论中国特色行政法院制度的具体建构

深化行政审判体制改革，引入行政法院制度，摆脱行政审判困境，已成为我国行政诉讼研讨的热点问题。在行政法院制度的具体建构上，我们必须结合基本国情，遵循司法独立、司法统一和审判专业化原则，建立隶属于司法系统且独立于普通法院的行政法院。同时设计好组织体系、人事、经费、行政法官等具体制度。

On Specific Constructing Administrative Court Institution in China

Deepening reform of administrative adjudication and establishing the administrative court system has become a focus of discussion of administrative litigation issues. We should combine with our national conditions, and establish administrative court institution with Chinese characteris- tics which is independent in common court but subordinate in judicial system. In the course of build- ing this system, we follow the principle of legislative independence, legislative integration and judicial professional, and solve such key problems as organizational system, jurisdiction, personnel, funding concerned.
