| 摘 要： | 由于《刑法》对非国家工作人员受贿罪和受贿罪在客观方面的表述不尽相同，也使非国家工作人员受贿罪在客观方面认定上存在一定争议。对非国家工作人员受贿罪在客观方面刑法适用具体问题进行探讨，期待对非国家工作人员受贿罪的司法适用更具有操作性。

| Abstract: | On November 20th, 2008, the Supreme People＇ s Court and the Supreme People＇ s Procurator- ate issued Opinions on Issues Regarding the Laws Applied to Handling Criminal Cases on Commercial Briberies and classified commercial briberies into eight specific crimes. For the first time in legislation the bribery of non - government employees is clearly stated as a kind of commercial bribery. However, owing to the different stipulations in Criminal Law there exist some disputes on the assertion of the bribery of non - government employees. This paper discusses the concrete issues regarding the laws applied to handling bribery crimes for non - government employees and hopes to provide a workable way to deal with cases involving bribery for non - government employees. |
