taken by local authorities to tackle the problem, based on interviews with officers responsible for dealing with youth homelessness in north‐eastern local authorities. Officers blamed young people's homelessness on a wide range of factors, but the action they thought appropriate to tackle the problem tended to focus on making more accommodation available or supporting young people to live in it. Officers expressed frustration at their inability to provide adequate support. It appeared that action to meet young people's needs was most likely to be taken when it also incorporated a ‘housing management’ objective such as filling empty properties.
