Plausible retributivist justifications for punishment assert that the commission of a moral wrong creates a pro tanto reason to punish the person who committed it. Yet there are good case-based and theoretical reasons to believe that not all moral wrongs are the proper subjects of criminal law or that they are within the proper domain of the state. This article provides these reasons, which suggest that a plausible retributivist justification for punishment must make distinctions between state-relevant and non-state-relevant moral wrongs and (consequently) state-relevant and non-state-relevant desert. The article makes the case for Rawlsian public reason as a plausible method for making these distinctions.  相似文献

Heilmann offers a psychoanalytic reading of Moore's narrative of cross-gender impersonation 'Albert Nobbs'. First published in A Story-Teller's Holiday (1918) and later transferred to Celibate Lives (1927), the story features a woman who passes herself off as a man, until a chance meeting with another male impersonator happily equipped with a wife galvanizes her desire for a companion. Her inability to reveal the secret of her body to her prospective bride, however, coupled with the marked absence of any expression of sexual passion, leads to the break-up of the relationship, and Albert dies, a loner hoarding money in order to sublimate her thwarted longing for love. In this text the no (wo)man's land of cross-gender masquerade operates as a psychological marker of Albert's social (hence internal) lack of identity. An illegitimate child brought up by a nurse, she never knew her parents, whose absent presence was embodied by an allowance discontinued after their death. Drawing on Kleinian object-relations theory, Heilmann argues that Albert's (mis)performance of 'manhood' constitutes a subliminal quest for her missing parents, a desire always frustrated and ultimately displaced into the hard currency of material commodities. If Moore's story represents the female tranvestite as a castrated, sexless and depressed 'perhapser', an 'outcast from both sexes', fatherless and yet forever locked into a male-authored, patronymic text, Simone Benmussa, who in 1977 adapted the story for the stage ( The Singular Life of Albert Nobbs ), offers a more subversive reading of the female cross-dresser as a 'figure that disrupts' (Marjorie Garber) cultural categories and binary oppositions. The article ends with a consideration of Benmussa's revisionary strategies.  相似文献

Abstract

This essay discusses the early life, education, and career of African American correctional leader Margaret Moore. Moore was the first African American woman to superintend a male prison in Pennsylvania. Moore's lengthy list of “firsts” also includes serving as Deputy Commissioner of the Pennsylvania Department of Corrections and overseeing the District of Columbia Department of Corrections. Moore's unprecedented success in overcoming sexism and racism to assume these key leadership roles has paved the way for other minority corrections professionals. This biographical essay is primarily based on two personal interviews with Moore.  相似文献

The public value theory has been accused of serving as a “rhetorical device” for public managers to advance their interests and influence vis-à-vis politicians. This article uses Legislative Budget Offices (LBOs) as a lens to re-examine the theme of “public value as rhetoric”. It examines how an LBO can relegate itself to a lower public value-creating position that avoids conflict with politicians, which then allows politicians to employ rhetoric such as fiscal “sustainability” and “responsibility”, without making actual budget choices that incur political costs. The findings of the article suggest that the use of public value as rhetoric is a function of contradictory values held by citizens, which politicians and public managers must reconcile by choosing to divert either resources or rhetoric. Furthermore, rhetoric is bidirectional, and employable not just by public managers, but by politicians as well.  相似文献

We use Legislative Budget Offices (LBOs) as both a lens and a test of “public value in politics,” a facet of Moore’s original framework that remains its most contested. We identify two public value roles for LBOs: (1) as a normative-advisory institution, and (2) as a mechanistic-costing one. Through Moore’s Strategic Triangle, we contrast the higher public value contribution of the advisory role, as manifested in the United States, with the costings role as manifested in Canada. Our findings suggest that LBOs enhance both democracy and efficiency and thus show how “public value in politics” can be achieved.  相似文献

This article reconsiders the work of Barrington Moore and his critics on the historical emergence of democracy in the light of post-communist democratization. What are we to make of a region which violates Moore's dictum – “No bourgeoisie, no democracy”? Using the tools of comparative historical analysis, it makes sense of how democracy emerged in the region by developing a theory which both explains why this was possible and what social actors were essential to this outcome. With attention to patterns of social development in the region, the politics of elite alliance in the final phase of communism, the strength of civil society at extrication, and the role of the international system, it explains differences in regime outcomes across the region.  相似文献

Abstract: Through a comparison between Daphne du Maurier's 1938 novel Rebecca and Susanna Moore's 1995 novel In the Cut, this article considers the extent to which Franco Moretti's theory of the inevitable dissolution of literary genres is true, with specific regard to the genre of the gothic romance. In evaluating both novels' treatment of female subjectivity, unregimented masculinity and the symbiotic relationship between sexual pleasure and mortal danger, this article investigates the degree to which a contemporary novel such as In the Cut, which is generally acknowledged to be an ‘erotic thriller’, is heavily indebted to the gothic romance and may therefore be interpreted as a continuation of this more traditional genre, and, conversely, the means through which Moore's novel exhibits an overt and defiant resistance to the gothic romance, thereby signifying the dissolution of this particular genre within twentieth-century women's writing.  相似文献
