Paradigmenwechsel in der europäischen Umweltrechtsetzung?

Zusammenfassung  Der europ?ische Umweltrechtsgesetzgeber verwirklicht seine umweltpolitischen Ziele in zunehmendem Ma?e durch planerische Instrumente, insbesondere durch die Pflicht der Mitgliedstaaten zur Aufstellung sog. Ma?nahmen- oder Aktionspl?ne. Dabei sollen durch die entsprechenden Planerstellungspflichten vor allem die europarechtlich vorgegebenen Umweltstandards oder -ziele erreicht werden. Eine erste Bestandsaufnahme und Typisierung des Instrumentes der Ma?nahmenplanung legt nahe, dass es sich um eine übergreifende Form der Regelungstechnik handelt. In der Folge werden daher übersektorale Problemkomplexe und m?gliche gemeinsame Umsetzungsfragen erkennbar, die sich auf konzeptionelle Spannungen zum deutschen Umweltrecht, Anforderungen des deutschen Verfassungsrechts und Rechtsschutzfragen beziehen.

Toxic lesions were found in liver, kidney and brain of rats and rabbits after oral application of hashish for 7 or 30 days. The brain tissue showed hyperemia and edema. The cerebral cortex, brain stem and cerebellum contained ganglion cells with eccentric nuclei and an icreased number of nucleoli. Different stages of cell lesions could be distinguished by nuclear vacuoles, pyknosis and karyolysis. The cytoplasma was loosened and showed numerous vacuoles. In the kidney we found, besides interstitial hemorrhage, cloudy swelling of the proximal tubules with vacuolous degeneration and nuclear pyknosis and karyolysis in all stages. The glomeruli were often enlarged with thickening of Bowman's capsule and surrounding cellular infiltration with cell fragments. The liver cells showed irregularities of nuclei and vacuolated nuclei, plasma vacuoles and cell necrosis. Infiltrations of round cells at the portal-biliary areas were usually combined with an activation of the Kupffer cells and intracellular bile stasis.     

Dental hygiene students' matching accuracy when comparing antemortem dental radiographs and oral photographs to simulated postmortem WinID3® odontograms

Matching dental antemortem (AM) and postmortem (PM) data for human identification is especially challenging when the workforce is limited. Dental hygienists have served mass fatality incidents (MFIs) due to dental-related expertise. However, forensics within dental hygiene education and research on transferable skills is limited. This qualitative balance design study assessed senior dental hygiene students' match accuracy of simulated cases varying in dental identifiers based on AM full mouth series (FMS) radiographs and oral photographs to PM WinID3^® odontograms to demonstrate possible disaster victim identification (DVI) transferable skills gained during formal education. A convenience sample of senior dental hygiene students (n = 31) was presented information on WinID3^® interpretation, then presented with 5 mismatched cases and asked to visually interpret each to make 10 total matches; five based on AM FMS with simulated PM WinID3^® odontograms and five based on AM photographs with PM WinID3^® odontograms. Match accuracy scores ranged from 41.9% to 58.1% for cases with 1–10 identifiers, and 77.4% to 93.5% for cases with 11–40 identifiers. Accuracy when matching AM radiographs to PM odontograms versus AM photographs to PM odontograms was compared and revealed no statistical differences in match accuracy depending on image type (p = 0.388 to 1.000). Results of this pilot study suggests transferable match accuracy skills resulted from the participants' dental hygiene formal education. These baseline skills with additional specialized training support the rationale for dental hygienists serving on DVI teams. More research is needed in education and practice when preparing dental hygienists for forensic-based service.

GSR2005--continuity of the ENFSI proficiency test on identification of GSR by SEM/EDX.

Within the framework of the ENFSI Expert Working Group "Firearms" a proficiency test on the detection and identification of GSR by energy-dispersive scanning electron microanalysis (SEM/EDX) is carried out in a 2 years term. The latest test was performed in 2005/2006 and was denoted as GSR2005. Seventy-five laboratories from 28 countries participated in this proficiency test and submitted in total 83 independent data-sets. The participating laboratories were requested to determine the total number of PbSbBa containing particles on a synthetic test sample following their own laboratory specific methods of automated GSR particle search and detection by SEM/EDX. Furthermore size and position of the detected particles had to be reported by the laboratories and were evaluated statistically. The results were compiled by means of z-scores according to the IUPAC and EURACHEM guidelines-assessing individual laboratory achievements (inter-laboratory) as well as intra-laboratory performance-and were compared to the results of the previous proficiency test run GSR2003 (1). The comparison shows that there is a noticeable improvement in the method's detection capability.
