| 摘 要： | 警察权与公民权之间的对立统一使二者之间存在博弈关系,但由于二者在博弈地位上存在差异,致使实质博弈难以展开。应当从适度控制警察权与适度扩展公民权两个方面着手,消除二者之间的差异,达成“双赢”格局。

| Abstract: | The unity of opposites between police rights and civil rights has the relation of playing chess,but because they possess different political resources,it causes the asymmetry nature between police organ and citizen.To make reciprocal playing chess in order to reach win-win pattern,we must make two reciprocal at equal legal status.So we should begin with the moderate control of police rights and the moderate expansion of civil rights. |
