Stepping Up to the Plate: Minor Leaguers Attempt to Remedy their Unconscionable Plight

Professional baseball players are often thought of as making multi-million-dollar salaries, but most professional baseball players have recently made under $15,000 a year. Minor league players toiled under an onerous system resulting from baseball's judicially created antitrust exemption and lobbying efforts that exempted them from minimum wage and overtime. These factors allowed teams to impose a uniform player contract (UPC) on players with numerous unconscionable provisions for years. However, a late-night Tweet in August of 2022 sent shockwaves through the sports and labor world, announcing that the Major League Baseball Players Association (MLBPA) was sending out authorization cards to represent minor league players. After years of fighting to maintain the authority to impose conditions on minor league players, through lobbying and litigation, Major League Baseball (MLB) turned over a new leaf and recognized the unionization of minor league players under the MLBPA less than three weeks later. In light of this long sought-after recognition, this article takes a novel approach. First, it provides historical context for baseball's unique ability to impose working conditions on minor leaguers without significant concern for legal ramifications. Second, it provides an overview of the doctrine of contractual unconscionability and analyzes the prior UPC as an unconscionable agreement. Finally, it details the historic unionization process and makes detailed recommendations to ameliorate the unconscionable conditions minor league players have faced when they negotiate with MLB owners to draft their initial collective bargaining agreement.     

Global scientific production,international cooperation,and knowledge evolution of public administration

Public administration is a discipline with considerable history, and is also a diverse, interdisciplinary field in social science. To analyze its evolution, discover the present research foci, and predict future development trends, this study applied scientometrics visualization technology to evaluate over 72,000 scientific articles from the 1920s to 2020s. This research referred to the SSCI and JCR databases to gather scientific data of the discipline and the journals' impact factor. Consequently, paper citations, cited journals, journal co-citations, author co-citations, authoritative papers, top countries, productive institutes, average references, and research collaboration trends were analyzed on the bases of the published literature. This study found top productive journals in the discipline, discovered productive countries and institutes, present the research foci, and predicted future development trends. Through this study, scientific production, international cooperation, and knowledge evolution mode of public administration research offers a clear knowledge map of the public administration discipline.

Dual-Credit Courses and the Road to College: Experimental Evidence from Tennessee

Dual-credit courses expose high school students to college-level content and provide the opportunity to earn college credits, in part to smooth the transition to college. With the Tennessee Department of Education, we conduct the first randomized controlled trial of the effects of dual-credit math coursework on a range of high school and college outcomes. We find that the dual-credit advanced algebra course alters students’ subsequent high school math course-taking, reducing enrollment in remedial math and boosting enrollment in precalculus and Advanced Placement math courses. We fail to detect an effect of the dual-credit math course on overall rates of college enrollment. However, the course induces some students to choose four-year universities instead of two-year colleges, particularly for those in the middle of the math achievement distribution and those first exposed to the opportunity to take the course in eleventh rather than twelfth grade. We see limited evidence of improvements in early math performance during college.     

An Empirical Study of Patent Grant Rates as a Function of Race and Gender

In this article we examine the rate at which patent applications are granted as a function of the inventor's race and gender. Empirical analysis of more than 3.9 million U.S. applications finds minority and women applicants are significantly less likely to secure a patent relative to the balance of inventors. Further analysis indicates that a portion of this bias is introduced during prosecution at the Patent Office, independent of the quality of the application. Mechanisms underlying these disparities are explored. The article concludes with a discussion of our results and their interaction with patent law, innovation policy, and employment trends.

The Dark Sides of Artificial Intelligence: An Integrated AI Governance Framework for Public Administration

ABSTRACT

As government and public administration lag behind the rapid development of AI in their efforts to provide adequate governance, they need respective concepts to keep pace with this dynamic progress. The literature provides few answers to the question of how government and public administration should respond to the great challenges associated with AI and use regulation to prevent harm. This study analyzes AI challenges and former AI regulation approaches. Based on this analysis and regulation theory, an integrated AI governance framework is developed that compiles key aspects of AI governance and provides a guide for the regulatory process of AI and its application. The article concludes with theoretical implications and recommendations for public officers.
