现阶段侦查取证工作存在的问题及改革重点——结合“两个证据规定”的分析

"两个证据规定"出台后,理论界和实务界都对其寄予了厚望。其中,《关于办理死刑案件审查判断证据若干问题的规定》(以下简称《办理死刑案件证据规定》)虽然主要立足于死刑案件,但对于普通刑事案件同样适用。现阶段,侦查取证工作未能全面贯彻"两个证据规定"的具体要求,有待通过进一步的改革来推进侦查取证的规范化,从而切实提高刑事案件的办案质量。

Problems in Collecting Evidence in Current Investigation

After Regulations of Excluding Illegal Evidence and Regulations of Handling Death Penalty Case Evidence were released,both the theoretical and practical circles had high expectations on them.Though the latter mainly focuses on death penalty cases,it can also be applied to common criminal cases.Currently the collection of evidence does not fully meet the requirements of the two regulations,which needs to be further reformed to standardize the collection of evidence in investigation and guarantee the quality of handling criminal cases.
