信息网络传播权立法评价与完善

信息网络传播权是中国略别于WIPO公众传播权的一项权利创设。中国《著作权法》第10条第12款提出了信息网络传播权,但《信息网络传播权保护条例》尚未出台,信息网络传播权的权利设置,权利所涉各方的利益衡平,技术措施保护及权利限制等种种问题,均有进一步从理论上探讨洞彻,并联系国内外司法与立法实践甄别酌明之必要。

A Analysis on Legislation of Information Spreading Right through Web and its Perfection

The media right of information network is a right creation which has a little different to the right of mass media of WIPO. Article 10.12 of China's Copy Right puts forward the media right of information network, while "the Protection Regulation of the Media Right of Information Network." hasn' t yet promulgated. The right creation of the media right of information network, the right balance of the parties to whom the right relate and the technical measures protection as well as the right restriction will be necessarily studied in theory and discriminated by linking to practices of judicature and legislation at home and abroad.
