| 摘 要： | 在人类文明的进程中，言论自由不仅是文明进步的重要手段，也是文明进步的重要标志。在我国历史上，思想言论罪曾经长期存在。当今，言论自由则是民主社会的基石。在言论自由的刑法保障中。政府的谅解是言论自由得以保障的根本保证，权利滥用的刑法限制则是其重要保证。

| Abstract: | With human civilization developing gradually, the freedom of speech is not only an important means of civilization and progress, and also marks the civilization and progress. In Chinese history, the speech and thinking crime has existed for a long time. Nowadays, the freedom of speech is the cornerstone of democratic society. To realize the freedom, government＇s understanding and restriction to the abuse of criminal law is of great importance. |
