关于我国地役权制度的几点思考

地役权是最古老的物权制度,其产生甚至要早于所有权.我国物权法应建立不动产役权制度,使其涵盖海域役权,克服地役权制度的不足,并创设新型的不动产役权;供役不动产人应包括不动产的一切物权利用人,需役不动产主体则不宜作任何限制,我国应建立土地使用权人自己役权制度;不动产役权内容的约定性、类型化的困难性决定了不动产役权登记的特殊性.

On Servitude System in Our Country

The servitude,which is even earlier than the ownership,is the most ancient real estate system.We should set up easement of real estate,which covers easement of maritime space,in order to conquer the defect.At the same time,we should build late-model easement of real estate.Subject of servant estate can include all the utilization person of real estate.Subject of necessary estate can't be limited and we should establish system of own-servitude.Varieties of content on servitude and difficulty of types determine special register of easement.
