我国经济犯罪案件侦查中的证据规则和取证要求

经济犯罪案件证据作为刑事犯罪证据的一种,必然遵循证据的一般规则。但目前我国缺少一部完整的证据法,也没有确定相应的证据规则。这导致了我国经济犯罪案件取证过程中存在着法律依据粗疏和侦查取证程序、手段非法制化的问题。要解决以上问题必须确定证据能力和证据证明力的规则。同时,由于经济犯罪案件证据的特殊性,要求在经侦取证过程中,应充分运用各种科学方法依法收集证据,正确处理涉案款物。

Evidence Rule and Requirement in Collecting Evidence in the Economic Crime Investigation

The economic crimes' evidences,as one of criminal evidences,must follow the general rule of the evidences.But currently our country neither has an entire evidence law nor confirms the corresponding evidence rule,which results in some problems that investigators often meet,such as,the legalization of collecting evidence procedure and the evidence-collecting means.To solve the above problem,we must confirm the corresponding evidence rule,meanwhile,the economic crimes' evidences have their particularities,so the investigators should use various kinds of scientific methods to collect the evidences in the course of evidence-collecting and handle the money involved in the cases rightly.
