司法独立的另一种诠释:权、责、信的统一

作为一种独立的制度有机体 ,司法必然包含着自我实现、自我完善的内在品质和取得社会认同与支持的价值亲和性。从对司法独立的制度及中国背景的实在考察中 ,检视出中国司法之独立的根本障碍在于各级决策层对司法权的独立缺乏信任和中国司法责任机制的缺乏。因而 ,作者主张以责任先行来引导中国司法的全面独立。

Another Annotation of Judicial Independence: Unity of Power and Responsibility and Reputation

As an independent system, judicature indispesably contains innate quality about self-realization and self-perfection, and value orientation of social identity. Following the study of domestic and abroad conditions, the paper points out that the main obstructions of judicial independence are lack of confidence in judicial independence by decision-making bodies and lack of judicial responsibility system in China. It suggests that the responsibility system go ahead of judicial power independence.
